HomeMy WebLinkAboutCity Council Resolution 2659 RESOLUTION NO: 2659 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA NODIFYING A DECISION OF THE PLANNING COMMISSION WHEREAS, HOLLY DAVIES, the applicant, has applied to the City of Saratoga for design review approval to construct a 1,453 square foot office building upon the property located at 14629 Big Basin Way (Application No. DR-90-006); a use permit to allow such office building to be located at street level (Application No. UP- 90-001); building site approval to allow development of a lot that has not been established as a lot of record within the previous 15 years (Application No. SD-90-001); and variance approval to allow construction of a privacy fence exceeding 6 feet in height and installation of a free-standing sign (Application No. V-90-012); and WHEREAS, on March 28, 1990, April 11, 1990, and May 9, 1990, the Planning Commission of the City of Saratoga conducted a public hearing on said applications, and following the conclusion thereof, the Planning Commission approved the applications; and WHEREAS, Barbara Van Derveer, Anne Wagner and Mary Boscoe have appealed the decision of the Planning Commission to the City Council; and WHEREAS, on June 6, 1990, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of the proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on June 6, 1990, by a vote of 4-1 with Councilmember Clevenger dissenting, did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was modified as set forth below. 2. The design review approval is modified to relocate the building to the west side of the lot, with the driveway being moved to the east side of the lot. With such change, the City Council was able to make the design review findings as set forth in Resolution No. DR-90-006 adopted by the Planning -1- Commission on May 9, 1990, and said Resolution is incorporated herein by reference, including all other conditions and requirements contained therein. 3. The fence to be installed along the easterly property line to separate the office building from the adjacent condominiums shall be constructed with overlapping boards so as to prevent any visibility through the fence. With such change, the City Council was able to make the variance findings as set forth in Resolution No. V-90-012 adopted by the Planning Commission on May 9, 1990, and said Resolution is incorporated herein by reference, including all other conditions and requirements contained therein. 4. Since no arguments were raised by the Appellants with respect to the granting of building site approval and the granting of a use permit, the decisions of the Planning Commission,'as set forth in Resolution No. SD-90-001 and Resolution No. UP- 90-001, are affirmed as originally rendered and said Resolutions are incorporated herein by reference, including all findings, conditions and requirements contained therein. The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 20th day of June, 1990, by the following vote: AYES: Councilmembers Moyles, Peterson, Stutzman and Mayor Clevenger NOES: None ABSENT: Counc i 1 member Anderson Mayor ATTEST: -2-
