RESOLUTION OF THE CITY COUNCIL OF THE CITY OF Si~R~TOGA UPHOLDING A DECISION OF THE PLI~NNING WHEREAS, pursuant to its continuing jurisdiction over use permits, the City initiated a review of the use permit granted to the Brookside Swim Club ("Brookside") to determine whether the prohibition contained therein against the consumption of alcoholic beverages on the premises ought to be removed, and to determine compliance with other conditions set forth in said use permit; and WHEREAS, on April 25, 1990, May 23, 1990, and June 13, 1990, the Planning Commission conducted a public hearing on the conditions of the Brookside use permit, and following the conclusion thereof, the Planning Commission removed the condition prohibiting the consumption of alcoholic beverages; and WHEREAS, Dee Askew has appealed the decision of the Planning Commission to the City Council; and WHEREAS, on July 24, 1990, the City Council conducted a · de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of the proceedings conducted by the Planning Commission, and the written evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on July 24, 1990, by a vote of 3-1 with Councilmember Monia dissenting and Councilmember Clevenger abstaining from participation on the matter, did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission to remove the prohibition against consumption of alcoholic beverages on the premises was affirmed. 2. The following additional conditions were imposed by the City Council: (a) Repairs to the existing fence along the creekside of the property shall be completed to the satisfaction of the Planning Director within 90 days from July 24, 1990. -1- (b) A new fence shall be installed on the southeast side of the property adjacent to the parking!lot, from the south property line to the northern end of the parking lot. Such fence shall be 8 feet in height and constructed of solid material so as to prevent light from penetrating the fence. The location and design of the fence shall be subject to approval by the Planning Director. Such installation shall be completed within 90 days from July 24, 1990. 3. No action was taken by the City Council on the request by the Brookside to modify or reverse the directive from the Planning Commission to remove or relocate the basketball standard. Consequently, such directive shall remain in full force and effect. The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 7th day of August, 1990, by the following vote: AYES: Councilmembers Anderson, Kohler, Monia and Stutzman NOES: None ABSTAIN: C0unci]member C]evenger ABSENT: None Mayor ~ ATTEST: erk~' ~ -2-
