HomeMy WebLinkAboutCity Council Resolution 2680 RESOLUTION NO: 2680 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UPHOLDING A DICI2ION OF THE WHEREAS, GTE Mobilnet, the applicant, has applied to the City of Saratoga for a use permit to construct a monopole cellular transmission tower and utility building and a variance to allow such tower to exceed the 30 foot maximum height limit, such applications being identified as UP-90-004 and V-90-020, and WHEREAS, on July 11, 1990, the Planning Commission of the City of Saratoga, conducted a public hearing on said applications, and following the conclusion thereof, the Planning Commission denied the applications; and WHEREAS, the applicant has appealed the decision of the Planning Commission to the City Council; and WHEREAS, on August 1, 1990, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of the proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on August 1, 1990, by a vote of 5-0, did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. Although the granting of a variance would not constitute a special privilege since licensed amateur radio station antennas may extend to a height of 65 feet and there is no height limit for utility poles, the City Council was unable to find any special circumstances related to the site. 3. The City Council directed staff to prepare an amendment to the zoning regulations that would allow installation of cellular telephone facilities at appropriate locations and subject to appropriate conditions and mitigation measures. Such ordinance -1- should ~e presente~ to Ene Plannxng consideration as soon as possible. The above and foregoing resolution was passed and adopted at a speCi=~]i~!~,~c' meeting of the City Council of the City of Saratoga held on the27th day of 1990, by the following vote: AYES: Councilmembers Anderson, Clevenger, Kohler, Monia, and Mayor Stutzman NOES: None ABSENT: None 'Mayor ~ A~ ~'~ City Clerk -2-
