RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SARATOGA UPHOLDING A DECISION OF
THE PLANKJNG COMMISSION
V-90"026, KOLSTAD
WHEREAS, JOHN KOLSTAD, the applicant, has applied to the City of
Saratoga for a variance to construct a garage addition to an existing single family
residence located at 13600 Westover Drive, encroaching 7 feet into the front yard
setback, such application being identified as V-90-026; and
WHEREAS, on October 24, 1990, the Planning Commission of the City of
Saratoga conducted a public hearing on said application, and following the conclusion
thereof, the Planning Commission denied the application; and
WHEREAS, the applicant has appealed the decision of the Planning
Commission to the City Council; and
WHEREAS, on November 20, 1990, the City Council conducted a de novo
public hearing on the appeal, at which time any person interested in the matter was
given an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in support
of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on November 20, 1990, by a vote of 5-0 did resolve as follows:
1. The appeal from the Planning Commission was denied and the
decision of the Planning Commission was affirmed.
2. The City Council was unable to make the findings required for
granting the variance for the same reasons as set forth in the Staff
Report to the City Council dated November 16, 1990, the Staff
Report to the Planning Commission dated October 24, 1990, and
Resolution No. V-90-026 adopted by the Planning Commission on
October 24, 1990, and said reports and resolution are incorporated
herein by reference. The City Council additionally noted that the
applicanrs residence was typical in design to other homes within the
neighborhood and to allow a variance in this case based upon the floor
plan would set a precedent for all other similarly situated structures.
Moreover, the proposal would result in the garage being located too
far into the front of the lot in relation to the other homes in the cul-
de-sac.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 5th day of December,
1990, by the following vote:
