WHEREA~, Robert A. Lanford and Kathleen Lanford executed an Offer To
Dedicate An Emergency Access Easement, dated May 12, 1988, as recorded on August
25, 1988, in Book K653, Pages 2175-2179, Official Records of Santa Clara County,
California, said Offer covering certain property located in the City of Saratoga,
County of Santa Clara, State of California, described as Parcel One and Parcel Two in
Exhibit "A" attached to and made a part thereof; and
WHEREAS, the City of Saratoga has not accepted the dedication of the
aforementioned emergency access easement; and
WHEREAS, the easement was intended to provide emergency access for
the occupants of Tract 7889, commonly known as the Gypsy Hill Subdivision; and
-r :E ~ WHEREA~, an alternative emergency access has now been established for
r.~ ~-- "' the Gypsy Hill Subdivision, and by reason thereof, the dedicated emergency access
h~ ~: r3 r.~ over Parcel One and Parcel Two is no longer required; and
~-- WHEREAS, Section 8330 of the California Streets and Highways Code
CD ~ r~ ,~ provides that the legislative body of a local agency may summarily vacate a street

W ~ C~ ~. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
~ r.~ . ~:~ Saratoga as follows:
~ *~ ~, 1. Pursuant to Part 3, Chapter 4 (commencing with Section 8330) of
~ Division 9 of the California Streets and Highways Code, the emergency access
Z Z ~.~ r.~ easement over Parcel One and Parcel Two, as described in the Offer To Dedicate An
Emergency Access Easement, dated May 12, 1988 and recorded on August 25, 1988, in
Book K653, Pages 2175-2179, Official Records of Santa Clara County, California, is
hereby vacated and abandoned.
2. The City Clerk is hereby authorized and directed to record a
certified copy of this Resolution in the Office of the Recorder for Santa Clara County,
California, and from and after the date of such recording, Parcel One and Parcel Two,
as described in said dedication, shall no longer constitute an emergency access
easement.
The foregoing Resolution was passed and adopted at a regular meeting of
the City Council of the City of Saratoga held on the 16th day of January .,
1991, by the following vote:
