[ VACA~G A DRDICA~D EMERGENCY ACC~ E~EMENT
WHEREAS, Sobey Oaks Associates, a partnership, executed an Owner's
Certificate offering for dedication an emergency access easement, twenty feet in
width, over a portion of Lots 7 and 8, as identified and shown on that certain Map of
Tract 7889 recorded on February 26, 1988, in Book 583 of Maps, Pages 53, 54 and 55,
Official Records of Santa Clara County, California, said Map covering property
located in the City of Saratoga, County of Santa Clara, State of California, commonly
known as the Gypsy Hill Subdivision; and
WHEREAS, the City of Saratoga accepted the dedication of the
aforementioned emergency access easement; and
WHEREAS, an alternative emergency access has now been provided for the
Gypsy Hill Subdivision, and by reason thereof, the dedicated emergency access over
Lots 7 and 8 is no longer required; and
I~1 WHEREAS, Section 8330 of the California Streets and Highways Code
f.D provides that the legislative body of a local agency may summarily vacate a street
IZ that has been superseded by reloeation,
;l~" .. ~ C3 NOW, THEREFORE, BE 1T RESOLVED by the City Council of the City of
r.3 I-- ~ .l Saratoga as follows:
re t~J I~1 i-- 1. Pursuant to Part 3, Chapter 4 (commencing with Section 8330) of
C3 ~ fJ} ~I: Division 9 of the California Streets and Highways Code, the emergency access
~ easement over a portion of Lots 7 and 8, as identified and shown on the Map of Tract
I-- ~ Ld 4[ 7889 recorded on February 26, 1988, in Book 583 of Maps, Pages 53, 54 and 55, Official
LIJ I:~ ID Records of Santa Clara County, California, is hereby vacated and abandoned.
f.5 I--: 2. The City Clerk is hereby authorized and directed to record a
C:D ~I: ~CD certified copy of this Resolution in the Office of the Recorder for Santa Clara County,
California, and from and after the date of such recording, the area covered by said
:Z: Z_ f_~ L1 dedication shall no longer constitute an emergency access easement.
3. The City Council expressly preserves the dedicated public service
easement over a portion of Lots 7 and 8, as identified and shown on said Map of Tract
7889, and nothing herein shall be deemed to affect, impair, or vacate such public
service easement.

The foregoing Resolution was passed and adopted at a regular meeting of
the City Council of the City of Saratoga held on the 16th day of 3anuar¥ . ,
