SECTION 1: Reference is hereby mde to the following Offer
of O~ication ~ the City of Saratoga covering
rights-of~ay over ~ions of streets:
a.) Offer r~orded on _.Febr~ary..~...~. 1986 , in Book
~6 - at Page .7 and 9 of Santa Clhra ~ty Records.
SECTION 2: Th~ aforesaid Offer of Dedication is hereby accepted
by t~ City of Saratoga and the above portions of
said streets covered ~ereby are hereby decl~ed to be public streets
of the City of Saratoga.
BE IT FURTHER RESOLVED:
~ That the following described Improvement Bond is hereby ordered released:

RESOLUTION NO. 91-28
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SARATOGA GRANTING IN PART AND
DENYING IN PART AN APPEAL FROM A DECISION
OF THE PLANNING COMMISSION
DR- 9 0 - 0 4 8.1 -RINALDO
WHEREAS, Alfred Rinaldo, the applicant, has applied to the
City of Saratoga for design review approval to construct a new
single family residence upon an existing lot of record located at
14071 Saratoga-Sunnyvale Road, such application being identified
as DR-90-048.1; and
WHEREAS, on January 9, 1991, the Planning Commission of the
City of Saratoga conducted a public hearing on said application,
and following the conclusion thereof, the Planning Commission
denied the application; and
WHEREAS, Alfred Rinaldo has appealed the decision the of the
Planning Commission to the City Council; and
WHEREAS, on February 20, 1991, the City Council conducted a
de novo public hearing on the appeal, at which time any person
interested in the matter was given an opportunity to be heard;
and
WHEREAS, the City Council reviewed and considered the staff
reports, minutes of proceedings conducted by the Planning
Commission relating to said application, and the written and oral
evidence presented to the City Council in support of and in
opposition to the appeal,
NOW, THEREFORE, be it resolved by the City Council of the
City of Saratoga as follows:
1. The appeal from the Planning Commission is hereby
granted in part and hereby denied in part and the decision of the
Planning Commission is affirmed in part and reversed in part, to
wit:
(a) The height, elevation and placement on the site of
the proposed structure, when considered. with reference to the
nature and location of residential structures on adjacent lots,
will avoid unreasonable interference with views and privacy, in
that the structure has been scaled down from an originally
proposed two-story structure to a one-story structure.
(b) The natural landscape will be preserved insofar as
practical and tree removal is minimized to the extent that three
non-ordinance sized trees which are poor ornamental specimens
with inappropriate growth habits and one of which is causing root
damage, and one ordinance sized tree which has been found to be a
nuisance to neighboring property and which if allowed to remain
would req~/ire the building site to be moved closer to Saratoga-
Sunnlrvale Road, resulting in greater noise to the inhabitants of
the residential structure are to be removed. One ordinance sized
tree, a Coastal Redwood, will be preserved on the site. Grade
changes will be limited to excavation for the building
foundations to be designed in accordance with the specifications
of the City Arborist.
(c) The proposed structure will minimize the
perception of excessive bulk and will be compatible in terms of
bulk and height with existing residential structures within the
i~mmediate neighborhood and shall not unreasonably impair the
light and the air of adjacent properties nor unreasonably impair
the ability of adjacent properties to utilize solar energy, in
that the proposed residential structure is one story in height in
a neighborhood of predominantly one-story homes.
(d) The structure shall be located and constructed as
shown on Exhibit "A", incorporated herein by reference. Exhibit
"A" shall include an architectural rendering of the proposed
structure.
Passed and adopted at a regular meeting of the City Council
of the City of Saratoga held on the 6th day of March ,
1991, by the following vote:
AYES: Councilmembers Anderson, Clevenger, Kohler, Monia, and Mayor Stutzman
