A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SARATOGA GRANTING AN APPEAL FROM
A DECISION OF THE PLANNING COMMISSION
DR-90-065-EMAMI
WHEREAS, Mr. and Mrs. Robert Emami, the applicant, has
applied to the City of Saratoga for design review approval to
construct a new single-family residence on an existing lot of
record located at 20760 Wardell Road (Parcel No. 2), such
application being identified as DR-90-065; and
WHEREAS, on June 12, 1991, the Planning Commission of the
City of Saratoga conducted a public hearing on said application,
and following the conclusion thereof, the Planning Commission
denied the application; and
WHEREAS, applicant has appealed the decision of the Planning
Commission to the City Council; and
WHEREAS, on July 17, 1991, the City Council conducted a de
novo public hearing on the appeal, at which time any person
interested in the matter was given an opportunity to be heard;
and
WHEREAS, the City Council reviewed and considered the staff
reports, minutes of proceedings conducted by the Planning
Commission relating to said application, and the written and oral
evidence presented to the City Council in support of and in
opposition to the appeal;
NOW, THEREFORE, be it resolved by the City Council of the
City of Saratoga as follows:
1. The appeal from the Planning Commission is hereby
granted and the decision of the Planning Commission is reversed,
to wit:
(a) The height, elevation and placement on the site of
the proposed structure, when considered with
reference to the nature and location of
residential structures on adjacent lots, will
avoid unreasonable interference with views and
privacy, in that unique design elements are used
to tone and minimize bulk and mass concerns such
chimney, bay window and room projections and roof
lines which vary in height and form. The
topographical conditions of the parcel consisting
of Calabazas Creek to the east and existing

vegetation, will help screen the residence from
surrounding properties. The residence will not be
seen by the greater area of the City due to its
location with the valley floor.
(b) The natural landscape will be preserved insofar as
practical.
(c) The proposed structure will not unreasonably
impair the light and air of adjacent properties
nor unreasonably'impair the ability of adjacent
properties to utilize solar energy.
(d) The structure shall be located and constructed as
shown on Exhibit "A", incorporated herein by
reference. Exhibit "A" shall include an
architectural rendering of the proposed structure.
Passed and adopted by the City Council of the City of
Saratoga, California, at a meeting thereof held on the 7 th
day of August _, 1991, by the following vote:
