WHBREAS, the City Council recently reviewed a Park and Trails
Master Plan recommended by the Parks and Recreation Commission; and
WHBREAS, the city is preparing amendments to the Open Space
and Circulation Elements of the General Plan, and these elements
contain policy regarding the implementation of a trails master
plan; and
WHBREAS, citizens residing along portions of Saratoga and
wildcat Creeks have expressed concerns over the impact of the
creation and utilization of creekside trails on the existing
residential uses abutting those creeks; and
nODS, the City Council recognizes the potential significant
impacts of trails along creeks wi thin established residential
developments in the R-l and R-M zone districts; and
WBBRDS, a City trail system can be developed and maintained
for the benefit of all citizens of saratoga without including a
continuous creekside trail within the Saratoga and wildcat Creek
corridors.
JlOW, THERBFORB, BB IT RBSOLVBD, that the City council adopts
the following policy statement:
It shall be the policy of the City not to acquire, plan or
develop trail easements or public access easements along
wildcat Creek or Saratoga Creek, across single or mUlti-family
land uses as designated in the Saratoga General Plan abutting
said creeks, or adjacent to said creeks between the centerline
thereof and any single or mUlti-family designated property.
This policy statement shall apply to Saratoga Creek from
Prospect Avenue south to Tollgate Road, and to Wildcat Creek
from Quito Road south to the Villa Montalvo Arboretum property
line, with the exception of the section between Carnellian
Glen Drive and Douglass Lane.
This policy shall not apply to dedicated trail easements in
the subject area.
The City Council so directs that this policy statement be
incorporated into the Circulation and Open Space Elements of the
General Plan as soon as possible.
