PROGRAM MANAGER POR, AB 434 (SHER-1991) VEHICLE REGISTRATION FEE REVENUES WHEREAS, the State of California enaded the CaJJfomia Clean AIr Ad of 1988, requiring air distrtdS to adopt, and dtles and counties to implement, certain transportation control measuæs in order to improve air quaUty¡ and, WHEREAS, the State of California enacted Congestion Management Legislation In 1989 and 1990, requiring dties and counties to implement Congestion Management Programs (CMP) to reduce traffic congestion and improve air quality; and, WHEREAS, the county and the cities of Santa Clara County have in response to the aforementioned State Legislation created the Santa Clara County Congestion Management Agency; and, WHEREAS, the Santa Clara County Congestion Management Agency operates the Commuter Network Transportation Demand Management Program for the benefit of its member ageodes; and, WHEREAS, the State of California enacted AD 434 (Sher) in 1991, to provide vehicle registration fee revenues to fund certain transportation control measures through the subvention of forty percent of the County's proportionate share of the revenue to a designated county-wide overall program manager; and, . WHEREAS, in order to qualify for the subvention of forty percent of the County' s proportionate share of the revenue, the majority of the population must designate, by resolution, a county-wide overall program manager to implement local programs and projects. NOW, 1HEREFORE, BE IT RESOLVED, that the City Council of the City of Sa.r~toga designates the Sartta Clara County Congestion Management Agency, as the County-wide Ovea.ll PrQIr'am Manager for projects and programs, and for the redplent of the County' I' forty percent proportionate share of the fee-paid vehide registration fee revenues, accordJng to the following terms and conditions: The Santa Clara County Con¡eslion Management Agency shall: 1. Develop, implement and administer transportation control projects and programs as set forth In state statutes. 2. The projedS and programs so developed, implemented and administered shall be incorporated: into the annual budgets and work programs of the 3. Congestion Management Alency, and Into the Commuter Network Transportation Demand Manapment Program. The Congestion Manasemen1 Agency will encumber the funds within two years of receiving the tu:ftds. The Conlestion Management Agency will, at least once every two years, undenake an audit of fåch project or propam. funded, according to the condIdons set forth in såte ~tutes.
