HomeMy WebLinkAboutCity Council Resolution 92-031.1 .'--'~.'--'--'--'- ..-...,--,-..-.,--.-.,-.,..,..,..,-.,..,-.,..,-.,-.,-.'_.'_.'-~'-.'~~I~~'~~I~~~~'-.'_.'_.'..'_.'_.,-_,- - RESOLUTION NO. 92.~1 A RESOLUTION OF THE CITY OF SARATOGA AMENDING RESOLUTION NO. 92-031 REGARDING DEDUCTIONS FROM COMPENSATION OF EMPLOYEES EXEMPT FROM THE OVERTIME PROVISIONS OF THE FAIR LABOR STANDARDS ACT WHEREAS, it is and at all times has been the administrative practice of City officials and the intent of the city Council that all relevant applicable provisions of the Fair Labor Standards Act (FLSA) be followed by City officials; and WHEREAS, the U.S. Department of Labor has published a new final regulation concerning the FLSA, effective September 18/ 1992, and this new regulation provides public sector employers with a special limited exception from certain salary test requirements; and WHEREAS, this exception is designed to provide protection to public sector employers who utilize pay systems that reduce the pay (or leave balance) of otherwise exempt employees for partial day absences; and NOW, THEREFORE, BE IT RESOLVED that effective September 18, 1992, the administrative policy contained on p. 12 of the city of Saratoga Personnel and Administrative Policies Manual, which states that "Annual leave is to be used for all time off from work except for Jury Duty, Military Duty or Matern! ty Leave," is reinstated for the employees designated as exempt from the overtime requirements of the FLSA (the designated management positions of the city service set forth in Resolution 85-9.69 as amended.) The above and foregoing resolution was passed and adopted at a regular meeting of the city Council of the City of Saratoga held on the 7th day of October, 1992, by the fOllowing vote: AYES: Councilmembers Burger, Kohler, Mania, Tucker and Mayor Anderson NOES: None ABSENT: None 1, /ì/l {Û1.<l ø J!v.
