HomeMy WebLinkAboutCity Council Resolution 92-032 RESOLUTION NO. 92-032 , " A RESOLUTION DESCRIBING IMPROVEMENTS AND DIRECTING PREPARATION OF ENGINEBR'S REPORT PaR FISCAL YEAR 1992-1993 CITY OF SARATOGA LANDSCAPING AND LIGHTING DISTRICT LLA-1 RESOLVED, by the City Council of the city of Saratoga, California, as follows: 1. This Council did, pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the streets and Highways Code of the state of California, conduct proceedings for the formation of the city of Saratoga Landscaping and Lighting District LLA-l and for the levy and collection of assessments for fiscal year 1980 - 1981, and did, on June 18, 1980, pursuant to proceedings duly had, adopt its Resolution No. 950-0, A Resolution Overruling Protests and Ordering the Formation of an Assessment District and the Im.provements and Confirming the Diagram and Assessments1 2. The pUblic interest, convenience and necessity require, and it is the intention of said Council to undertake proceedings for the levy and collection of assessments upon the several lots or parcels ot land in said District, for the construction or installation of improvements, including the maintenance or servioing, or both, thereof, for the fiscal year 1992 - 1993. 3. The improvements to be constructed or installed, including the maintenance or servicing, or both thereof, are more particularly described in Exhibit "A" hereto attached and by reference incorporated herein. 4. The costs and expenses of said improvements, including the maintenance and servicing, or both, thereof, are to be made chargeable upon said District, the exterior boundaries of which District are the composite and consolidated area as more particularly shown on a map thereot on file in the office of the Clerk of the City of Saratoga to which reference is hereby made for further particulars. said map indicatès by a boundary line the extent of the territory included in said District and of any zone thereof and shall govern tor all details as to the extent of the assessment district. 5. The Engineer of said city be, and is hereby, directed to prepare and file with said Clerk a report, in writing, referring to the assessment district by its distinctive designation, specifying the fiscal year to which the report applies, and, with respect to that year presenting the following: a) plans and specifications of the existing improvements and for proposed new improvements, if any, to be made within the assessment district or within any zone thereof; b) an estimate of the costs of said proposed new improve... ments, if any, to be made, the costs of maintenance or servioing, or both, thereof, and of any existing im- p~ovements, together with the incidental expenses in conneotion therewith~ c) diagram showing the exterior boundaries of the assess- ment district and of any zones within said district and the lines and dimensions of each lot or parcel of land within the district as such lot or parcel of land is shown on the County Assessor's map for the fiscal year to which the report applies, each of which lots or parcels of land shall be identified by a distinc- tive nuaber or letter on said diagram; and d) a proposed assessment of the total amount of the esti- mated costs and expenses of the proposed new improve- ments, including the maintenance or servicing, or both, thereof, and of any existing improvements upon the several lots or parcels of land in said district in proportion to the estimated benefits to be receiv- ed by suoh lots or parcels of land, respectively, from said iaprovements, including the maintenance or ser- vicing, or both, thereof, and of the expenses inciden- tal thereto. 6. The Off ice of the Engineer of said city be, and is hereby, designated as the office to answer inquiries regarding any protest prooeedings to be had herein, and may be contacted during regular office hours at the City Hall, 13777 Fruitvale Avenue, Saratoga, California 95070 or by calling (408) 867-3438. City Clerk- ". rJ ,,-- EXHIBIT "An CITY OF SARATOGA LANDSCAPING AND LIGHTING DISTRICT LLA-1 a) The construction or installation, including the maintenance or servicing, or both, thereof,- wi thin ZQne,s 1, 2, 3, 9, 10, 11, 12, 13, 14, 15, 17, 18 and 22 of landscaping, including trees, shrubs, grass or other ornamental vegetation, stat- uary, fountains and other ornamental structures and facili- ties, including tbe cost of repair, removal or replacement of all or any part thereof, providing for the life, growth, health and beauty of landscaping, inçluding cultivation, irrigation, trimaing, spraying, fertilizing or treating for disease or injury, the removal of trimmings, rubbish, debris and other solid waste water for the irriqation of any land- scaping, the operation of any fountains or the m.aintenance of any other improv81llents. b) The construction or installation, includinq the maintenance or servicing, or both, tbereof, within Zones 4, 5, 6 and 7, of public lighting facilities for the lighting of any public places, including ornamental standards, luminaires, poles, supports, tunnels, manholes, vaults, conduits, pipes, wires, conductors, guys, stUbs, platforms, braces, transformers, insulators, contacts, switches, capacitors, meters, coømuni- cation circuits, appliances, attaohments and appurtenances, including the cost at repair, removal, or replacement ot all or any part thereof, electric current or energy, gas or other illuminating agent for any public lighting facilities or for the lighting or operation of any other improvements. c) The construction or installation, including the maintenance or servicing, or both, thereot, within Zones 8, 16, 19, 20 and 21 of landscaping, including trees, shrubs, grass or other ornamental vegetation, statuary, fountains and other ornamen- tal structures and facilities and public lighting facilities for the lighting of any public places, including ornamental standards, 1 wainaires , pol es , supports, tunnels, manholes, vaults, conduits, pipes, wires, conductors, guys, stubs, plat- forms, braces, transformers, insulators, contacts, switches, capacitors, ..ters, co_untcatien circuits, appliances, attach- ments and appurtenances, including the cost of repair, removal or replace.ant of all or any part thereof, providing for the life, growth, health and beauty of landscaping, including cul- tivation, irrigation, tri_lng, spraying, fertilizing or treat- ing for disease or injury, the removal ot trimmings, rubbish, debris and other 801id waste, electric current or lighting faoilities or for the lighting or operation of any other im- provements, water for the irrigation of any landscaping, the operation of any fountains or the maintenanoe of any other improvement.s.
