RBSOLUTION NO. 92-059
A RESOLUTION OF THE CITY OF SARATOGA
ADOPTING THE CITY'S SOURCE REDUCTION AND RECYCLING ELEMENT
AND HOUSEHOLD HAZARDOUS WASTE ELEMENT
WHEREAS, California Public Resources Code Section 41000
requires the City of Saratoga (the "Citytl) to prepare, adopt and
submit to Santa Clara County (the "Countyfl) a Source Reduction
and Recycling Element ("SRREtI) that proposes programs to reduce
or recycle 25 per cent of the City's solid waste being landfilled
by January 1, 1995, and 50 per cent by January 1, 2000; and
WHEREAS, Public Resources Code Section 41500 requires the
city to prepare, adopt and submit to the County a Household
Hazardous Waste Element ("HHWEtI) that proposes programs to safely
collect, recycle, treat and dispose of household hazardous wastes
generated by households in the City and which should be separated
from the solid waste stream; and
WHEREAS, pursuant to Public Resources Code Section 41793,
the City Council of the City duly noticed and the city Council
conducted a public hearing on July 1, 1992, to receive testimony
on the preliminary drafts of the SRRE and HHWE¡ and
WHEREAS, pursuant to section 18766 of Title XIV, Chapter 9,
of the California Code of Regulations, the City Council of the
City duly noticed and conducted a second public hearing on
September 2, 1992, to consider the final drafts of the SRRE and
the HHWE, and the City Council has considered all the comments of
the members of the Council and the public on the SRRE and the
HHWE ¡
NOW, THEREFORE, the City Council of the City of Saratoga
does hereby resolve as follows:
section 1. The City Council has considered and hereby
approves the mitigated Negative Declaration prepared for the SRRE
and the HHWE and finds that the project will have no significant
environmental effects, as shown in said mitigated Negative
Declaration, for purposes of the California Environmental Quality
Act.
Section 2. The Council hereby approves and adopts the SRRE
and the HHWE in accordance with the above determinations.
Section 3. The Council hereby directs the City Manager or
his designee to transmit the SRRE and the HHWE/ on behalf of the
City, to the county for incorporatiDn into the Countywide
Integrated Waste Management Plan.
The foregoing Resolution was regularly introduced and
adopted at a Regular meeting of the City Council of the City of
Saratoga, duly held on the 2nd day of September, 1992, by the
following vote:
