A RBSOLUTION OF THB CITY COUNCIL
OF THE CITY OF SARATOGA WAIVING COMPBTITIVB
BIDDING PROCEDURES - BONNBT WAY BOUNDWALL,
CAPITAL PROJECT NO. 9113
RBCITALS
WHEREAS, the Route 85 Construction Project includes the
construction of soundwalls along portions of Route 85; and
WHEREAS, as a result of the construction of Route 85 the
Southern Pacific Railroad tracks were relocated in close
proximity to Bonnet Way; and
WHEREAS, due to the relocation of the railroad tracks, the
City has decided to construct the proposed soundwall along Bonnet
Way within the Bonnet Way right-of-way on the community side of
the relocated railroad tracks, in order to provide both visual
and noise mitigation from the railroad tracks and Route 85; and
WHEREAS, the City and the Santa Clara County Traffic
Authority have entered into an agreement to credit the City an
amount of money equal to the cost of constructing the soundwall
in its original, proposed location; and
WHEREAS, the City Engineer has recommended that the City
Council waive the city's competitive bidding process and
authorize the City Engineer to solicit informal bids and
negotiate a contract price for construction of the Bonnet Way
soundwall with the four contractors currently working on the
Route 85 project;
NOW, THEREFORE, the City Council of the City of Saratoga
does resolve as follows:
1. The City Council determines that, for the following
reasons, use of the competitive bidding process is impracticable,
would not likely result in a lower price to the City from a
responsible bidder, and would cause unnecessary expenses or
delay:
(a) Four contractors are currently working in Saratoga
on the Route 85 project and are constructing similar soundwalls
in conjunction with the Route 85 project;
(b) These contractors have already secured all
necessary governmental permits, rights of access to the freeway
corridor and railroad right-of-way, for the performance of such
work;
(c) These contractors have already mobilized and have
placed on site all the required construction equipment and are
currently purchasing the same materials required to construct the
Bonnet Way Soundwall, in large quantities, all of which should
result in advantageous prices to the city.
2. The competitive bidding process is hereby waived and the
City Engineer is authorized to solicit informal bids and
negotiate a contract price with current Route 85 contractors for
the construction of the Bonnet Way soundwall.

The above and foregoing resolution was passed and adopted at
a regular meeting of the City Council of the City of Saratoga
held on the 21st day of October I 1992, by the
following vote:
