A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SARATOGA ACCEPTING LETTER PROPOSAL
FOR ENGINEERING SERVICES
(LEONARD ROAD ASSESSMENT DISTRICT) -
The City Council of the City of Saratoga resolves:
The City Council hereby accepts the letter proposal
submitted by John Heindel, dated June 7, 1993, to serve as
Engineer of Work in Leonard Road Assessment District, city of
saratoga, Santa Clara County, California. A copy of the letter
proposal i~_attached to this resolution.
The Public Works Director is authorized to approve the
letter proposal by signing a copy and returning it to Mr.
Heindel.
PASSED AND ADOPTED at a regular meeting of the city
council of the City of saratoga held on the 7th day of JUly,
1993, by the following vote:

Ladies and gentlemen:
As you requested, I am pleased to submit this proposal to provide
assessment engineering services relative to the formation of an
assessment district in the City of Saratoga to improve portions of
Leonard Road, and tp prepare the Engineer's Report required by the
Municipal Improvement Act of 1913.
Scope of Services
I propose to perform the services detailed in enclosed Exhibi t
"A".I have assumed that there will be a valid petition signed by
the owners of at least sixty percent of the area to be included
in the assessment district, and therefore a report pursuant to the
provisions of the Special Assessment Investigation, Limitation and
Majority Protest Act of 1931 will not be required.
Compensation for Services
I propose to perform the above services for the compensation
detailed in section I of enclosed Exhibit ¡'B". I propose that
payment of compensation be made in accordance with section II of
Exhibit "B".
The compensation I propose in Exhibit "B" is based on the data
requirement asswnptions included in Item 2 of Exhibit "A". In the
event that different data are required to implement the selected

assessment formula, I propose that an adjustment to the
compensation be negotiated.

SCOPI OF SBRVICES
BASIC SERVICES
1) Determine the formula for spreading the costs to the various
parcels within the Project, subject to approval by the City's
bond counsel and the City staff.
2} Compile the data required to implement the selected formula.
This data will include for each parcel within the proposed
boundaries of the assessment district:
a} Assessor's parcel number
b} Property owner's name and address
c) Parcel frontage on the proposed improvements
d) Number of potential residential parcels under the
City's present zoning ordinance.
3) Prepare one or more spreads of Project costs, based upon cost
information provided by the City and/or others.
4) Respread costs if required by changes ordered by the City
Council at the public hearing for the Project.
S) Represent the cíty at informal meetings with property owners
and/or their representatives, which may be held at various
stages of the proceedings, to explain the rules of spread, to
answer questions on matters related to Consultant's duties,
and to receive input.
6) Testify at public meetings at which the Project is to be
considered, including the public hearing and any continuances
thereof, as to benefits and other matters related to
Consultant's duties.
7) Assist the City with determining whether a majority protest
exists.
8) Consult and maintain liaison with the city's bond counsel,
the city staff and others as required, concerning costs and
other matters related to Consultant's duties.
9) Prepare exhibits for meetings, hearings and legal notices, if
required.

10) Prepare the record boundary map and assessment diagram for
the Project.
11) Produce the public hearing notices required by law (wording
to be provided by the City's bond counsel), formatted for
mailing in window envelopes.
12) Mail the notices described above, including folding notices
and stuffing in window envelopes (to be provided by the
City), sealing envelopes, applying first class postage,
delivering to the U. S. Postal Service, and executing a
certificate of mailing on a form provided by the City's bond
counsel.
13) Prepare the Engineer's Report required by the Municipal
Improvement Act of 1913, including revisions thereto ordered
at, or prior to, the pUblic hearing, and execute the
Engineer's Report as Engineer of Work.
14) Provide up to ten copies of the Engineer's Report and an
equal number of copies of an amended report if required by
revisions ordered at, or prior to, the public hearing.
ADDITIONAL SBRVICBS
15) Produce the list of paid and unpaid assessments.
16) Produce and mail notices of recordation of assessment in
accordance with, Section 10404 of the Streets and Highways
Code. (Text to 'be provided by the City's bond counsel).
17) Provide an Auditor's Record containing bond principal and
interest amounts for the term of the bonds, for all parcels
for which assessments were not paid in cash, formatted to the
County Auditor's requirements.
18) Perform segregation of assessments for any parcels for which
assessments were not paid in cash, which have been subdivided
or otherwise changed during the term of the bonds.

EXHIBIT "B"
COMPBNSATION FOR SERVICES
I . p.MOUNT
A. For the Basic Services set forth in Exhibit "A" herein,
a lump sum fee of $5,500.00.
B. For the Additional Services set forth in Exhibit "A"
herein, a fee to be negotiated upon determination of the
specific scope of said services.
C. For any extra work, the rate of $100.00 per hour
expended by Consultant, plus 115% of the actual cost of
any outside services and expenses incurred by
Consultant.
Consultant's fee as specified above shall be full
compensation to Consultant for all costs and expenses
incurred by him in connection with the performance of his
duties described herein including, but not limited to, cost
of supplies, facilities, equipment, consultants, travel,
telephone, typing, duplicating, and all other items of
general overhead.
In the event that Consultant's services have not been
completed within the period ending twelve (12) months from
the date of execution 'of the agreement to perform the
services described herein, the portion of Consultant's fee as
described above which is unbilled at the end of each
anniversary of said execution shall be escalated by ten
percent (10%).
II. PAYMENT
Consultant's fee for Item LA. above shall be billed and paid
monthly as the work progresses, based upon the estimated
percentage of completion of said duties.
Consultant's fee for Items I.B. and I.C. above shall be billed and
paid monthly as the work progresses.

WORR TO BB PIRFORMED BY THE CITY
1. Make available all plans, reports, estimates and other
data relative to the costs to be assessed and benefits
to be received by the various parcels within the
District.
2. Review documents presented by Consultant and, within a
reasonable time, notify Consultant of any error,
omission or other defect which the City believes to be
contained therein.
3. Advertise and distribute bid documents, receive and open
bids, and administer all construction contracts.
4. Execute all documents which are to be recorded with the
County Recorder, and pay all recording fees.

prepare all necessary resolutions for adoption by the
