A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SARATOGA REPEALING RESOLUTION NO. 1084,
RELATING TO ACCEPTANCE OF HILLSIDE ROADS
AS PUBLIC STREETS
WHEREAS, the City Council of the City of Saratoga adopted
Resolution No. 1084 on April 27, 1982, which resolution
restricted acceptance of offers of dedication of hillside roads
unless the roads in question are a main arterial or collector and
that the benefits to be derived from the public outweigh the
City's costs of maintenance of such roads; and
WHEREAS, the City Council has introduced an ordinance adding
Article 9-65 to the Code of the City of Saratoga which would
establish a mechanism for financing the costs of extraordinary
repair and maintenance of all new hillside roads, thereby
allowing offers of dedication of such roads to be accepted upon
payment of a Hillside Street Repair Fee; and
WHEREAS, upon adoption of the aforedescribed ordinance, it
is the desire of the City Council to exercise its lawful
discretion to accept future offers of dedication of all new
hillside roads which otherwise meet all applicable construction
standards and maintenance requirements of the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council that the
City Council of the City of Saratoga does hereby repeal
Resolution No. 1084, which resolution shall be of no further
force or effect; provided, however that the repeal of Resolution
No. 1084 shall become effective only upon this Council adopting
an ordinance by no later than July 1, 1994, establishing a
Hillside Street Repair Fee for financing future anticipated costs
of extraordinary repair of all new hillside streets.

The above and foregoing resolution was passed and adopted at a
regular meeting of the City Council of the City of Saratoga held
on the 1st day of aune , 1994, by the following vote:
AYES: Councilmembers Anderson, Burger, Kohl er, Moni a and Mayor Tucker
