RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
COMMITTING LOCAL MATCHING FUNDS FOR THE
SARATOGA-SUNNYVALE ROAD IMPROVEMENT PROJECT
Whereas, the Intermodal Surface Transportation and Efficiency
Act of 1991 (ISTEA) (Public Law 102-240, Dec. 18, 1991) created the
Surface Transportation Program and the Congestion Mitigation and
Air Quality improvement program; and
Whereas, pursuant to the ISTEA, and the regulations
promulgated thereunder, eligible project sponsors wishing to
receive Surface Transportation Program or Congestion Mitigation and
Air Quality improvement program grants for a project shall submit
an application first with the appropriate metropolitan
transportation planning organization (MPO), for review and
inclusion in the MPO's Transportation Improvement Program (TIP);
and
Whezeas, the Metropolitan Transportation Commission is the MPO
for the San Francisco Bay region; and
Whereas, the City of Saratoga is an eligible project sponsor
for the Surface Transportation Program (STP) or Congestion
Mitigation and Air Quality (CMAQ) improvement program funds; and
Whe:eas, the City of Saratoga wishes to submit a grant
application to MTC for funds from the STP/CMAQ program in fiscal
year 1995-96 for the following project:
8ARATOGA-SUNNYVALE ROAD IMPROVEMENTS $899,000
Whereas, MTC requires, as part of the application, a
resolution stating the following:
1) the commitment of necessary local matching funds (at least
20% for bicycle and pedestrian projects, and at least 11.5%
for all other projects); and
2) that the sponsor understands that the STP/CMAQ program
funding is fixed at the programmed amount, and therefore
any cost increase cannot be expected to be funded with
STP/CMAQ program funds; and
3) the assurance of the sponsor to complete the project as
described in the application, and if approved, as
programmed in MTC's TIP.
Now, therefore, be it resolved, by the City Council of the
City of Saratoga that the Director of Public Works is authorized to
execute and file an application for funding under the STP/CMAQ
program of the ISTEA in the amount of $899,000 for Saratoga-
Sunnyvale Road Improvements; and
Be it further resolved, that the City of Saratoga by adopting
this resolution does hereby state that:
1) The City of Saratoga will provide $224.750 (20%) in local
matching funds; and
2) The City of Saratoga understands that the STP/CMAQ program
funding for the project is fixed at .$899,000 and that
any cost increases must be funded by the City of Saratoga
from local matching funds, and that the City of Saratoga
does not expect any cost increases to be funded with STP or
CMAQ funds; and
3) The Saratoga-Sunnyvale Road Improvements will be built as
described in this resolution and, if approved, as
programmed in the Metropolitan Transportation Commission
(MTC) Transporation Improvement Program (TIP).
PASSED and ADOPTED by the City Council of the City of Saratoga at
a regular meeting held on the 3rd day of August, 1994, by the
following vote:
