HomeMy WebLinkAboutCity Council Resolution 95-10 RESOLUTION NO. 95-10 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF B~t~TO~A DECLARING CERTAIN CITY-OWNED RF~L PROPERTY BURPLUS, ~ A~ORIZINa IT2 DISPOSITION RECITALS 1. The City of Saratoga owns certain real property (hereinafter "property'~) located on Fifth Street, east of Big Basin Way, and more particularly described in the attached Exhibit A. 2. The Public Works Director has determined that based upon the size, location and utility of the property, the value of the property is less than $250.00. 3. The owner of property adjacent to the City-owned property has received design review approval for a five-unit condominium complex (DR-No. 93-020) and tentative subdivision map for such project (SD-No.93-005). The adjacent property owner has expressed an interest in obtaining the subject property from the City and has offered to perform certain improvements upon other City-owned property within Village Parking District No. 2 in consideration for obtaining the subject property. 4. The Public Works Director recommends that the City Council authorize the disposition of the City-owned property to the adjacent property owner in consideration for certain improvements being made by the adjacent property owner to other City-owned property within the Village Parking District No. 2. NOW, THEREFORE, the City Council of the City of Saratoga RESOLVES as follows: 1. That the above-described City-owned property has become unnecessary for City purposes and is declared to be surplus. 2. That the disposition of the subject property to the adjacent property owner is authorized, in consideration of the adjacent property owner performing the following improvements on other City-owned property within the Village Parking District No. 2: a. Construction of a new trash enclosure in conformance with requirements established by the Public Works Director. 1 b. Creation of five new parking stalls, in conformance with City standards. c. Installation of landscaping improvements, in conformance with requirements established by the Public Works Director. 3. The City Manager is hereby authorized to execute all documents necessary to cause the transfer of ownership of the subject property to the adjacent property owner in consideration for the improvements described in Section 2 above; provided, however, the actual transfer of ownership of the subject property shall not be recorded until security in a sufficient amount as determined by the Public Works Director, to guarantee completion of the aforementioned improvements is furnished to the Public Works Director. *** Passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 15th day of February , 1994, by the following vote: AYES: Counciln~s Jacobs, Moran, Tucker, Wolfe and Mayor Burger NO ES: None ABSENT: None ABSTAIN: None U ATTEST: Deputy City Clef] nrsw\ 2 7 3 \Res \D4 spstn. sur 2 EXHIBIT A LEGAL DESCRIPTION All that certain real property situate in the City of Saratoga, County of Santa Clara, State of California described as follows: Beginning at the southwesterly comer of Parcel A as said Parcel is shown on that certain Parcel Map recorded in Book 440 of Maps at pages 41 and 42, Santa Clara County Records, said point being at the intersection of the southeasterly line of Big Basin Way and the northeasterly line of Fifth Street as shown on said Map; thence along the said line of Fifffi Street for purposes of this description S 47°00 '00" E 168.49 feet to the TRUE · POINT OF BEGINNING; thence N 40°45 '40" E 150.12 feet; thence N 47°00'00'' W 3.41 feet; thence S 43 °00'35" W 150.00 feet to the said northeasterly line of Fifth Street; thence along said line S 47°00'00'' E 9.33 feet to the TRUE POINT OF BEGINNING.
