RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA DETERMINING AND CERTIFYING TO COUNTY
AUDITOR THE FEE PAYABLE TO COUNTY TREASURER FOR
CANCELLATION OF WILLIAMSON ACT CONTRACT FOR
PROPERTY LOCATED AT 2085 1 SARATOGA HILLS ROAD
Recitals
WHEREAS, the Community Foundation as the owner of the property located
at 2085 1 Saratoga Hills Road ("Property") in Saratoga, Califomia, has filed a
petition with, the City requesting cancellation of the Williamson Act Contract as to
that property; and
WHEREAS, prior to the City Coundl giving tentative approval to the
cancellation of the Williamson Act Contract as to the Property, the Santa Clara
County Assessor shall certify the cancellation valuation of the land for the purpose of
determining the cancellation fee, and the City Council shall determine and certify, the
amount of the cancellation fee payable by the owner of the Property, to the Santa
Clara County Auditor; and
WHEREAS, by letter to the City Council dated March 27, 1995, a copy of
which is on file in the office of the City Clerk, the County Assessor has determined
that the cancellation valuation of the Property for the purpose of determining the
cancellation fee is $1,069,000;
NOW, THEREFORE, the City Council of The City of Saratoga Hereby
Resolves as follows:
i. The City of Saratoga hereby determines and certifies that the
cancellation fee which the landowner of the property located at 2085 1 Saratoga Hills
Road shall pay to the Santa Clara County Treasurer is $133,700 ~vhich is computed
in accordance with Government Code § 51283, by multiplying by 12 ~/~ percent the
cancellation valuation of the Property as determined by the County Assessor.
2. The City Clerk is directed to forward a certified copy of this
resolution to the County Auditor.
Passed and adopted at a regular meeting of the City Council of the City
of Saratoga held on the 17th day of May, 1995, by the following vote:
AYES: Councilmenk~rs Jacobs, Moran, Tucker, Wolfe and Mayor Burger
