HomeMy WebLinkAboutCity Council Resolution 95-58 RESOLUTION NO. 95- 5B RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA RESCINDING RESOLUTION NO. 95-25.2 RELATING TO TENTATIVE CANCELLATION OF A WILLIAMSON ACT CONTRACT FOR PROPERTY LOCATED AT 2085 1 SARATOGA HILLS ROAD BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SARATOGA AS FOLLOWS: 1. Resolution No. 95-25.2 entitled "Resolution of the City Coundl of the City of Saratoga Approving Tentative Cancellation of a Williamson Act Contract Relating to Property Located at 20851 Saratoga Hills Road" adopted May 17, 1995 is hereby rescinded. Said Resolution shall be void and of no further legal effect. 2. The City Clerk iS hereby authorized and directed to record in the Office of the Recorder for Santa Clara .County, CA, a notice certifying the rescission of Resolution No. 95- 25.2 Passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 20th day of December, 1995 by the following vote: AYES: Counci lmembers Burger, Moran, Tucker, Wolfe and Mayor Jacobs NOES None ABSENT: None Mayor ATTEST: J:\WPDXMNRSW~273~S95~WILLIAM3.RES ~,,~' RESOLUTION NO. 95-58 RESOLUTION OFT HE CITY COUNCIL OF THE CITY OF SARATOGA ORDERINGAND CALLING A SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF SARATOGA ON MARCH 26, 1996; REQUESTING THE SERVICES OF THE REGISTRAR OF VOTERS; REQUESTING CONSOLIDATION OF ELECTIONS; SPECIFYING CERTAIN PROCEDURES FOR THE CONSOLIDATED ELECTION; AND PROVIDING FOR GIVING NOTICE OF ELECTION WHEREAS, the City Clerk received an Initiative Petition signed by not less than 15% of the voters of the City according to the Santa Clara County Registrar of Voters' last official report of registration to the Secretary of State, and WHEREAS, this petition was certified as to the number of signatures on November 27, 1995, by the Santa Clara County Registrar of Voters, and WHEREAS, the City Council has determined not to adopt said measure as an ordinance, but to submit the same as an initiative ordinance to the voters of the City at an election to be held on March 26, 1996. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Saratoga, County of Santa Clara, State of California, as follows: 1. Pursuant to Section 9214(b) of the Elections Code a special election shall be and is hereby ordered to be held in the City of Saratoga on March 26, 1996, at which election there shall be submitted to the qualified electors of the City the following measure. City of Saratoga Measure ( ) Do the qualified electors of the City of Saratoga approve the following proposed initiative petition? Amendment to the City General Plan requiring vote of the people in order to intensify existing land use designations for all lands designated "Residential" or "Outdoor Recreation." YES NO 2. Pursuant to Elections Code Section 10002, the City Council hereby requests the Board of Supervisors of Santa Clara County to make available the services of the Registrar of Voters for the purpose of performing the usual services necessary in the conduct of the consolidated municipal election, including the provision of election supplies and voter's pamphlets. 3. Pursuant to Elections Code Section 10403, the City Council hereby requests the Santa Clara County Board of Supervisors to order the consolidation of the special municipal election hereby called with the statewide primary election to be conducted within the boundaries of the City of Saratoga on March 26, 1996, with respect to which the Santa Clara County Board of Supervisors has the power to order a consolidation. The City Council further consents to and orders the consolidation of the special municipal election hereby called with the statewide primary election. Upon consolidation, the consolidated election shall be held and conducted, election officers appointed, voting precincts designated, ballots printed, polls opened at 7:00 a.m. and closed at 8:00 p.m., ballots counted and returned, returns canvassed, and all other proceedings in connection with the election shall be regulated and done by the Registrar of Voters of the County of Santa Clara in accordance with the provisions of law regulating the elections so consolidated. 4. Principal arguments on the measure shall be submitted to the City Clerk by 5:00 p.m. on Friday, January 5; rebuttal arguments shall be submitted to the City Clerk by 5:00 p.m. on Tuesday, January 16. 5. The City Clerk be and hereby is authorized and directed to publish a notice of the special municipal election, which notice shall be consolidated with the notice of a measure to be voted on, pursuant to Elections Code 12114(b). 6. The City Clerk is hereby authorized and directed to certify to the due adoption of this resolution and to transmit a copy thereof so certified to the Board of Supervisors of Santa Clara County and to file a copy thereof so certified with the County Clerk of said County. The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga City Council held on the 20th day of December, 1995, by the following vote: AYES: Councilmembers Burger, Moran, TuCker~ Wolfe and Mayor Jacobs NOES: None ABSENT: None ~.
