RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SARATOGA REGARDING SATISFACTION OF
OBLIGATION TO CONSTRUCT CERTAIN IMPROVEMENTS
ON QUITO ROAD - SUNLAND PARK NEIGHBORHOOD
Recitals
WHEREAS, in 1981, as a condition of annexation of their
property into the City, owners of property within a residential
subdivision known as the Sunland Park Tract ("Owners') entered
into an agreement obligating the Owners to perform future
improvements to Quito Road; and
WHEREAS, in 1995, in lieu of performing the improvements
originally contemplated by the 1981 agreement, Owners agreed to
have their property annexed into the City Landscape and Lighting
Assessment District, (No. 1995-1) and to construct and install
streetscape (including curbs, gutters, drainage system
improvements, widening for bike lanes, and landscaping
improvements) along the East side of Quito Road from Baylor
Avenue to McCoy Avenue, and to maintain the same through the
Landscape and Lighting Assessment District; and
WHEREAS, the streetscape improvements have been completed to
the satisfaction of the City; and
WHEREAS, the City desires to acknowledge that the completed
improvements satisfy in full the obligation of Owners as set
forth in the 1981 agreement, and to declare said agreement null
and void;
NOW, THEREFORE, the City Council of the City of Saratoga,
does hereby resolve as follows:
1. The streetscape improvements installed and constructed
along the East side of Quito Road from Baylor Avenue to McCoy
Avenue have been completed and are deemed to be in full
satisfaction of Owners' obligations, as set forth in the 1981
agreement.
2. That certain 1981 agreement entitled "Agreement
Relating To Future Widening And Improvement of Quito Road'
recorded against the following properties - Lots 1 through 73,
Tract 976, Sunland Park, Unit No. 1; and Lots 74 through 200,
Tract 977, Sunland Park, Unit No. 2 - having been satisfied in
full, is declared null and void and of no further force or
effect.
