RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA ORDERINGAND
CALLING A SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF
SARATOGA ON NOVEMBER 5, 1996; REQUESTING THE SERVICES OF THE
REGISTRAR OF VOTERS; REQUESTING CONSOLIDATION OF ELECTIONS;
SPECIFYING CERTAIN PROCEDURES FOR THE CONSOLIDATED ELECTION; AND
PROVIDING FOR GIVING NOTICE OF ELECTION
RESOLVED, by the City Council of the City of Saratoga, County of
Santa Clara, State of California, as follows:
1. Pursuant to Elections Code Section 9222, a special election
shall be and is hereby ordered to be held in the City of Saratoga
on November 5, 1996, at which election there shall be submitted to
the qualified electors of the City the following measures.

Saratoga approve the following?
NO
Shall the General Plan of the City of Saratoga be amended by
allowing an approximately 1/2 acre portion of a 8.4 acre
parcel located at 13570 Pierce Rd. to be redesignated from
land use designation "Hillside Conservation Single Family" to
"Very Low Density Single Family," thereby allowing said 1/2
acre parcel to be combined with an adjacent existing 1/2 acre
parcel to form an approximately 1 acre parcel?
Measure ( ) Do the qualified electors of the City of YES
Saratoga approve the following?
NO
Shall the existing City of Saratoga Utility User Tax be
extended, with no increase in the tax rate, to January 1,
2001, unless extended beyond that date by a further vote of
the people?
2. Pursuant to Elections Code Section 10002, the City Council
hereby requests the Board of Supervisors of Santa Clara County to
make available the services of the Registrar of Voters for the
purpose of performing the usual services necessary in the conduct
of the consolidated municipal election, including the provision of
election supplies and voter's pamphlets.
3. Pursuant to Elections Code Section 10400, the City Council
hereby requests the Santa Clara County Board of Supervisors to
order the consolidation of the special municipal election hereby
called with the statewide general election to be conducted within
the boundaries of the City of Saratoga on November 5, 1996, with
respect to which the Santa Clara County Board of Supervisors has
the power to order a consolidation. The City Council further
consents to and orders the consolidation of the special municipal
election hereby called with the statewide general election. Upon
consolidation, the consolidated election shall be held and
conducted, election officers appointed, voting precincts
designated, ballots printed, polls opened at 7:00 a.m. and closed
at 8:00 p.m., ballots counted and returned, returns canvassed, and
all other proceedings in connection with the election shall be
regulated and done by the Registrar of Voters of the County of
Santa Clara in accordance with the provisions of law regulating the
elections so consolidated.
4. Principal arguments on the measure shall be submitted to the
City Clerk by 5:00 p.m. on August 16; rebuttal arguments, if
authorized by the City Council, shall be submitted to the City
Clerk by 5:00 p.m. on August 26.
5. The City Clerk be and hereby is authorized and directed to
publish a notice of the special municipal election within the time
and in the manner specified in the Elections Code Section 12109.
The above and foregoing resolution was passed and adopted at a
regular meeting of the Saratoga City Council held on the 17th day
of July, 1996, by the following vote:
