SOLVED by the Cc.m~ ofthe City ofSaratogR. as follows: WHEREAS, Municipal Code Section 16-70.020 establishes a procedure for the creation of underground u~h'W districts and requires aS the initial step in such procedure the holding of a public he~ring to ~ whether public necessity, hea~k safety, or welfare requires the r~moval of poles, overhead wipes and associated overhead structures and the underground installation of wires and ~ for rapplying electric, communication, or similar or associated service in any such distri~ and WHEREAS, it has been recommended that such underground utility district, hereafter called Underground Di~rict No.g, be formed on Saratoga Avenue between Fruitvale Avenue and Baroni Court. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held, by the Council of the City of S~a~oga on June 3, 1998, at the hour orS:00 P.M. in the Council Chambers of the City Flail, 1377'/Fruitvale Avenue, Saratoga, California, to ascertain whether the public necessity, health, safety, or welfa~ requires the removal ofpoles; overhead wires and associated overhead structur~ and the underground installation of wires and facilities for supplying electric, colon, or simi1~ ~ s~ice in the District hereinabove described. 2. At such hearing, all persons iraerred shall he given an opportunity tO be heard. Said hearing nmy be ~minued from time to time as may be determined by the City Council. 3. The C~ Clerk shall notify all affected properW owners as shown on the last equalized as~ssment roll and u~ilities concerned at least ten (10) days prior to the date of the public hearing. 4. The are~ opo~d to be included in Underground District No.S is shown upon that in the Otce of the C~y Clerk of the City of Sarmoga. The above and foregoing resolution was passed and adopted by the Saratoga City Council at a meeting held on the 6th day o£ May, 1998, by the following vote: AYES: Councilmembers Bogosian, ~acobs, Moran, Shaw and Mayor Wolfe NOES: None ABSENT: None ~~ a r ATTEST: Deputy City Clerk
