RESOLUTION NO. 99-65
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA REQUESTING THE SERVICES OF THE COUNTY
CLERK OF SANTA CLARA COUNTY AND AUTHORIZING THE
FILING OF AN IMPARTIAL ANALYSIS AND WRITTEN
ARGUMENTS
BE IT RESOLVED, by the City Council of the City of Saratoga, California (the "City") that:
WHEREAS, this City Council has passed Ordinance No. 195 entitled "AN ORDINANCE
OF THE CITY COUNCIL OF THE CITY OF SARATOGA ORDERING THE SUBMISSION OF A
PROPOSITION OF INCURRING BONDED INDEBTEDNESS FOR THE PURPOSE OF THE
ACQUISITION, CONSTRUCTION AND COMPLETION OF CERTAIN MUNICIPAL
IMPROVEMENTS TO THE QUALIFIED VOTERS OF THE CITY OF SARATOGA AT AN
ELECTION TO BE HELD ON MARCH 7, 2000," ordering the submission of a proposition to the
qualified voters of the City (the "Ordinance"); and
WHEREAS, this City Council desires that the special municipal election provided for in the
Ordinance be consolidated with any other election to occur on March 7, 2000, in the territory of the
City and that said proposition be included on the ballot for said election which ballot is prepared
by the Santa Clara County Clerk; and
WHEREAS, section 9280 of the California Elections Code authorizes the filing of an
impartial analysis and sections 9282 and 9285 of said Code authorize the filing of written
arguments for or against any ballot proposition, and, if adopted by the City Council, rebuttal
arguments;
NOW, THEREFORE, IT IS ORDERED, as follows:
Section 1. The Board of Supervisors of Santa Clara County is hereby requested to permit the
Santa Clara County Clerk to provide such services as may be necessary to properly and lawfully
hold and conduct a special municipal election in the City on March 7, 2000, pursuant to the
Ordinance, including but not restricted to the providing and printing of ballots and polling place
cards, election supplies, voting booths, flags, registration lists and any other materials and services
required to lawfully conduct the election.
Section 2. For its approval and signature this Council hereby directs the City Manager and
his staff to prepare and file a written argument for the proposition to be submitted at said special
municipal election. Said written argument for the proposition shall not exceed 300 words in
length. The City Council hereby adopts the provisions of subdivision (a) of section 9285 of the
California Elections Code. If any person submits an argument against said proposition, the City
Manager and his staff shall prepare, for the approval and signature of this Council, a rebuttal
argument not exceeding 250 words. The argument and rebuttal shall otherwise conform to and
comply with all applicable provisions of the California Elections Code. The deadline date for the
submittal of arguments, in favor or in opposition, shall be December 6, 1999. The deadline date for
the submittal of rebuttals to arguments in favor or in opposition, shall be December 13, 1999.
Section 3. The City Clerk is hereby directed to submit to the City Attorney a certified copy
of the Ordinance. The City Attorney is hereby authorized and directed to prepare an impartial
analysis of the proposition specified in the Ordinance showing the effect of the measure on the
existing law and the operation of the measure, said analysis to be submitted by the City Attorney
to the Registrar of Voters or other appropriate officer of Santa Clara County. The analysis shall not
exceed 500 words in length and shall otherwise comply in all respects with the applicable
provisions of the California Elections Code. The deadline date for the submittal of the analysis
shall be December 20, 1999.
Section 4. The City Clerk is hereby directed to file with the Board of Supervisors of Santa
Clara County a certified copy of this Resolution and of the Ordinance on or before December 10,
1999.
Section 5. This Resolution shall be effective upon its adoption.
The foregoing is a full true and correct copy of a resolution duly adopted by the City
Council of the City at a meeting thereof on the 23rd day of November, 1999, by the following vote
of the members thereof:
