HomeMy WebLinkAboutCity Council Resolution 00-06 RESOLUTION NO. 00-06 RESOLUTION OF THE CITY COUNCIL OF SARATOGA ADOPTING A NEGATIVE DECLARATION IN CONNECTION WITH: Azule Crossing; 12312 Saratoga-Sunnyvale Road I. The City of Saratoga initiated consideration of the Azule Crossing Project consisting of the following applications: SD-99-005, UP-99-018, and DR-99-037 (collectively referred to hereinafter as the "Project"). II. A Negative Declaration (ND) was prepared for the Project by the City of Saratoga, pursuant to the requirements of the Califomia Environmental Quality Act (CEQA, Public Resources Code sections 21000-21177), CEQA Guidelines, and City CEQA requirements. III. The ND was circulated for a public review period ending on February 2, 2000. IV. The ND indicates that no significant adverse environmental impacts will result from the Project. V. On December 15, 1999, January 19, 2000, and February 2, 2000 the City Council conducted a duly noticed public heating on the adequacy of the ND at which oral and written comments and a staff recommendation for approval of the ND were presented to the City Council. The City Council reviewed and considered the information in the ND, administrative record, and Staff Reports for completeness and compliance with CEQA, the CEQA Guidelines, and City CEQA requirements. VI. THEREFORE, BE IT RESOLVED that the City Council hereby makes the following findings: 1. Notice of all City Council hearings on the ND was given as required by law and the actions were conducted pursuant to CEQA, the CEQA Guidelines, and local City requirements; and 2. All Interested Parties desiring to comment on the ND were given the opportunity to submit oral and written comments on the adequacy of the ND prior to this action by the City Council; and Resolution 00-06 3. All comments raised during the public comment period and at the public hearings on the ND were responded to adequately; and 4. Analysis of the changes to the Project subsequent to preparation of the ND demonstrates that those changes do not raise any new issues about the significant effects of the Project on the environment; and 5. The City Council was presented with and has reviewed all of the information in the administrative record; and 6. The ND has been completed in compliance with the intent and requirements of CEQA, CEQA Guidelines, and the City's CEQA requirements, and the ND represents the City Council's independent judgment. The City Council has considered the information contained in the ND and the record in considering the Project and related actions; and 7. Based on the entire record of this matter, there is no evidence that the Project will have a significant effect on the environment; and 9. The documents constituting the record of proceedings upon which this City Council's decision is based are located in the City of Saratoga Department of Community Development and are maintained by the Director of that Department. VII. BE IT FURTHER RESOLVED that the City Council hereby adopts the Negative Declaration.
