RESOLUTION NO. 03-006
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SARATOGA AMENDING THE CITY'S OPERATIONS
TO INCLUDE A HOLIDAY FURLOUGH.
WHEREAS, subsequent to the adoption of Resolution No. 85-9.122, as amended, the
City Manager has recommended changes to the City's working conditions that include a holiday
furlough; and
WHEREAS, the proposed furlough will consist of closing City of Saratoga operations
from December 24 through January 1 of every year beginning December 2003; and
WHEREAS, an in-house study was conducted in determining a holiday furlough will
reduce annual leave liabilities and employee payouts for excess accrued annual leave as well as
maximize productivity and service levels during more essential times of the year; and
WHEREAS, a stand-by/on-call schedule is needed to ensure that work of an emergency
nature is performed during the holiday furlough;
WHEREAS, the City Council has considered the recommendations of the City Manager
and believes that implementing these further changes will be in the best interests of the City.
WHEREAS, the City has apprised recognized labor organizations of these amendments
to the classification plan and is providing at least nine months advance notice, as required by
California law; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Saratoga does hereby the following:
Section 1. Holidav Fnrlough.
The City agrees to amend its working conditions stated in the City's policies and procedures and
within existing classification plans and agreements to include a holiday furlough between the
periods of December 24 through January 1, beginning December 2003.
Section 2. Emplovee Agreements.
The Memorandum of Understanding between the City and both SEA and SMO IS hereby
amended as follows:
Section VII_ Working Conditions - A holiday furlough will exist whereby the City
operations are closed from December 24 through January 1 of every year, beginning
December 2003 _ Employees shall utilize their available leave balances (annual leave,
compensatory time), if applicable. Employees that utilize unpaid leave due to insufficient
leave balance shall maintain regular benefit status.

Section 3. City Manae:er Autho.-ization.
The City Manager is authorized to negotiate an agreement with SEA and SMO on a standby
and/or call-out policy pay to be ratified by the City Council.
The above and foregoing resolution was passed and adopted at a regular meeting of the
Saratoga City Council held on the 19th day of February 2003, by the following vote:
AYES: Councilmembers Kathleen King, Norman Kline, Vice Mayor Ann Waltonsmith
NOES: None
ABSTAIN: None
ABSENT: Councilmember Stan Bogosian, Mayor Nick Streit
