RESOLUTION NO. 03-030
RESOLUTION OF THE CITY COUNCIL OF SARATOGA
ADOPTING A MITIGATED NEGATIVE DECLARATION
IN CONNECTION WITH:
St Andrew's Parish and Church, 13601 Saratoga Avenue
I. The City of Saratoga initiated consideration ofthe St.Andrew's Parish and School Project
consisting of the following applications: Environmental Determination 01-002, Design Review
01-035 and Use Permit 01-013 (collectively referred to hereinafter as the "Project").
II. An Initial Study (IS) was prepared for the Project by the City of Saratoga, pursuant to the
requirements of the California Environmental Quality Act (CEQA, Public Resources Code
sections 21000-21177), CEQA Guidelines, and City CEQA requirements_
III. The IS identified potentially significant adverse effects on the environment rrom the
proposed project but found that revisions in the Project made by or agreed to by the applicant
would avoid the effects or mitigate the effects to a point where clearly no significant effects
would occur.
IV The IS and a notice of intent to adopt a Mitigated Negative Declaration (MND) were
circulated for public review from January 29,2003 through February 26,2003.
V On May 21,2003 the City Council conducted a duly noticed public hearing on the adequacy
of the MND (including the IS) at which oral and written comments and a staff recommendation
for approval of the MND were presented to the CounciL The City Council reviewed and
considered the information in the IS and MND, administrative record, and Staff Reports for
completeness and compliance with CEQA, the CEQA Guidelines, and City CEQA requirements_
VI. THEREFORE, BE IT RESOLVED that the City Council hereby makes the following
findings:
1. Notice of all hearings on the MND was given as required by law and the actions
were conducted pursuant to CEQA, the CEQA Guidelines, and local City
requirements; and
2. All Interested Parties desiring to comment on the MND were given the
opportunity to submit oral and written comments on the adequacy of the MND
prior to this action by the Planning Commission; and
3. All comments raised during the public comment period and at the public hearings
on the MND were responded to adequately; and

4. Analysis of the changes to the Project subsequent to preparation of the MND
demonstrates that those changes do not raise any new issues about the significant
effects of the Project on the environment; and
5, The City Council was presented with and has reviewed all ofthe information in
the administrative record; and
6. The MND has been completed in compliance with the intent and requirements of
CEQA, CEQA Guidelines, and the City's CEQA requirements, and the MND
represents the Planning Commission's independent judgment. The Planning
Commission has considered the information contained in the MND and the record
in considering the Project and related actions; and
7. Based on the entire record of this matter, there is no evidence that the Project as
revised may have a significant effect on the environment; and
8. The documents constituting the record of proceedings upon which this decision is
based are located in the City of Saratoga Department of Community Development
and are maintained by the Director of that Department.
VII. BE IT FURTHER RESOLVED that the City Council hereby adopts the Negative
Declaration_
VIII. BE IT FURTHER RESOLVED that the City Council hereby directs the Community
Development Director to monitor the applicant's compliance with the mitigation measures
required in the project or made a condition of approval to mitigate significant environmental
effects.

California, this 21st day of May, 2003, by the following vote:

This permit is hereby accepted upon the express terms and conditions hereof, and shall have no
force or effect unless and until agreed to, in writing, by the Applicant, and Property Owner or
Authorized Agent. The undersigned hereby acknowledges the approved terms and conditions
and agrees to fully conform to and comply with said terms and conditions within the
recommended time frames approved by the City Planning Commission_
