HomeMy WebLinkAboutResolution 36-B-012 Tract 822 05-06-1959 RESOLUTION N0. 36-B-12 RESOLUTION ACCEPTING DEDICATION OF STREETS TRACT 822 It appearing that on or about April 19, 1954 the street improvements as shown on the herinafter referred to subdivision map were completed and that thereafter they were maintained by the sub- divlaer for not less than an additional year from date of satisfactory completion, and, it further appearing that the storm sewer and drainage facilities for said subdivision have not been. properly completed, in that, amongst other things the proposed drain line from Dagmar Drive to Wildcat Creek has not properly been placed within the ten foot storm drain easement shown and delineated on said final map and therein offered for dedication, which easement lies between lots l0 and ll on said. map, NOW THEREFORE the City Council of the City of Saratoga hereby resolves as follows: SECTION I All streets only offered for dedication as shown on that certain subdivis ion map of Tract 822, Saratoga Gardens, re- corded in Book A~0 of Maps a~ pages 55 and 56 in the office of the County Recorder, County of Santa Clara, State of California, on October 28, 1952, are hereby accepted and said. streets are hereby declared to be public streets in the City of Saratoga, County of Santa Clara, State of Calif- ornia. Such improvement bond as relates to street surfacing only is hereby ordered to be released. SECTION 2 All other easements offered for dedication in said final map are 'not accepted, and all storm sewers and. other drainage facilities in said subdivision are not accepted by the City of Sara toga. SECTION 3 Until such time as a complete and final release has been ob- tained from the owners, their heirs and assigns of lots l0 and. 11 as shown on said final map, in form and substance to be approved by the City Attorney, the City Council hereby declares lt's intention not to accept any of the easements or improvements as set forth in Section 2 hereinab0ve, and until such time the storm sewage bond covering the afore- said subdivision and the improvement agreement relating thereto shall not be released.
