PRESENT: Brazil, Jepsen, Rosasee, Williams ABSENT: Langwill A. EESOLUTIONS 1. George Oldham, File ~C1, a resolution proposing amendment to the zoning ordinance and directing George Oldham secretary to set time and place was introduced. ~C1 Commissioner RosaBoo moved for adoptien. Passed unanimously. 2. Charles E. Glass, File ~C2, a resolution proposing amendment to the zoning ordinance and directing Charles Glass secretary to set time and place was introduced. #C2' Commissioner Jepsen moved for adoption, Passed unanimously. 3- Fred H. Smith and Maud D. Smith, File #C3, a resolution proposing amendment to the zoning ordinance and Fred H. & Maud D. directing secretary to set time and place was introduced. Smith #C3 Commissioner Willjams moved for adoption. Passed unanimously. B. VARIANCES ~D USE PERMITS 1. Daniel W. Clark, variance: (a) Lessen front yard from 30 feet to 15 feet; (b) Lessen rear. yard from 24~ feet Daniel Clark to l0 feet., Lot 43,'Wildwood Heights Subdivision; #V1 southwest corner Canyon View Drive and Glenmerit Drive. -1- Since the report from the County Plannin~ Department dis not arrive until 6:45 P.M. and inSicated that the Department recommende8 denial of the front yard set- back while approving the rear yard setback, Commissioner Jepsen moved that in view of the lack of time allowed for consideration of the Planning Department's report, further consideration should be defered until the next meeting. Unanimously asproved. 2. John M. Brown, variance from the ode acre zoning re- quirement in this area, this property comprising only 0.369 acres, 19755 Glen Una Drive. Mr. Robert Davies, attorney, argued that Mr. Brown at the time he purchased the property in 1955 fr~.m Cyril Vertin did not know of john M. Brown any zoning violation and that if the Commission granted #V2 the variance, it wol~ld not alter the living pattern in the area. Commissioner Willisms moved'thz;t in view of the late arrival of technical information from the Planning Department, the matter be deleted until the next meeting of the Planning Commission. Unanimo~lsly adopted. 3. Richar~ Butera, variance: change of side yard set back on East side of prooerty from l0 feet to 4 feet, 2 inches. Richard Mrs. Prendergast of Thelma Avenue, stated from the floor Butera #V4 that the carport wa!s not objectionable to her, but that' it might start'a trend and lower the stanSs. rSs of the neighborbooS. Commissiomer Jepsen moved ~hat the variance be granted with the qualification that the carport be un-enclosed and that the variance a~ply to the east side of the property o~ly. Unanimously passed, Resolution No. V4o -2- C. ARCNITECU~UHAL AND SITE CONTROL 1. Pacific Telephone and Telegraph Company: to provide building space for installation of additional telephone Pacific central office equipment on S~ratoga Avenue. Tel & Tel #V5 Commissioner Rosasco moved for approval of the request. Unanimously ~assed, Resolution #V5- D. SUBDIVISION COMMITTEE 1. Lee H. Br.~ndenburg, tentative map, portion of Lot 3 Lee H. Titus and Langtry Tract. Chairman Brazil moved for Brandenburg SD #1 approval of tentative map to be sent to Plannin~ Department for technical workup. Passed. unanimously. 2. S. Mc Cotmack, Fan~ell ikvenue. Commissioner Jepsen moved that the tentative map be approved subject to conditions S. HcCormack SD #5 set forth by the S~nta Clara County Planning Commission on December 5, 1956, with add~tlonal proviso that condition #1 be left open for further discussion. Frank and Gwendolyn Bennett, Pierce Road opposite Houston Court. Commissioner Rosasee moved that tentative map be apprcved subject to conditions of approval set Frank & Gwendolyn forth by the Santa Clara Planning Commission on December Bennett SD #~ 1~, 1956, with proviso that Item ~6 r~quiring suburban curbs be subject to modification, if the Commission receives certification from the County Engineer's Office that Item #6 has been deleted. Approved unanimously. 4. J. Rodrieues, Brook Glen an8 Bellwood. Mr. Rodriques j. Rodrtques asked that consideration of his tentative map be def'ered SD #2 for 30 days. Request granted unanimously. -3- 5. J. Rodriques, Brook Glen and Bellwood. Commissioner WillJams moved for approval of tentative map, subject J. Rodriques SD #8 to conditions set forth by the Santa Clara County Planning Commission at their meeting on January 2, 1957- Passed unanimously. 6. Small and Kendall, 15020 Sobey Road. Commissioner Rosasco moved that the tenta~tlve map subject to the Small and Kendall conditions set forth by, the Santa Clara County Planning so #3 Commission at their meeting of January 2, 1957 be approved. Unanimously passed. 7. H. K. Hayes, Piedmont and Mendelson. Councilman Rosasco moved that the tentative map subject to the conditions set up by the County of Saute Clara Planning H. K. HAyes SD #6 Commission at their meeting of December 4, 1956, be approved and that the final map be referred to the City Council for action. Commissioner Williams moved for adjournment at 10:50 P.M. Unanimously passed.
