PLACE: Flreman's Hall, Oak Street, Saratoga, California TYPE: Regular meeting I ROUTINE ORGANIZATION A. ROLL CALL Present: Anderson, Bennett, Cameron, Crisp, Higgins, Pasetta, Webster Absent: None B. MINUTES Commissioner Bennett moved that the reading of the minutes be waived and that said minutes of the previous meeting be approved. Carried unanimously. II NEW BUSINESS A. N~,J ZONING PETITIONS None B. WRITTEN COMMUNICATIONS 1. Letter dated March 18, 1957 from J. T. Miller of 12039 Saratoga-Sunnyvale Highway, Saratoga, California was read by the Secretary. Commissioner Webster J. T. Miller letter moved that the letter be acknowledged with thanks with no committment on policy. C. ORAL COMMUNICATIONS 1. Marshall Hall, Attorney of San Jose snoke briefly on behalf of George Oldham in connection with File No. C 1. Mr. Hall stated that he felt that it was the ~C 1 01dham feeling of the Commission to hold the Oldham matter in abeyance until the Master Plan has been completed and that his client, Mr. Oldham, was acceptable to waiting until the Master Plan but wants to save the $100o00 refiling fee. Mr. Hall stated that the City Attorney said that the Commission would have the power to prolong the case by Resolution until the -1- Master Plan had been completed. Mr. Clark, Assistant City Attorney said that he was not in complete accord with the opinion of the City Attorney but that he felt that a new application could be accepted and the filing fee waived. Mr. Hall stated that Mr. Bachman had told him that he was not in accord with the suggestion since the allowing of a case to remain open would cause a congestion of incomplete oases in the files. Commissioner Bennett moved that Mr. Clark's suggestion and Mr. Hall's suggestions be taken under aavisemento 2. Mr. Galeb of Highway #9, Sar?toga, California discussed from the floor his problems in connection with his property at the Southern Pacific Tracks on the East Galeb property side of Highway #9- He stated that shortly before zoning the incorporation election, the County Planning Commission has indicated a favorable attitude toward light industry and commercial along the railroad tracks in the vicinity of his property, but that they wanted to wait as to any final decision until after the incorporation election. Mr. Galeb stated that he felt the property between Cox Road and the Railroad along Highway #9 Should be zoned of a nature to bring revenue. He also remarked that recently a printing establishment wished to move into his building but the printing establisbaent was not acceptable to the City of Saratoga under the zoning regulations and that it was causing him a considerable loss of income. Chairman Crisp asked whether this was to be considered at the time of the Master Plan and Mr. Galeb replied in the affirmative. He stated further that he would like to see the area similar to small towns around Los Angeles which all have some industry. -2- Mr. Galeb submitted a map of his area indicating a general plan and Chairman Crisp stated the matter would be taken under advisement at the proper time. III PUBLIC HEARINGS USE PERMITS 1. #V ll - Robert Potts The Clerk read the petition. A Mr. M. J. Oberhouse of Alta Vista Drive asked for an explanation of the request for the Use Permit and it was given by #V ll Chairman Crisp. Robert Potts Chairman Crisp recommended the Use Permit be granted with the proviso that the minimum side yard be six (6) feet. Carried unanimously. At this time, Chairman Crisp indicated that the public hearing portion of the meeting was at an end and that henceforth the r~mainder of the hearings would be devoted to subdivisions. IV Mj~TTEP_S HELD UNDER ADVISEMENT None V COMMITTEE REPORTS A. ARCHITECTURAL AND SITE CONTROL None B. SUBDIVISION 1. SD #5 - Stewart Mc Cormack The Secretary read Mr. Clark's opinion dated March 18, 1957 in which it was suggested that the word "deeded" be used in describing a 30' right-of-way. Mr.Clark SD ~5 after reviewing the file, stated that the situation Stewart Mc Cotmack seemed somewhat different than described to him and indicated that the word "dedicated" should be used instead of "deeded". -3- Commissioner Cameron made a motion that Provision One of the conditions set forth by the County Planning Commission at their meeting on December 5,1956 be waived and in its place the following provision be inserted: "A thirty foot dedication of a right-of- way to be granted by o~ner". Carried mnanimously. (Later in the meeting, the Commission returned to this case and Commissioner Cameron made a motion to withdraw the original motion as outlined above. This was carried unanimously. A new motion which read as follows was introduced by Commissioner Cameron: "A thirty foot deeded right- of-way to be grantl~d by owner". This motion was passed unanimously.) 2. SD #16 - Sevrens & Derrick After some discussion, the following motion was made by the Subdivision Committee: That the condition as set out by the County of Santa Clara Planning SD #16 Commission Subdivision Committee at their meeting Sevrens & Detrick of March 19, 1957, be accepted with the followin~ exceptions: 1. Provide an access road to Herriman Avenue; 2. Eliminate Condition No. 15; 3. Eliminate Condition No. 19, with the provis'o that lighting to be established at aoproval of final map. Carried unamiously. 3- SD #17 - J- S. Moucressey After some discussion, the Subdivision Committee SD #17 moved that the conditions set out by the Subdivision J. S. Moucressey Committee of the County of Santa Clara Planning Commission on March 6, 1957 be accepted in their -4- entirety with following exceptions: 1. Reduce Condition No. 16 to 56' instead of 60', said condition to effect only Radoyka Street south of Lots 37 and 44; 2. Eliminate Provision No. 15 with the proviso that lighting to be established at approval of final map. Carried unanimously. 4. SD #9 - Robert Swift After some discussion, the Subdivision Committee moved that Condition No. 2 of the Subdivision CommLttee of the County of Santa Clara Planning Commission report of March 16, 1957 be eliminated SD ~9 Robert Swift and the following condition inserted in place of it: "Provide 30' right-of-way extending from Saratoga Av.nue to rear lot of Swift property all as shown on location map received and dated by the City Clerk, 3/20/57". 5- SD #2 - John Rodrigues The Subdivision Committee moved to approve the tentative map subject to the conditions set forth by the Subdivision Committee of the County of Santa SD #2 - J.Rodrigues Clara Planning Commission at their regular meeting on January 2,1957- Carried unanimously. VI GENERAL PLANNING AND ZONING A. REPORT OF COMMITTEES 1. Contract with County Planning Department. Chairman Crisp rsad a tentative contract to be drawn Contract with County up with the County Planning Department in its entirety. Commissioner Webster moved that a prlvso be added to the contract which would indicate that while -5- one person would be responsible for the work done for the City of Saratoga said work could be distributed to other members of the Department. Chairman ~risp stated that this would be added to the contract and that said contract would be sent to the City Attorney for final draft and then sent back to the Planning Commission for final approval. Commissioner Bennett moved at 9:45 P.M. for adjournment. Carried unanimously. Present 25; i press -6-
