PLACE: Flreman's Hall, Oak Street, Saratoga, California TYPE: Regular Meeting I ROUTINE ORGANIZATION A. ROLL CALL Present: Anderson, Bennett, Cameron, Crisp, Pasetta, Webster Absent: Higgins B. MIErUTES Commissioner Bennett moved that since the minutes had been reoeived and read they be approved. Carried unanimously. II NEW BUSINESS A. NEl~l ZONING PETITIONS None B. WRITTEN COMMUNICATIONS None III PUBLIC HEARINGS A. REZONING 1. C-6 - Smith, Fred and ~ude The Clerk described the area affected and the proposed uses. There were no written communications. Attorney J. E. Bean discussed the following points on behalf of the proponents: C-6 (1) Described the site and uses proposed. Smith, Fred and Maude (2) Predicted the intersection of Saratoga Ave. and Junipero Serra Freeway as a major intersection in the county highway system. (3) Exhibited various maps showing commercial uses in the West Valley area. (4) Stated the necessity for the proposed services to the Saratoga area. -1- (5) Discussed the traffic safety aspects of off-street parking. (6) Cited the rapid increase in County population and the corresponding upsurge in Saratoga population. (7) Predicted that a city of minimum services would sooner or later have to be dependent on larger tax revenues to support service demands of the increasing population. (8) That although a limited area was involved in this particular application, there was a potential for a larger coordinated commercial area, including the balance of ll acres in the Smith property and 3 acres in the Teresi property. Attorney Bean stated that he had many favorable letters supporting the application, that he would defer reading them to save time. There were no other proponents for the zoning change. When opponents were asked to speak the following state- ments were made: (1) Ernest H. Renzel, owner.~of Quito Shopping Center. Agrees with Bean on application for zoning change, questioned the uses being restricted to those pro- posed in the application. Mr. Renzel stated that in his Quito Shopping Center there was room for another ~0,000 sq. ft. of building expansion. (2) Mr. Bill Bulllet, 13186 Montrose, Saratoga stated his desire to have the planning Commission retain full control over the development through Architec- tural and Site Control Dept. (33 Mr. Alfred Croat, 18597 McCoy Ave., Saratoga, stated that if the area was to be zoned C-1 that it would have to keep the appropriate uses. Chairman Crisp terminated public discussion at 8:40. Commissioner Bennett stated that he had made an extensive study of the area, that it was overzoned, had more -2- commercial use than necessary, and was bad planning. He suggested that the application be denied. Commissioner Anderson decta~edLh~s intention to keep Saratoga Ave. free of commercial use and to keep rural and residential uses in the City of Saratoga. He stated that it would be undesirable to clutter the highways with businesses and that this policy had been expressed by the Mayor and Council. Commissioner Webster stated that he was not satisfied on the present need for the shopping center and that there were uses for outside residents not necessary for Saratoga use. Commissioner Bennett moved that the request be ~nled. Commissioner Pasetta questioned the figures given for population increase in Saratoga and stated that restrictions on zoning in Saratoga prevented population growth on such a rapid scale as was found in other areas. Me also stated that local services were what was needed and that there was sufficient area in Quito for expansion. Commissioner cameron stated his intention to abstain from voting. The motion of Commissioner Bennett was brought to a vote. Carried unanimously by those voting. Request denied. 2. PC~2 - Allendale Rezoning Time 8:45 The Secretary read a description of the area involved and the proposed zoning changes. There were no statements from the floor in favor of PC-2 Allendale adoption of the zoning change. ReZoning Speaking in op~ositlon to the zoning change was Francis Smith, 12421 Lolly Court, Saratoga, who stated that he had originally proposed a gradual zoning in the area from 10,000 to 20,000 to 40,000 sq. ft. minimum lot sizes, each zone acting as a buffer between the others and that he -3- intended to make another proposal regarding this zoning within a year or so. Smith stated that he and Mr. Muston, and Mr. Gotham intended to request half acre lots on the South side of Allendale Ave. Mr. Smith stated that he wished to go formally on record in opposition to the zoning change. Commissioner Webster moved that the Commission adopt the resolution recommending to the Council that the proposed rezoning be adopted. Carried unanimously. B. PUBLIC HEARINGS 1. PC-3 - Minimum Lot Sizes The Clerk read the proposed ordinance setting minimum lot frontage, minimum lot sizes and other matters per- taining thereto. Chairman Crisp stated that the proposed ordinance puts PC-3 into permanent form emergency ordinances already existing Minimum Lot Sizes and gives further definition. Discussion of specific sections followed. Commissioner Bennett moved that the Commission adopt a resolution recommending to the Council that this ordinance be adopted as read. Carried unanimously. C. VARIANCES AN~ USE PERMITS 1. V-34 - San Jose Water Works - Tanks The Clerk described the proposed use and the site area involved. Charles B. Leib, attorney for the San Jose Water Works, V-34 described the public utility use being applBd for as two S.J.W.W. Tanks redwood tanks 47½ ft. in diameter and 20 ft. high, screened from view by trees, tanks to serve the Highway 9 area. It was stated that the tanks would be approximately 550 ft. above sea level. The following persons spoke when opposition to the proposed use was asked for: -4- (1) Mr. John L. LaJeunesse, 21161 Saratoga Hills Road, stated that he wanted it understood that expansion of the facilities, once granted, could be done only under a use permit. (2) Mr. Howland Sinclair, 21151 Saratoga Hills Road, asked that the tanks be placed at least 75 feet from his property line and that the appearance of the tanks be harmonious with the surrounding area. Commissioner Webster discussed the area to be served by the tanks with the representative of the San Jose Water Works. Commissioner Bennett moved that the permit be granted subject to the following provisions: (1) The foundation of the tanks be at ground level. (2) The location of the tanks be as shown in the plot plan. (3) There be two tanks approximately 48 ft. in diameter and 20 ft. in height. (~) The elevation of the base of the tanks be approximately 560 feet above sea level. (5) The tanks and the surrounding area be landscaped and beautified subject to the approval of the Planning Commission. Carried unanimously. 2. V-35 - Yatsko, Michael The Clerk read the application for a variance. Mr. Yatsko made a statement in support of his request. V-35 Mr. D. R. Miller, 125 Main St., Los Altos, asked to see Yatsko, M. the plans and after doing so stated that he had no objec- tions to granting the variance. Co~nissioner Pasetta moved that the variance be granted. Carried unanimously. Adjournment of public hearings at 10:05 P. M. -5- IV MATTERS HELD UNDER ADVISEMENT 1. C-5 - Johnston, Dorothea The Secretary read a report of findings. C-5 Johnston, D. Commissioner moved for the adoption of the resolution and the report of findings. Carried unanimously. V COMMITTF~. REPORTS A. ARCHI%vECTD~L AND SITE CONTROL 1. V-36 - Payne, George H. The Clerk described the area involved and proposed uses. Mr. Cannon, 14488 Oak St., Saratoga, discussed the pro- V-36 posed structure with the Commissioners. Payne,G.H. Commissioner Webster moved that the application be taken under advisement. B. SUBDIViSiON COMMITTEE 1. SDR #12 - Cox, C. (A. A. Rodrigues) The Clerk read a statement of the history of the case and cited the change in the original conditions. Mr. Rodrigues stated that the County had originally approved the record of survey for two home sites and he had proceeded with building with that understanding and that he had already constructed a bridge to clear the SDR #12 channel and had posted Flood Control fees in accordance Cox, C. (Rodrigues) with original County conditions. Chairman Crisp stated that this was the first time that a map with two pieces involved in a record of survey had been presented to the Saratoga Planning Commission and it was further stated by Commissioner Webster that County commitments do not bind the Saratoga Planning Commission. Commissioner Webster moved that the matter be taken under advisement. Carried unanimously. 2. SDR #36 - Powers, W. W. Mr. E. W. Montague, Civil Engineer, P. O. Box 698, Los SDR #36 Gatos, requested that a continuance of 30 days be granted Powers,W.W. in this case because of the failure of the County to set up proper conditions. Request granted. 3. SDR #37 - Evans, Harr~ F. SDR.#37 Commisslone~m~oved ~ the tentative map be disapproved. Evsns,H.F. Carried unanimously. 4. SDR #39 - Evans, Alfred S. The Secretary read the conditions proposed at the County Subdivision Committee meeting. SDR #39 Discussion between Mr. Evans and the Commissioners Evans,A.S. followed with regards to the fire control condition. Commissioner Anderson moved that the tentative map be approved subject to the conditions read. Carried unanimously. 5- SD #25 - Wandemere The Secretary recited the past actions taken in this case and read a report of a conference with Mr. Goodman of Sanitation District Four and Mr. Fallis and Mr. Pearl of the County Health Dept. SD #25 Mr. Walters discussed his view point on the stipulations Wandemere for septic tank installation and requested that further information be obtained from the Health Dept. Mr. Walters requested a 30 day extension in this case pending definite statement by the Health Dept. Request granted. 6. SD #30 - Mr. Eden Estates The Secretary read the conditions set at the County Sub- division Committee meeting of July 16, with the additional condition that fire protection installation be made to SD #30 the satisfaction of the Saratoga Fire Dept. Mt.Eden Estates Mr. Park Verner made a statement regarding the layout of drain fields and the Health Department's requirement for sanitary disposal. Mr. DollaM, co-owner of the area, stated that he was disturbed at the large lot sizes and that he objected to the northward 50 foot right-of-way. -7- Commissioner Bennett moved that the tentative map be approved subject to the conditions read with the amendment to Condition 9, that it be changed to read, "Extend 50 foot right-of-way to 600 foot contour at property line at lower line of Lot 6."
