PLACE: Firemsn's Hall, Oak Street, Saratoga, California TYPE: Regular I ROUTINE ORGANIZATION A. ROLL CALL Present: Anderson, Bennett, Cameron, Webster Absent: Crisp, Higgins, Pasetta B. Minutes Commissioner Webster moved that the reading of the minutes be dispensed with and that they be spproved as prepared and dispensed to the Commission. Carried unanimously. II N~i BUSIk~SS A. N~,~ ZONING PETITIONS None B. WRITTEN COMMUNICATIONS None III RESOLUTIONS 1. PC-2 - Allendale Rezoning The Clerk read Resolution No. PC-2-1A adopting a report of findings and recommending proposed amend- Res.PC-2-1A ment. Allendale Rezoning Commissioner Cameron moved the adoption of the reso- lution and the report of findings. Carried unanimously. IV PUBLIC HEARINGS A. REZONING 1. C-4, Taylor, Robert H. The Clerk gave the record of action to date. Nestor Barrett, planning consultant, discussed the C-4 planning asoect of the proposed rezoning. He dis'cussed Taylor,R.H. the history of the case before the County Planning Commission and stated that the proposed uses were not spot zoning and the limited residential uses on the northem portion of the property would stop further ~l- commercial expansion along the Highway. He also stated that every attempt had been made to minimize the traffic hazard and the proponents would widen '- Reid Lane as necessary. Fred Marburg, architect, discussed the precise design of the proposed rezoning. He described the multiple family uses, clinic area and administrative offices involved in th~ rezoning. Nestor Barrett, introduced as exhibit A evidence that Mr. Taylor had paid $92,500.00 as the purchase price. Several of the Commissioners discussed various aspects of the residential uses involved in the area. Speaking in opposition to the proposed rezoning was Mr. Rhodes, 20660 Reid Lane, attorney representing the Saratoga Orchards Association. He discussed the history of the proposed development and compared it with similar developments in nearby communities. He also gave several reasons as proof that the area should not be fezcried as requested. Others speaking in opposition to the proposed rezoning were: 1. A. E. Schifferman, 20640 Canyon View Drive, Saratoga, who stated that he had decided to live in the area because of it's peace and quiet and high residential use. 2. Charles J. White, 20811 Canyon View D~ive, cited the existing traffic problem and stated that the multiple dwelling use proposed was not in keeping with surrounding uses. 3. Frank Davis, Reid Lane, stated that he would request a change of zoning for his own property to commercial use if the present application is granted and that he had built near the schools for the use of his child. -2- 4. John Ainlay, 20720 Canyon View Drive, stated that it was unnecessary to consider anything but R1 uses in the area. 5. Mr. Moyles, 20560 Reid Lane, stated that he had been approached for a possible rezoning to commercial. 6o Rod Westfall, 20620 Reid Lane, stated that apart- ment houses would ruin Saratoga. Public hearings were closed at 8:35 P.M. Commissioner Anderson stated his opposition to the proposed rezoning and gave several reasons in support ef his position. Commissioner Anderson moved that the request be denied. Commissioner Webster stated that while there was an attractive~'design that he could not see sufficient Justification for granting the rezoning. Commissioner Cameron stated that while he disagreed with some of the statements of the opponents, that considered from the point of view of the city as a whole there were existing areas for this type of expansion and that the proposed rezoning should be denied. Commissioner Anderson's motion was brought to a vote. Carried unanimously. B. V-a-RIANCES AND USE PEP. MITS 1. V-37 - Peruzzaro, Italo The Secretary read the report of the City Administrator dated May 22, 1957, and an opinion of the City Attorney V-37 dated May 24, 1957. Peruzzaro Mr. Bean, attorney for the applicant, stated the case for the granting of the application and gave an explan- ation of the situation. be stated that the granting of the variance would not lead to a breaking down of acreage requirements and would not set a precedent. -3- Mr. J. W. Bailey, 13681 Pierce Road, spoke in favor of the applicant. City Administrator Bachman took exception to the statement of Attorney Bean that a record of survey was not necessary for the issuance of a building permit and stated that his office had been insisting on recorded building sites before the issuance of building permits. Commissioner Cameron moved the approval of the variance. Carried unanimously. .Adjournment of public hearings. V MATTERS HELD UNDER ADVISh~MENT None VI- COMMITTEE REPORTS A. ARCHITECTU~h~L ~WD SITE CONTROL 1. V-36 - Payne, George H. Mr. Cannon, Oak Street, Saratoga, representing Mr. Payne, discussed the proposed building with the Commissioners. He stated that off-street parking V-36 was provided through the use of ten parking spaces Payne,G.H. leased in the adjoining Richfield Station. Discussion of the need for architectural harmony in the commercial areas was discussed amongst the Commissioners and with Mr. Cannon. Mr. James A. Rodrigues, 394 Boynton Ave., San Jose, speaking from the floor, stated the need for a development of a long-range planning of commercial structures on Big Basin Way. Commissioner Webster suggested a conference with Mr. Payne and the members of the Architectural and Site Control Committee. Commissioner Webster moved that a conference be arranged with Mr. Payne and the necessary members of the Planning Commission and that the matter be held under advisement until after that conference- -4- 2. V-38 - Willjams, Theo P. Commissioner Bennett gave an explanation of the proposed remodeling of the Williams property at the corner of Oak Place and Saratoga-Los Oatos Rd. Commissioner Webster moved the granting of the V-38 architectural and site control permit with the con- Williams,T.P. dition that the expansion of the parking facilities on the property should not interfere with the trees on city property opposite the Federated Church. The Clerk discussed the incomplete application of Durr,Fred Fred Durr for an architectural and site control permit for auto repair shop at the rear of the Saratoga Club. B. SUBDIVISION 1. SDR 12 - Cox, Charles (Rodrigues, A. A.) The Clerk brought the Commission up to date on details of the case. Discussion followed amongst the Commission- SDR 12 era and with Mr. Rodrigues. Cox,C. (Rodrigues) Commissioner Webster moved the approval of the record of survey subject to the four conditions set at the County Subdivision Committee. meeting of July 16, 1957- Carried unanimously. 2. SDR 36 - W. W. Powers The Clerk read the recommended disapproval of the SDR 36 County Subdivision Meeting of August 7, 1957. Powers,W.W. Commissioner Cameron moved disapproval of the record of survey. Carried unanimously. 3. SDR 41 - Evans, Alfred S. The Clerk read the conditions set at the County Subdivision Meeting of August 7, 1957. SDR 41 Commissioner Anderson moved the approval of the Evans, A.S. record of survey subject to the conditions set at the meeting of Aughat 7, 1957- Carried unanimously. -5- 4. SD 16 - Sevrens & Detrick (Saratoga Village) The Clerk brought the Commissioners up to date on the case and discussed the aspects of its submission as a final map to the City Council before approval of it as a portion of the approved tentative map. SD 16 Commissioner Webster moved the approval of the portion Detrick as a tentative map subject to all conditions on the previous tentative map insofar as they apply to this tentative map and subject also to the condition.~that the approval of the County Engineer be required on this map as a separate submission. Carried unanimously. 5. SD 25 - W~ndemere Co. The Clerk stated that Mr. Walters had requested that the SD 25 case be dropped. Wandemere Co. Commissioner Cameron moved disapproval of the subdivision map. Carried unanimously. 6. SD 40 - Western States Land Co. The proposed subdivision was discussed by Mr. Mackay of Mackay & Somps, Sunnyvale,Cslif., and the Clerk SD 40 requested more time to study certain proposals. Western States Land Co. Mr. Mackay stated his approval of a thirty day extension. Commissioner Anderson moved that the thirty day extension be granted. Carried unanimously.
