WRITTEN COMMb~v. ICATIONS 1. The Secrebary read a letter dated September 16, 1957, addressed to the City Council, written by Mrs. Raymond V-10 Rodoni T. Waylsnd with reference to the Saratoga Gravel Co. operations on Pierce Road. iII RESOLUTIONS A. ZONING PETITIONS 1. C-8 - Tripoli, J. P~esolution No. C-8-2A. C-8 The S~cr~tary read the proposed resolution and a Tripoli, J. report of findings attached thereto. Commissioner Webster moved the adoption of the resolution as it incorporates the findings. Carried unanimously. IV PUBLIC HEARINGS _ 7:40 P.M. A. VARIANCES AkrD USE PERMITS 1. V-42 - Dollard, Nell V-42 The Secretary introduced the case bo the Colmnission Dollard ,iq. and read a letter dated September 19, 1957, from -l~ Miss ice Ackerman, urging approval of the application. Following discussion of the application Commissioner Pasetta moved that the use permit be granted. Carried unanimously. V-43 - Maynard, [larry The proposed use of the property was described by applicant. Special reference was made to the car- port setback on the west boundary of the lot. The V-43 Secretary read a letter dated September 23, 195? from Maynard, Mrs. Cynthia Ingham (Assenza) urging adherence to existing restrictions. Com~.issioner ~iebster moved that the use permit be granted with the condition that the side yard setbacks be a minimum of 6 ft. on both sides. Carried unani- mously. 3. V-44 - Teal, J. M. The Secretary described the proposed use and the need for a variance in rear yard setback minimums. Mrs. Teal discussed the plan with the Commission. V-44 A new plot plan was submitted at this time and Teal, J.M. accepted by bhe Commission as a part of the file. Com~nissioner Pasetba moved that the variance be granted in conformity with the plan submitted at this meeting. Carried unanimously. Adjournment of public hearings at 8:15. V MATTERS HELD b~NP.~'ETi ADVISEMEqT 1. V-41 - Pennington, W. A, The Secretary brought the Commission up to date on previous action on this case a~d read a letter dated V-41 Fennington,W.A. September 20, 1957 from L. M. Farasyn, attorney for Mr. Pennlngton, describing the history of the uses on the premises. -2- Following discussion and comments by the Commissioners Mr. Pennington addressed the group with regards to proposed highway widening and contemplated improve- ments in the structure. Commissioner ~iebster stated that the question of rezoning in the area would be studied carefully by the Planning Commission in the future but the ques- tion to be decided tonight was the extension of non- conformin~ use, not the validation of existing uses. Commissioner Bennett discussed the question of rezoning procedure with the applicsnt. Commissioner Webster moved the petition be denied. Carried unanimously. VI COMi.iITTEE REPORTS A. ARCHITEC~I~iL A!4D SITE CONTROL 1. V-45- Flory, L. J. Mr. Flory described his project to the Commission, discussed the type of construction and pointed out that the project would include alteration of the V-45 front of the store only. Flory, L.J. Commissioner Pasetta suggested cooperation with an architect or draftsman on the improvement of "panel design". Commissioner Pasetta moved tlmt the Architectural and site control permit be granted. Carried unanimously. B. SIBDIVISION 1. SDR 44 - Schmidt, Ernest W. The Secretary read the conditions of site approval set at th? meeting of September 17, 1957. Commissioner Anderson requested that the matter be taken under advisement. 2. SDE 45 - Aldredge, Charles The Secretary brought the Commission up to date on previous action on this case and 4iscussion ~Ollowed of house location and inspection of bopcgraphlcal map. Mr. Wentworth of Oak Street asked to see the map and to check the house location. SDR 45 Followin~ discussion of tl~e case Commissioner Anderson Aldredge,C. moved that the building site approval be granted subject to the following conditions: (1) Survey required. (2) 10' side yard setback on the east side of the lot facing the unimproved portion of 5th St. (3) $150 flood co~itrol fee. (4) Vehicle access to lot to be from Charles St. only. Carried unanimously. 3. SDR ~8 - Hibbe, Dr. H. J. Follov~Ing discussion of the case Commissioner Ps. setta moved approval subject to conditions set at the County SDR 48 Subdivision Co~Ittee of September 17, 1957, which are Hibbe,Dr.H.J. as follows: (1) Post $150 cash to flood control (2) Provide survey Carried unanimously. 4. SDR 49 - Small, Frank The Secretary introduced the case and discussion followed. Carried unanimously. -4- 5- SDR 47 - Case and Powers The Secretary recSmmended that the Plan~ing CoP_mission reconsider certain conditions set on this case st its SDR 47 last meeting. Following discussion Commissioner C~se and Powers Webster moved that the Plannin~ Commission on its own motion reconsider the case and as a condition of reconsideration that the 10' future street line and 20~ flood control easement be express conditions of the approval.
