PLACE: Fireman's Hall, Oak Street, Saratoga, California TYPE: Regular Meeting I ROUTINE ORGANIZATION A. ROLL CALL Present: Anderson, Bennett, Crisp, Hidgins, Pasetta, Webster Absent: None B. MINUTES Commissioner Anderson moved that the minutes be approved as received. Carried unanimously. II N~! BUSINESS A. N~ ZONING PETITIONS 1. C-10 - jules Duc Commissioner Anderson moved that the Secretary be C-lO directed to set a date for public hearing. Carried Jules Duc unanimously. 2. C-11 - John Rodrigues, Jr. Commissiener Webster moved that the Secretary be C-11 directed to set a date for public hearing. Carried Rodrigues unanimously. B. WRITTEN COMMUNICATIONS 1. Letters of Pennington and Rosenreid re Rezoning The Secretary read the letters of the Penningtons and Rosenfelds with reference to establishin~ commercial zoning alon~ Highway 9- Commissioner Pennington Crisp moved that the Secretary write a letter to & Rosenreid re Rezonlng the applicants and explain the procedure for establishing rezonlng and that the letters be filed for future reference in preparation of the master plan. Carried unanlmcus]y. -1- 2o The Secretary read a letter from Chester C. Wrenn dated October 5, 1957 requesting change in street name for a certain portion of Zorks Avenue. Zorka Ave. Name change Commissioner Higgins moved that the Secretary be directed to set a date for public hearing, for the proposed street name change. Carried unanimously. C. DISCUSSION OF PROPOSE CIVIC CENTER SITE The Secretary read a description of the property and explanation of its proposed uses. Proposed Commissioner Criso requested that the matter be Civic Center referred to the Architectural and Site Control Committee for a report showing possible uses of the property. Commissioner Bennett asked that the Architectural and Site Control CoMmittee make a study showing the uses of the property and report st an early date to the Commission. III RESOLUTIONS None IV PUBLIC HEARINGS - 7:55 P.M. A. ZONING PETITIONS 1. C-9 - Vogler, Fred The Secretary introduced the case to the Commission. Mr. Vogler spoke on behalf of his application and stated that he had no opposition from the residents and further he described the property and the pro- C-9 Vogler,F. posed use. The matter was discussed among the Commissioners and the question of spot-zoning and the suitability of this particular property for R4 uses were covered. It was pointed out that the matter would be recon- sidered with reference to the development of a master plan. -2- Commissioner Higgins moved that the petition be denied. Carried unanimously. B. USE PERMITS AND VARIANCES 1. V-47 - Saratoga Parent Nursery School The Secretary introduced the case to the Commission and Mrs. Haanstrs, President of the Parent Nursery V-47 Saratoga School, explained the Dropteed uses to the Commission. Parent ~ ' Nursery After discussion, Commissioner Webster moved that the School use permit be granted for a period of one yesr from the date of the lease and that the permit was non- transferable. Carried unanimously. Time 8:25 P.M. Public hearings declared adjourned. V MATTERS ~LD UND~I~ ADVISEMENT Dione VI COMMITTEE REPORTS A. ARCHITECTD~AL AND SITE CONTROL 1. V-46 - Hernandez, S. G. The Secretary introduced the application for architectural and site control approval on a motel unit submitted by Mr. 3. G. Hernandez. Mr. Hernandez described the proposed use with V-46 Hernandez,S.O. reference submitted in the application. Mr. Hernsndez discussed the question of allowing an existing adjacent structure to remain standin~ after ccnstruction of the new unit. Commissioner Webster moved that the matter be referred to the Architectural and Site Control Committee for a further study. Carried unanimously. B. SUBDIVISIONS AND SI'_vE~ APPROVAL 1. SDR 23 - Oxendine (Anderson) The Secretary introduced the case to the Commission SDR 23 and brought them up to date on past actions regarding Oxendine (Anderson) it. Mr. Toby, 809 Fremont, Los Altos, one of the owners of the property, described the proposed use -3- and discussed aspects of the conditional approval with the Planning Commission. After lengthy dis- c~ssion Commissioner Webster moved that the tenta- tive be accepted subject to the following conditions: 1. Show 10' future street line adjacent to Sobey Road. 2. Provide 2~' fee title access to Lots 3 and ~, the centerline of same bei.n~ the common boun- dary of Lots 1 and 2. 3- Access to Lots inrear to be paved 18' minimum width. 4. Drainage to be provided as shown on tentative or in open ditch as preferred by owner on same route s~d base elevations. 5. Front setback on Lots i and 2 to be 100-120 ft. from Sober Road as requlre~ by County Health Dept. 6. Post ~150.00 cash per lot to Flood Control. 7- Buildimgs on Lots 3 and 4 to constr~cted on rear half of lot ss require6 by County Health De~t. 8. All lots to have a minimum building site area not under i net acre,. Carried,~nsnimously. 2. SDR 44 - Schmidt, E. ~. The Secretary discussed the past action of the Commission in this case and the applicant asked for modification of certain co~dltio~s of approval. SDR 4~ Schmidt,E.W. Commissioner Higgins moved that the tentative map be approved subject to the following conditions: 1. Deed area for ditch as required by Flood Control. 2. Develop drainage structures corresponding to the drainage on adjacent property downstream. 3. Post ~150o00 cash to Flood Control. Vote cast as follows: Aye: Bennett, Higgins,Pasetta and Anderson, No: Webster. Commissioner Webster stated that his no vote was based on the failure to properly provide for septic tank location in the conditions of approval. 3. SD 40 - Western States Land Co. The Secretary read s letter in regard to this case from the City Administrator dated 10/14/57 requestin~ the imposition of certain conditions precedent to the approval of a tentative map. Mr. Harvey Koch, representing the Western States Le~md Co., discussed certain conditions of aporoval with the Planning Commission. Commissioner Bennett discussed the alignment of the proposed SD 40 ~.Vestern 90' right-of-way with the intersection of Quito Road. After States Land Co. discussion of the right-of-way and drainage problems Conumissioner Webster moved that the tentative map be approved subject to those conditions set at the County Subdivision Committee Meeting of August 7, 1957 with conditions 5 and 12 excluded. And further that in place of the excluded conditions the following be substituted: "All in-tract 8raina_qe to empty into Saratoga Creek through a system of underground storm sewers. Actual installation and specifications of said underground storm sewer to be subject to approval of City Engineer." Carried unanimously. Mr. Koch expressed an intention to appeal the storm drain condition to the City Council. -5- 4. SDR 49 - Small, Frank The Secretary read a letter from Mr. Small dated 10/10/57 SDR 49 requesting withdrawal of his b~ilding site approval request Small,F. at this time. Granted.
