PLACE: Fireman's Hall, Oak Street, Saratoga, California TYPE: Regular Meeting I ROUTINE ORGANIZATION A. ROLL CALL Present:Anderson, Bermett, Crisp, Higgins, Pasetta, Webster Absent: None B. MINUTES Commissioner Crisp moved that the reading of the minutes be dispensed with and that they be accepted as distributed. Carried unanimously. II WRITTEN COMMUNICATIONS 1. Report on Non-profit Recreational Areas The Secretary read a report on neighborhood recrea- tional centers from the County Planning Dept. dated November 22, 1957. George Day, Saratoga, commented briefly on the proposed recreational area. Mr. Van den Bos, Palo Alto, discussed the activities Non-profit of the Green Meadow Association in Palo Alto as an Recreation Report example of the successful experience with this type of activity. He further explained.that the people in the area to be served by the recreation center favor the development of it and further that the project would be unencumbered and that there was no danger of it becoming a public charge. Mr. Robert Crane, developer of Merrivale, expressed the interest of the residents of his area in a similar type of project. The City Attorney discussed the methods of accom- plishing the necessary change from R-1 zoning to accomodate the proposed use and also the need for establishing a general policy on this subject. Commissioner Crisp moved that the matter be referred to the Subdivision Committee for recommendations and a report. After further discussion amongst the Commission and additional comments from the audience Commissioner Crisp's motion was carried unanimously. 2. The Secretary read a letter dated November 29, 1957 from the San Jose Water Works requesting a change in the conditions of Use Permit V-34 granted July 22, 1957. A specific change would be as follows: "There would be one tank approximately 67' in diameter and 20' in height". Commissioner Crisp stated his feeling of the need to get the consent of the neighbors to any proposed S.J.W.W. changes and Commissioner Bennett concurred with his V-34 statement. Commissioner Pasetta felt that there would be no pro- test forthcoming from the residents and moved that the application be approved as submitted. The motion was brought to a vote and defeated. Commissioner Crisp moved that the Secretary be directed to establish a date of public hearing for the proposed change in the condition of the use permit. The motion was amended by Commissioner Webster to include the request for a more detailed plot plan. Voting on the motion was as follows: Ayes: Anderson, Bennett, Crisp, Higgins, Webster Noes: Pasetta III RESOLUTIONS A. REZONING 1. C-11-2A - John Rodrigues The Secretary read the resolution "Adopting the Report C-11 Rodrigues,J. of Findings and Recommending Proposed Amendment" and the report of findings attached thereto. -2- Commissioner Webster moved that the resolution be adopted including the report of findings. Carried unanimously. IV PUBLIC HEARINGS - 8:03 P.M.' A. REZONING None B. USE PERMITS AND VARIANCES 1. V-50 - St. Andrews Episcopal Church (Continued) The Secretary read recommendations of the County Planning Dept. in regards to improvement conditions. V-50 Reverend Strasburger speaking for the Church stated St.Andrews Epis.Church his concurrence with the recommendations. After further discussion Commissioner Crisp moved.that the use permit be granted subject to the conditions recommended by the County Planning Dept. and also to include architectural and site control. Carried unanimously. 2. V-52 - Lomac Development Co~ The Secretary read the.application and Mr. Harkhess, the applicant, discussed the matter with the Commission, especially with relation to the loca~on of the house V-52 and its effect on the adjacent property. After further Lomao Devel. Co. discussion Commissioner Anderson moved that the variance be granted. Carried unanimously. Public hearings adjourned at 8:30 P.M. V MATTERS HELD UNDER ADVISEMENT None VI COMMITTEE REPORTS A. ARCHITECTURAL AND SITE CONTROL None B. SUBDIVISION AND BUILDING SITE APPROVAL 1. SDR-54 - Kruse, W. G. SDR-54 The Secretary explained the application and located Kruse,W.G. the sites involved on the map. Mr. Kruse, 365 W. Bayshore, -3- Sunnyvale, discussed the application with the Commission. There followed a lengthy discussion on the means of access to the property and the private rights-of-way involved. The Secretary read a letter to Dr. Milton Broemser from the San Jose Abstract and Title Co. dated December 4, 1957 with reference to certain rights- of-way involved. Commissioner Webster stated his.feeling that no action of the Planning Commission creates any rights-of-way for adJacsnt property o~mers. D. R. Miller, Los Altos, stated his feelings as to his rights to use Saratoga Hills Road, and further his feeling that the application.should be approved. Commissioner Crisp moved that the tentative approval be granted subject to the conditions suggested by the County Planning Commission and read at the meeting by the Secretary; leaving out all reference to Saratoga Hills Road in Condition 4. Carried unanimously. Commissioner Webster moved that all reference to Saratoga Hills Road as a primary access to the site as shown on maps in.the.file be deleted. Carried unanimously. 2. Proposed Subdivision Ordinance - Committee Discussion Commissioner Bennett made a statement introducing the proposed subdivision ordinance and stated that it was being read tonight only as a report of the Subdivision Subdivision Committee and that public hearings would be scheduled Ordinance in the near future. The Secretary read the ordinance. Commissioner Crisp and the City Attorney discussed the ordinance with reference to its possible dupllca- \ tion of certain parts of the minimum lot size ordinance. -4- The Chair directed the Secretary to set the date for public hearing. Commissioner Bennett moved that the meeting be adjourned. Carried unanimously. 9:50 P.M. Present 20 - 1 Press -5-
