Present: Anderson, Bennett, Crisp, Hlggins, Pasetta Absent: Webster B · MIhl~i?ES Commissioner Crisp moved. that ~he reading of the minutes be dispensed with and that they be accepted as distri- buted. Carried unanimously. II WRITTEN COMMUNICATIONS 1. A letter from the Planning Commission to the City coun011 requesting the assistance of a planning Planning technician in.compiling proposed zoning.ordinances Technician was read by the Secretary. Commissioner Pasetta moved_that the letter be for- warded to the City Council_for action. Carried unanimously. 2. The Secretary distributed copies of a report from the CoUnty Planning Dept. concerning establishment Recreation of non-profit recreational areas in residential Areas Report subd~y~lons. III RESOLUTIONS 1. PC-10 - Estes, Ralph The Secretary read Resolution No. C-10-2A,"Adopting report of findings and abandoning ~urther proceedings C-10 on proposed amendment" and also the Report of Findings Estes,Ralph atta0hed thereto. Commissioner Crisp moved that the resolution and Report of Findings be adopted as read. Carried unanimously. -1- IV PUBLIC HEARINGS - ?:45 P.M. A. REZONING 1. PC-11 - Rodrigues, John The Secretary explained the nature of the case and pointed out_the area involved on the zonir~ map. Mr. Rodrigues spoke in behalf of his application and explained that a tentative map for the proposed area P~-ll Rodrigues, had already been approved by the Planning Commission. John Commissioner Pasetta moved that.the petition be granted and that a favorable_recommendation be for- warded to the City Council.. Vote was as follows: Yes: Anderson, Bennett, Hlggins and.Pasetta, No: Crisp. Carried. B. USE PERMITS 1. V-48 - Brown, Mrs. Irene The Secretary explained the application after which Mrs. Brown discussed with the Commissioners the nature of the use for which the permi~ was being applied. She explained that it was an art workshop and that there were never more.than fou~ cars.at a time parked in the V-48 driveway. Further that there was no commercial aoti- Brown, Mrs. Irene vity other than the. sale of materials to students and the charge for the instruction. Commissio~er Andersonmoved that. the use permit be granted with a one year time limit. Carried unanimously. Dr. Simone, Fourth St., Saratoga, spoke in behalf of the application and Commissioner Bennett explained the attitude of the Planning Commission. toward home occu- pations. 2. V-49 - Francelie Inc. Mr. Adams, representing the applicant, explained the -2- need for the reduction in rear yard setback and stated that the setback from the cul-de-sac would be at least ~5 feet. Mr. Adair, Reid Lane, examined the plans and questioned the Commission. on the..cons~ruction. of a fence to the street line. Commissioner Pasetta moved that the petition be granted, dimensions as shown on.the plot plan including a 25 ft. setback from the cul~de~sac.. Carried unani- mously. 3- V-50 - St. Andrews Episcopal Church Leo Ruth, engineer for the applicant, explained.th~ plans.for the property showing the.layout Of proposed structures and their affect on adjacent property. Mr. Jones, architect.for the.Church, discussed the location of the parking area, the centralized activi- ties and the setback. of.the buildings.from the street. V-50 He stated_that there.waseroom for.at least 100 auto- St. AndPews Episcopal mobiles in the parking area. Church Commissioner Bennett_stated that. certain stipulations on the use permit would be required and that until such recommendations were received.from the County Building Site Approval. Committee t~e Commission could take no further action. The Chairman declared that the public hearing would.be continued until the meeting of December 9, 1957- V-51 - Saratoga Inn The Secretary read the.application and stated that V-51 certain required information. was_lacking. Saratoga Inn Mr. Gardner Bullis,.at~orne~..for .the applicant, stated that he had no p~ans to submit at this time and that no Immediate construction.was contemplated. -3- Mr. L. B. Peck, Orchard Road, stated that he had nothing against the applicant.but.that he felt that the.residential~are~.of Saratoga was not the proper place for another cocktail lounge, as requested by the applicant. Mr. Roland,Buckman, Saratoga Ave., praised the ethical operation of the present management of the In~ but. stated that he would.oppose the installation of a cocktail lounge because of additional traffic- and the fact that it was. close.to a residential area. Mrs.Marion Hurtlinger, Blue Hills Real Estate, stated her feeling that.there was need. for a high class hotel as well as restaurant and cocktail lounge in Saratoga. Mrs. Virginia Crisp stated_that.she'was 100% in favor of the statements made by Mr. Buckman. Dr. Nobel Wiley Jones expressed his feelings that if Saratoga needs the Inn and that/the question of a liquor license came.up the opportunity would be given for protest to the proper state agencies. In the meantime.the.Inn needed..to be refu~nished and modernized and he felt that the.use permit_should_be.granted. Commissioner. Anderson.stated.that he would find it difficult..to render a favorable decision.without seeing more detailed plans of proposed.construction. Mr. Bullis stated.that they were applying for a use permit.at this time to stabilize the present high type of operation. After further discussion Commissioner Pasetta moved that the application for a use permit be granted "for a hotel. of high standard of service and approved facility" but the balance of the application.as stated in Exhibit B attached thereto be denied.. VOting as follows: Ayes: Anderson, Bennett, Higgins, Passetta~ Noes: None, Not Voting: Crisp. SUBDIVISION AND BUILDING SITE APPROVALS 1- SD 16A - Sevrens and Derrick The Secretary explained that this was a resubmission of a portion.of a previously approved tentative map. The Secretary read a letter from.the County Planning Dept. dated Nov..15,.1957 with reference to this subdivision. Admiral. Joseph Connol~y, Saratoga, speaking from the SD 16A- floor stated.his feeling. that_subdl~iders. should pro- Sevrens and DerriCk vide recreation.areas. in their subdivisions. He explained that unless. the subdividers provided these.facilities the taxpayers would be ~equi~ed to do so and that the .tax rate would increase accordingly. Comlssloner Crisp explained that the. Planning Commission had given this matter consideration. and that they were trying to arrive at. some .legal.means of insuring the subdividers installation. of.such facilities. After further.discussion.Commissioner_Crisp moved that the map be approved as submitted.._Carried unanimously. 2. SD 51- Dr. Ploeser (Longs0n) The Secretary read.the conditions.of improvement recommended for'this subdivision at the COunty Sub- SD 51 Dr. Ploeser division Commit~ee meeting. on November 19, 1957- (~ongson) ' Mr. Longson,. engineer for.the developer, .stated that the street.alignment facing lots 5, 4, 3 and 2 could be adjusted to avoid any conflict_with zoning district regulations. map Commissioner Crisp moved that the tentati~e/be.approved subject to the conditions read and to satisfactory compliance with the zoning.district_boundary. Carried unanimously. 3. SD-52 - Armstrong, (Longson) The Secretary read the conditions for this building SD-52 site approval set at the County Subdivision Committee Commissioner.Pasetta moved that the tentative map be approved subject to the conditions read. 4. SD-53 - Lasich, Jartin The Secretary read the conditions for this building site approval set at the.County Subdivision Committee meeting on. November 19, 1957- SD-53 Mr. Lasich, Allendale Ave., the applicant, stated his Lasich, Martin feeling that he should.not.be.required to install a sewer connection. After further. discussion of the sewer and right-of-way improvements, Commissioner Crisp moved tb~t the tentative map be approved subject to conditions Land 2 of the County Subdivision CoMmittee Report and that condition..3 be changed to read "subject to approval of County Health Dept. on installation of septic tank."
