MINUTES Co~mt'ssioner Crisp moved that'the reading of the minutes be dispens~d,=~nd that they be accepted as distributed. Cartled unanimously. II NEW BUSINESS A. WRITTEN COMv[UT~ICATION None B. NEW ZONING PETITIONS 1. O. R. Maggiore - C-12 The secretary read the application for change of zoning from RI-B2 to RLpH-BD. Chairman Crisp moved that the secretary be directed to set a date for public hearing, O. R. Maggiore C-12 namely March 10, 1958. Wade Hover, San Jose, attorney for Mr. Maggiore stated that this date was preferable to February III PUBLIC HEARINGS A. USE PErmITS 1. R. L. Mathis - The secretary read the details of the request for a use permit. Commissioner Pasetta moved for approval of the R. L. Mathis V-56 use permit. Carried unanimously. -1- B. SUEDIVISION ORDINANCES icontinued) 1. PC-4 5ubdivlsio~ Ordinance The secretary read a letter from Leo Ruth, Civil Engineer, dated 3anuary 2?, 1958. The letter was referred to the subdivision committee for study. Larry Palm, Saratoga, stated that the 150r frontage PC-4. Sub- on acre zonin9 was overly restrictive. Acting Chairman division Ordinances Bennett moved that the hearing be continued until the next meeting. The secretary was directed to notify the Associated Civil Engineers and Land Surveyors of Santa Clara County of the next hearing. Adjournment of public hearings. IV CQW~ITTEE REPORTS A. WESTERN STATES L~ND COMPANY - SD-40 The secretary read a letter from Oeor9e Nolte dated January 13, 1958. Mn'MacKay of MacKay and Somps stated that the City Sf San Jose would ente~ into an agreement with the City of Sarato9a to accept the responsibility now for drainage of Western this tract even if the actual installation of the.drainage States Land pipes was two years off. Chairman Crisp stated that the City Company SD-~O Council will be studying the overall drainage problem and'when a decision Is ~eached, it will take care of this problem and others. After lengthy discussion between Mr. MacKay and the Planning Commissioners, the Commissioners decided to reaffirm drainage requirements in the tentati. ve map. B. SUBDIVISION C~I~MITTEE 1. L. A. P~lm - The secretary read the condition "disapproved until access is approved throuGh.,~o'Montevtno ~oad". He explained L.A. Palm SDR-5~ further that the reason for this was that the fire marshall wants no further homes in this area until an access road is provided. Mr. Palm stated that he had sold 50 sites in this area in ~he last 10 yea~s and that people who have J bought property already further up Bohlman Road~ will be in for buildin9 permits. Mr. Palm stated that he thought it unfair that he should provide the access road if others were not assessed al~o. When Mr. Palm agreed to a time extension of 30 days~ Chairman Crisp moved that the case be continued for an additional 30 days. Carried unanimously. Commissioner Anderson stated that the County Engineers plans for this road shoul'd be ascertained. Assistant City Attorney Clark was directed to study the legality of the condition. 2. James Barnctt- 5D-%6 The secretary read ,the conditions set by the subdivision committee of the County Planning Department at their meeting of January 21, 19~8. Mr. Somps, Civil Engineer, for the applicant questioned the conditiO~:12. He was referred to the County Engineer for clarification of four lane develop- ment of Quito Rpad. Commissioner Pasetta moved for approval of the tentative map, subject to the conditions laid down James by the subdivisio~ committee of the County Plannin9 Depart- Barnett '5D-56 merit at their me~tinG. of January 21, 19~8 and with the additional conditionS:-1. Each lot to contain no less than 10,000 square feet 2. Minimum'width at the building line to 5~ 8~ feet. Carried unanimously. Chairman: Crisp stated that the Planning Commission had been .: acting for one year and that an election of officers should be.held at the next meetingT. The seqretary stated that complete sets of zoning maps will be ~eceived soon from the County Plannin9 Depantment and '.Zoning suggested that screens be used to display these maps at the 'Maps PlanninG Commission Meetings.
