MINUTES Commissioner Webster suggested that IV, A, 1., on Page 3 of the minutes fqr the June 9, 1958 meeting be changed to read a~ follows: "Commissioner Webster moved that Exhibit B, as sub- mitted June 9, 1958 be given Architectural & Site Control approval, subject to the terms and conditions of the Use Permit previously granted." Commissioner Webste~ moved that the minutes be approved as corrected. Commissioner Crisp seconded. Carried unanimously. PUBLIC HEARINGS A. USE PERMITS V-?I 1. V-?I - W. A- Meyer W.A.Meyer Mr. Ing~aham, attorney for Mr. Meyer, stated that a set of new corporation papers had been filed with the Assistant City Attorney on June 22, 1958- Commissioner Anderson moved approval of the Use Permit subject to the following conditions: 1. Use permit is granted subject to approval under the applicable laws of the State of California by the State Corporation Commission of: a. Articles of incorporation b. By-Laws c- Financing. Copy of the approved corporation action to be filed with the Saratoga Planning Commission. 2- This use permit is granted to approve the establishment of a high:.type of Recreational or Country Club; the recre- ation and other facilities as specified in the application -1- to be operated in conjunction with the social activities of the Club House and Grounds. This permit is to be void if these facilities are separated wit]lout further modifi- cation of this permit. 3- Use of the property as a commercial recreation area in the case of financial failure of the club will not be permitted because of the adverse effects on the adjacent area. 4. This permit is 9ranted subject to approval of archi- tectural, landscape, parking and other,plans. 5. The membership shall be limited to 450 members of which 75% shall be residents of Saratoga, Los Gatos, Monte Sereno, Cupertino and adjacent areas of Santa Clara County. Preference for replacing members of the remaining 25% shall' be given to residents of the above named conu- nities. 6. This permit shall be void two (2) years from date of issuance unless the Club is in active operation at that time. 7. This permit shall be subject to review automatically at the end of each year followin9 issuance or at such other times as may be requested by the Club or the Saratoga Planning Commission. ~ommissioner Crisp seconded. V-88 2- V-88 - Ray-Lite Neon Ray-Llte Neon The Actln9 Secretary read the request for a Use Permit to erect a new directional sign in place of the present one at the corner of Cox Ave. and Saratoga Avenue. Mr. H. F- Johnston, Manager of Ray-Lite Neon, explained the request. Commissioner Crisp moved for approval of the Use Permit. Commissioner Tiffany seconded. Carried unanimously. V-89 3. V-89 - Vyverber9, John J.Vyverberg The Secretary read a letter from Joan Vyverberg received -2- on June 23, 1958 asking temporary withdrawal of the appli- cation for use permit for horses. B. VARIANCES 1. V-87 - Thompson, Willard M. V-87 The Acting Secretary read the request for a variance from W.M.Thompson the required front and rear setbacks on a corner lot tn Tract #1690. Commissioner Crisp moved for approval of the variance, subject to the house being moved toward the rear of the lot so as to assure a 10' clearance from Lot #35, 25' set- backs. on Angus Ct., 16t setback on Cumberland Dr., and a 20' rear clearance. Commissioner Tiffany seconded. Carried unanimously. I I I COI~AMI TrEE REPORTS A. SUBDIVISION COMMITTEE 1. SDR 65 - Mel DoSelie SDR-65 The Acting Secretary read the conditions as set by the Mel De Selle County Subdivision Committee meeting of April 16, 1958. Commissioner Pasetta moved that the application 'for build- lug site approval be granted subject to conditions #2, 3, and ~, and further that the applicant be required to improve the pavement to an 18' width from the edge of the bridge to his driveway. Commissioner Crisp seconded. Chairman Bennett ruled the motion and second out of order. TIle Acting Secretary read a letter and statement of policy from the County Director of Public Works dated June 20, 1958 regarding 18' minimum improved'access roads to building sites. Bruce Wiggins, County Fire Marshall, explained the need for the 18w' width. Commissioner Pasetta moved that the application for building site approval be granted subject to conditions #2, 3, and 4, and further that the applicant be required to improve the pavement to an 18t width from the edge of the bridge to his driveway. Commissioner Crisp seconded. The~followtn9 vote was recorded: Ayes: Crisp, Pasetta. Noes: Tiffany, Webster, Bennett, Anderson. The motion was defeated. Commissioner Webster moved that building site approval be 9ranted subject to the conditions set by the County Sub- division Committee meeting..of April 16, 1958 and that condition #1 be amplified to specify an oil and screening surface. Commissioner Tiffany seconded. The following vote was recorded: Ayes: Anderson, Webster, Bennett, Tiffany. Noes: Crisp, Pasetta. Motion carried. 2. SDR-69 - L- T. White SDR-69 L.T. White T~e Acting Secretary read ~he conditions as set by the County Subdivision Committee meeting of June 18, 1958. A letter dated June ~, 1958 from the State Division of Highways was then read. Chairman Bennett directed that the'case be continued until July 28th so that the matter of the number of building sites being requested could be clarified. Mrs. White agreed totthis continuance. Commissioner Crisp left the meeting at 9:00 P.M. SDR-70 - A. R. Woolworth SDR-70 The Acting Secretary read the conditions as set by the Sub- A.R.Wool- worth division Committee meettn9 of June 18, 19~8. Commissioner Pasetta moved approval of the building site subject to the above conditions. Commissioner Tiffany seconded. Carried unanimously. ~. SDR-71 - Mrs. D- S. Dooman SDR-?I D.S.Dooman The Acttn9 Secretary read the conditions as set by the County Subdivision Committee meetin9 of June 18, 19~8. Warren Held, architect for Mrs. Dooman, presented photo- graphs of the road leading to this site. Mr. F. Oehler and Mr. D. Geoffroy, both owners of land adjoining this building site, spoke regarding the trees along the right of way- Bruce Wiggins, FIre Marshall, spoke about the need for otl and screenings along this right of way. Commlssioner Webster moved approval of the building site subject to the foregoin9 County Subdivision conditions, with~the exception that the paving need not exceed 155 oposite the 3' oak tree at the entrance to the right of way and if other difficulties are encountered the appli- cation and conditions can be reviewed further without fee. The following vote was recorded: Ayes: Anderson, Bennett, Ttffany, Webster. Noes: Pasetta. Motion carried. 5. SDR-72 James MillikAn SDR-72 T~e Acting Secretary read the conditions as set by the J.Milltkin County Subdivision Committee meeting of June 18, 1958. Chairman Bennett ordered the Secretary to contact the owner regardin9 the net acreage of the building sites. IV PETITIONS AND GRIEVANCES A. WRITTEN COMMUNICATIONS 1. City Council 701 ProGram City The Secretary read a letter directed to E. R- Andtaws from CounCil - 701 Program the City Council regarding the 701 Program. The Secretary stated that July 1, 1958, Fireside Room of the Federated Church in Saratoga is the time and place set for the next study session of the Planning Commission and City Council with Mr. Lawrence Livingston, the Planning Consultant regarding the minimum lot size ordinance. Commissioner Anderson moved for adjournment at 9:35 P.M. Commissioner Pasetta seconded.
