MINUTES Commtssione~ Anderson moved for approval of the minutes as distributed. Commissioner Higgtns seconded. Carried unanimously. II NEW BUSINESS Ii Sign Ordinance - PC-6 PC-6-1 Chairman Bennett indicated that the Planning Commission Signs was considering a sign ordinance amending the County of Santa Clara~s zoning regulation ordinance which was adopted by reference by the City of Saratoga. Mr. Mttch of the Santa Clara County Builders~ Association stated that he wanted to go on record with the following recommendations: 1) That dlrectlonal signs be 2t x 4t in size 2) That the subdivider pick out his own sites for directional signs. 3) That those subdivfslons which were of£ main roads be allowed one dlrectional sign the size o£ an entrance sign. Commissioner Crisp moved for adoption o£ Resolution No. PC-6-1 being, "RESOLUTION PROPOSING ANENIlv~NT TO ZONING ORDINANCE AND DIRECTING SECRETARY TO SET 'TINE AND PLACE FOR PUBLIC HEA~ING'ANDORDERING NOTICE OF HF_ARiNG PUBLISHED." DeSella V-69 The Clerk read the application for a variance from a re- DeSelle quired side set back of 15t to a proposed l~t set back. Commissioner Anderson moved for approval of the variance. Commissioner Higgins seconded. Carried unanimously. 2. V-9? - Walter Marck V~97 The Clerk read the application for a variance from a ra- W. Marck qutred lOt set back to a desired 6t side set back. Mr. L. Gilbert of 20190 Cherry Lane, Saratoga spoke against the proposed variance. Commissioner Webster moved for denial of the variance. Seconded by C~mmissioner Anderson on the basis that there was no hardship involved. Carried unanimously. IV OLD BUSINESS 1. .Proposed amendment to zoning ordinance regulating density Min. Lot Size of population, locations of structures, etc. Ord. The Chairman read the proposed ordinance from the beginning and during the course of the discussion the following changes were recommended and approved: 1) Insert under Section l., DEFINITIONS, after FRONTAGE the following: (g) Heigh~ - The verticai.:distance from finished grade of that portion of the site covered by the structure to the highest point of the structure or -2- .~W~ to the wall coping of a flat roof, or to the mean height between the plate and ridges of a hip, gable or 9ambrel roof." 2) Starting with LOT - A Site, on page 1, the identifying initial should be advanced one on all the remaining definitions. .3) In Section 2.3 in the table contained therein the 12,000 sq. ft- figure under B-2, Corner Lot, was 6hanged to 11,500. Section 2.~ a new paragraph to replace paragraph 3 of this section and to read as follows: "One foot shall be added to each side yard for each 2"feet above the lowest l~ feet of height of that portion of a structure adjoining a side yard, provided that a side yard mo~e than 25 feet shall not be required." A new paragraph to be added to Sect[on 2.4, said para- graph will be the fourth paragraph of this section and it is to read as follows: "On a corner lot a rear yard equal to the required minimum side yard shall be permit- ted, provided that a yard space equal to 25 per cent of the area of the site shall be provided adjoining the rear property line." 6) Wherever the fiGure'16w is used in connection with Height in the ordinance, this figure is to be changed to 7) Paragraph ~ of Section 3-~ which read, "One foot shall be added --- the lowest 25 feet of height of a structure", should be eliminated in its entirety. 8) Section 5-1 (b) the word ~l~ feet" should be changed to 12 feet. 9) Section 5.1 the first six words, "Except as provided in Section ~.2" should be eliminated~ -3- 10) SeCtion 5-2 should be eliminated in its entirety. 11) Section 6.1 should be eliminated in its entirety. Section 7, RECLASSIFICATION OF ZONINe DISTRICTS, should read, "Ordinan&e 3-A, Exhtbit'"B" is h&reby'amended to reclassify properties tn the RlliBD zoning district to the R-XB2 zoning district". 13) From th~ old Section 7, w~tch should he ranumbered ~ection 6, the ordinance should he ranumbered. Commissioner Anderson moved that the suggested ordinance known as PC-3 he adopted subject to the changes noted above. S~conded hy Commissioner Htggins. Carried unanimously. V COMMITTEE REPORTS A. 'SUBDIVISION COMMITTEE 1. 'SDR-61 - L. W. Curtis SDR-61 T~e Secretar9 read a letter from Mr. Curtis dated August L.W.Curti~ 19, 1958 in which he asked for reconsideration of certain conditions. Commiss~oner Webster moved that the Director of Public Works he directed to inspect the sit& and come hack with ~is recommendations. Seconded hy Commissioner Higgins. Carried unanimously. 2- SDR-79 - G. Oldham SDR-79 T~e Secretary read the conditions as received from the Suh- O-Oldham division Committee at the County of Santa Clara but there seemed to he some confusion as to the extent of the right of way and Mr. Oldham a~reed to a continuation of a maxi- mum of 30 days so that this matter may be clarified. 3. Reports on Various Studies in Progress 1) Commissioner Crisp stated that the matter of zoning Ord. changes as set out in Ordinance 3A-7A was still being 3A-7A studied and consideration has been given to inserting a zoning change in a sectton of suggested Ordinance PC-3- However further discussion indicated that there was a question as to whether proper notice as to hear- ing had been Given in connection with this particular sectton and Commissioner Crisp indicated that further study would he continued, particularly along the lines of a separate ordinance regarding use permits for quarrying operations, The Planning Consultant stated that the Land Use Map Land Use ts very nearly completed and that he hoped to have a Map preliminary draft to present at a joint study session of the Planntn9 Commission and the Council near the end of September. He commented briefly on the fact that funds for the 701 Pro- 701 ProGram would be delayed due to the United States gram Congress failing to take action on the matter. He strongly suggested that the City of Saratoga, through the League of California Cities, ask that the applica- tions now on the desk of Mr. Auger, Commissioner of Federal Aid, be processed and sent back to the regional planning offices so that they may proceed. Commissioner Anderson moved for adjournment at-11=00 P.M. Seconded by Commissioner Pasetta.
