TYPE: Regular Meeting ROUTINE ORGANIZATION A- ROLL CALL .. Present: Anderson, Crisp, Pasetta, Webster, Tiffany, Ht99tns Absent: Bennett In the absense of Chairman Bennett, Vice-Chairman Webster presided at the meetin9· B. MINUTES: Commissioner Anderson moved that the minutes be approved as distributed. Commissioner Higgins seconded. Carried unani- mously. II PUBLIC F~INGS A. VARIANCES 1. V-102 - H. Melas V-102 Mr- Helas, the applicant, spoke in favor of his application H.Melas for a variance. Commissioner Crisp moved for approval of a variance to add an addition as outlined on the submitted map. Seconded by Conlmissioner Pasetta. Carried unanimously. 2- V-103 - H. D. Aste V-103 Commissioner Higgins moved for approval of the Use Permit H.D.Aste and variance from l0t side setbacks to 6~ side setbacks. 6econded by Commissioner Tiffany. Carried unanimously. B. USE PERMITS V-lOS 1. V-105 - Odd Fellows of California Odd Fellows Mr- Gtff Sobey, architect of San Jose, spoke in favor of the application for a Use Permit tnvolvtn9 a dormitory addition to existing infirmary buildinG. ComMissioner. Pasetta moved for approval. Commissioner -1- Higgins seconded. Carried unanimously. 2- V-lOa - Santa Clara Sand & Gravel Co. V-104 Mr. John Brethauer, attorney of Oakland, spoke on behalf S.C-Sand & Gravel Co. of the Santa Clara Sand & Gravel Co., and stated that they were not prepared to present their full case at this time and asked for a continuance until the 13th day of October, 19%8. Commissioner Pasetta moved for a continuance to 10/13/58. Seconded by Commissioner Higgins. Commissioner Pasetta withdrew his motion. ComMissioner Higgins withdrew his second. After a dtscussion'~ith persons present in the audience it was agreed that a special meeting would be held on 10/20/58. Commissioner Pasetta moved that the public hearing be continued until 10/20/58 at which time a special meeting would be held at the Fruitvale School. Seconded by Commissioner Crisp. Carried unanimously, The Chairman directed the Secretary to note in the minutes that 20 people in opposition were present. C. ORDINANCES 1. Sign Ordinance Sign George Day of Day Enterprises of Saratoga'spoke briefly Ord. regarding the proposed Sign Ordinance. Mr. Robert Keller of Pierce Rd., Saratoga asked that no limitation be placed On signs which would prevent a possible entrance sign to the City to b~ erected in the future. The Planning Commission reviewed the proposed ordinance and made several additions, changes and exceptions in line with the Planning Consultant's suggestions contained in his letter of of September 19, 1958. Commissioner Anderson moved that the proposed subdivision sign ordinance be referred to the subdivision committee to -2- correlate the notes on the changes suggested and trans- mit the same with Mr. Liv~ngstonxs letter of September 19, 1958 to the City Attorney for drafting of ordinance by the next regularly scheduled meeting. Seconded by Com- missioner Pasetta. Carried unanimously. Commissioner Higgins moved that all reference to off-tract dtrectional signs be deleted from the ordinance and that none be allowed. Seconded by Commissioner Anderson. A roll call was taken with the following result: Ayes, Ander- son, Higgins; Noes, Crisp, Pasetta, Webster, Tiffany. The motion failed to carry. Chairman Webster called the public hearing portion in con- nection with the proposed subdivision sign ordinance closed at 9:50 P.M. IV CO}~ITTEE REPORTS A. ARCHITECTURAL & SITE CONTROL 1. V-106 - W. E. Mustatn V-106 Mr. W- E. Mustatn spoke in favor of his application. W.E.Mustain Commi'ssioner Higgins moved that architectural and site approval based on the map submitted by Mr. Mustain on %he lath day of September be approved subject to a built-up roof being constructed rather than a corregated roof. Seconded by Commissioner Tiffany. Carried unanimously. B. SUBDIVISION CO~qITTEE 1. SDR-83 - H. L. Simmons SDR-83 C~manissioner Anderson moved for approval of the tentative H.L.Simmons map subject to the foll6wing conditions: l) Record survey 2) Provide $150.00 per lot Flood Control fee. Seconded by Commissioner Crisp. Carried unanimously. SD-81 2. SD-81 - Glenbrook #2 Glenbrook ~2 After some discussion during which Mr. Leo Ruth of San Jose -3- and Mr. A. Dampsay of. Saratoga spoke on behalf of the application, Chairman Webster referred the matter to the subdivision committee ~or clarification l) Extension of elan Brae through to westerly property line 8~ or 10~ walkway should be brought through to Braemar Drive, through about Lot 157 because of long block and need for access from Tract No, 1956 and others to school to north, Mr. A, Dampsay agreed to a time extension to the City of Saratoga until 10/13/58, the date of the next Planning Cor~dssion meeting. II C 2. Off Street Parking Off Street The Off Street Parking proposed ordinance was introduced by Parking Ord. Chairman Webste~ and he asked if there were any questions from the 'floor, either pro or con. There were no questions- Chairman Webster closed the public hearing in connection with the 6ff street parking proposed ordinance and referred the matter to the subdivision committee for review in con- nection with the suggestions made by the Planning Consultant in his letter of September 19, 1958 and for redrafting of the ordinance. A meeting at 5:00 P.M. on 9/23/~8 was set up by the sub- division committee with the Planning Consultant for dis- cussion of the suggestions outlined in his letter of Septem- ber 19, 1958, in connection with the proposed off street parkin9 ordinance. III OLD BUSINESS ~, REAPPRAISAL OF A-1ANDA-2 ZONES k-1 and 'In accordance with the suggestions of the City Council that A-2 zones the Planning Commission confer with the Planning Consultant -4- and the City. Attorney, the Secretary was directed to set up a meeting. V PETITIONS AND GRIEVANCES A-WRITTE~ COFAMUNICATIONS None B. ORAL PETITIONS 1. The plannin9 consultant su99ested a joint meetin9 with the Council and the Plannin9 Commission, said meetin9 to".be in the nature of a study session, tentatively set for 10/14/58.at 7:30 P.M. for a discussion of the interim land use plan. Chairman Webster adjourned the meetin9 at 11:30 P-M.
