TYPE: ~egular meeting I ROUTINE ORGANIZATION A. ROLL CALL Present: Anderson, Bennett, Crisp, Higgins, Pasetta, Webster Absent: Tiffany B. MINUTES: Commissioner Webster moved approval of the minutes as dis- tributed. Commissioner Crisp seconded. Carried unanimously. II PUBLIC HEARINGS A- USE PERMITS 1- V-48-R1 irene Brown V-~.8-RI The Secretary read the request to renew a use permtt Irene Brown previously granted for a one year period for a weaving school at 20431 Walnut Ave., classes not to exceed ten 'at a time. The Secretary read letters.signed by Bruce Thrasher, Diana B- Livingston, and Clarence E. Neale, stating no ~bjection to the school. Commissioner Webster moved that the use permit be renewed for a tw6 year period and that the Planning Commission retain jurisdiction to act upon the ~se permit at any tlme. Commissioner Anderson seconded. Carried unanimously. B. VARIANCES None C. ORDINANCES H-1 Zoning 1. Repealing certain uses in H-1 Zoning DIstricts Districts The Secretary read the proposed amendment to the zoning ordinance. Chairman Bennett called for commen~from the audience and when none were offered closed the public hearing. Commissioner Pasetta moved for approval of Resolution PC 9-2 recommending the change to the City Council. Commissioner Anderson seconded. Carried unanimously III NEW BUSINESS A.' CHANGE OF ZONING 1- C-16 -'Eramotto Gatewood C-16 The Secretary read the request for a change of zonin9 E.Gatewood from R1-B2 to C-2H for property located at Saratoga-Los Gatos Rqad at Oak'Place. Mr. Gatewood ~xplained the need for parking on his property. Commissioner Crisp moved that the Secretary be directed to set a date for public hearing. Commissioner Webster seconded. Carried unanimously IV OLD BUSIIf~SS A- C-iS - G. B. Steinberg C-15 The Secretary explained that this rezoning had not received G.B.Stein- berg the necessary five "yes" votes at the last regular meeting in order to send it to [he Council. After a discussion among the Commissioners as to spot zoning, Commissioner Higgins stated that since it is the inten~ion of the Planning Commission of the City of Saratoga that the area adZjoining parcel #1 to the south bounded by the Saratoga Creek should rightly be zoned for R4:B4 use, he moved that rezoning be approved for parcel #1, Exhibit "A", submitted September 26, 1958 to R4:Bh zoning district, subject to the following conditions: 1) Plans and specifications to be subject to Architectural and Site control. 2) If construction is not started within one year from the -2- date of rezonin9 of the property, it will revert to Ri:BD6. Commissioner Crisp seconded- The followin9 roll'call vote was recorded: Ayes, Anderson, Crisp, Higgins, Pasetta, Webster; Noes, Bennett. A-2 Rezontng Commissioner Crisp moved for adoption of Resolution PC-8-2A adopting the Report of Findings and recommending the pro- posed amendment to the City Council. Commissioner Pasetta seconded. Carried unanimously. V COMMITTEE REPORTS A. SUBDIVISION COMMITTEE SDR-gl 1. 'SDR 91 - H. E- Heldsmart H.E. Haldeman T~e Secretary read the conditions set by the County Building Site Approval Committee meeting of November 1958- Commissioner Crisp moved approval of the tentative map subject to the following conditions: I) Submit site improvement plan satisfactory to the County Health Dept. 2) Record of survey. 3) All lot drainage taken to creek in pipe, size of pipe cleared with Flood Control. 4) Improve access road to 18' minimum width (County minimum specifications) to Pierce Rd. ~) Flood Control fee of $1~0.00 Commissioner Pasetta seconded. Carried unanimously. 2. SDR-92 - S. Miller SDR-92 T~e Secretary read the conditions set by the Building S-Miller Site Approval Committee of the County of November 1958. Mr. Miller stated that he had no intention of ever making an entrance onto his property from Bohlman Rd. Commissioner Pasetta moved for approval or the tenta- tive map sub3ect to the rollowing conditions: 1] Flood Control fee of $15~-00 2) Provide erosion control.where hillside is scarfried for homesite. 3) Provide for any natural swales or slides that drain through property'. Carry all drainage to street or secure a letter from ad3ointng property owner. ~) Check with Flood Control for pipe size for any drive- ways crossing swales and draws. Commissioner Anderson seconded. Carried unanimously. B. ARCHITECTURAL AND SITE CONTROL COMMITTEE V-116 1. V-116 - Ralp~ Van Arsdale R. Van Arsdale The Secretary read the request rot a store butldin9 at 14515 Big Basin Way in the C1H district. The Cornmiss/on d~scussed the off-street parking proposed in the rear of the building. Mr. Van Arsdale, Mr. Kocher, the architect, and Mrs. Satlea, the proposed tenant of:.the building, spoke in favor of the parking in the rear of the building rather than fn the front. Commissioner Hlggins moved to refer the matter to the Planning Consultant for recommendation on this and similar cases that will appear in the future in this area so that a policy can be adopted as to parking in the rear on the front. There was no second to the motion. Mr. Van Arsdale offered a bond to the City to assure more fill being put in so that more parking would be available behind the buildin9 than that shown. Commissioner Pasetta moved for approval of the applica- tion for the plans submitted on December 1, 1958 with the condition that 5 off-street parking spaces be provided. ComaissionerAnderson seconded. Carried unanimously. Commissioner Webster left the meeting at this point. V-117 2. V-117 - Stern & Renzel Stern & Renzel The Secretary read a request for a permit for a bank building in the Quito Shoppin9 Center which is in a C-1H Zoning District. After a discussion among the Commissioners and Mr. Renzel of the status of the Building Site Approval application for this property. Commissioner Crisp moved for approval of the tentative map, SDR-96 Stern and Renzel, sub3ect to all the conditions ~et by the County Subdivision and Building Site Approval Committee at their meeting on December 11, 1958, and that the future property line'be 42' from the centerline of Cox Avenue. Commissioner Anderson seconded. Ayes, Anderson, Crisp, Bennett, Pasetta; not voting, Higgins. Commissioner Anderson moved for approval of the Archi- tectural and Site Control permit in accordance with the plans submitted on December 3, 1958. Commissioner Crisp seconded. Ayes, Anderson, Crisp, Bennett, Pasetta; not votin9, Higgins- V-118 3- V-118 - Electrical Products Co. Electrical Products The Secretary read the request for a permit to erect a Co. sign on the First National Bank of Saratoga-Cupertino on Big Basin Way. Mr. Clark,'representing the sign company, spoke in favor of the sign. The Commissioners discussed the other signs in the Village Center. Commissioner Anderson moved that the Chairman of the Architectural and Site Control Committee be directed to contact Mr. Held, architect for the bank, reOardtng the sign and report at the next Planning Commission meeting. Commissioner Crisp seconded. Carried unanimously. Meeting 2. Commissioner Anderson suggested that the meeting time be time changed to 7:00 P. M. instead of 7:30 P.M. All the Commisstoner~ present agreed upon this time. Chairman Bennett stated that Commissioners Tiffany and Webster should be consulted before any decision is made. Ord. # 3- Chairman Bennett referred the matter of non-conforming 3A-8,,non- conforminG sites in Ordinance 3A-8 to the subdivision committee sites for study. Commissioner Anderson moved for adjournment at 9:25 P.M. Commissioner Pasetta seconded. Carried unanimously. 1~ present, 2 Press.
