MINUTES Cemmissione~ Bennett .moved for 'th~ appreval of the minutes as distributed. Conunissioner Tiffany seconded. Carried unanimously. II PUBLIC HEARINGS A. VARIANCES 1. V-129 - R- J. Parden Vi129 The Secretary read the application fo~ a variance f~om a R.j. Parden required rear and side setback on Lot 101, Tract #1690. Mr. Parden spoke in favor of the variances. Commissioner Pasetta moved to 9rant the variances for a 20 rear yard and'an ~ side yard on the side adjacent to Ramsay Drive as shown on the Plans submitted February lO,.19~9- Commissioner Higgtns s~conded. Mr. Taxera spoke in favor of the variance. Commissioner Bennett moved that the requested variance in rear yard from 25' to 18½' be 9ranted for the residence located as shown on the plot plan on file. Commissioner Tiffany seconded. Carried unanimously. B. CH/LNGE OF ZONING C-18 1- C-16 - Harrison Gardiner'- 7:35 P.M. H.Gardtner The Secretary read the a~plia~tibn for a change o~ zoning -1- from A2:B4 to C2-H for a 3 acre parcel on the west SIde of HiGhway #9 adjacent and to the north of the S- P- Railroad property] · Chairman WebSter read a report from the Planning Consultant dated February 19, 1959 land stated further that the Land Use Poiicy Plan had not yet been adopted by the City Council. Mr- Copple,'San Jose Rea'l Estate man representing Mr. Oardiner, spoke in favor of the re-zoninG. There were no other comments from the audience. . Chairman Webster closed the Public Hearing at 7:58 P.M. CommissioHer Anderson moved to continue the matter until the next meeting for further study- Comaissioner Bennett seconded. Carried unanimously. Chairman Webster directe~ the Subdivision Comaittee to study the proposed re-zoning and have a report for the next regular meeting. III OLD BUSINESS 'A.' SUBDIVISION ORDINANCE Com~issiCner Pa~etta read a report dated February 2~., 1959 from Subdiv, Ord. the SubdivtsiSn Committee su99estin9 changes in the original draft of the ordinance, Chairman Webster directed that the original draft be corrected as suGgesied in the report and that the corrected copies be sent to the Director of Public Works and the Planning Consuliant for thei~ comments priq~ to th~ next meetinG~ the ordinance and - comments to be considered at the next Planning Commission meetin9 at which time a decision will be made ~oncerninG public hearinG on the proposed ordinance B, ACCESS ROADS R~s,pC-13 Chairman Aaderson of.thejinterim committee on access roads stated Access Roads that Resolution PC-13 passed,~y the PlanninG Commisslon at their last meeting should be pht in correc~ legal form before sending "A" to Rl:B2, RI:B2X, RI:B3 and RE:B4 for a 42-26 acre parcel adjacent and to the south o~ Tract #822 running from Saratoga Avenue through to Allendale Avenue. Commissioner Bennett moved that the Secretary be directed t6 set a date'for public hearing. Commissioner Pasetta seconded. Carried unanimously. Bank of had been submitted. Saratoga- Cupertino Mr. Neid, architect for the bank, spoke in favor of the new sign plan. Co~nisstoner Htggins moved that application be reconsidered. and approval be given 'to the sign plan submitted on February 19, 1959. Commissioner ~iffany seconded. C~rried unanimously. 2. Off Tract Subdivision sign plan Off-Tract Co~unission~r Higgins presented a drawing incorporating the 5ubdiv. Sign plan reqntrements for off-tract subdivision directional signs re- quested at the last Planning CommiSsion meetin9. Commissioner Bennett moved approval of the proposed off-tract directional sign plan including the specifications and that it be used as the standard for off-tract signs in Saratoga. Commissioner Pasetta moved that the City Council be requested Extension to provide an'extension telephone at the meetin9 place, to the City'Council. Commissioner Crisp moved that Resolution PC-13 be sent to the City Attorney for re-drafting and re-submitted to the Planning CommiSsion at its next regular meeting for approprlate"actfon. Commissi oner Anderson seconded. Cartted unanimously. C. SDR-103 - Carl Dimelf SDR-103 T~e Secretary read the c6nditions set by the Department of Public C.Dimeff Works at their meeting January 22, 1959 on th~ buildin9 sit~ and a letter dated February 16, 1959 f~om the Department of Public Works clarifyin~ condition #2, "Improve access road to minimum County standards", .. Commissioner Htggins moved. for approval of the building site application subject to the following conditions: -- 1. Comply with Flood Contro~ requirements 6n Bainter Creek. 2. Flood Contro£ fee of $150.00 per lot. 3- Record of survey. Commissioner Crisp seconded. The following roll ~all vote was recorded: Ayes½ Cri~p, Higgins, Pasetta, Tiffany, Webster. C-19 -'A- Carteta et al C-19 A.Carreia The Secretary read the request for a change of zoning from et al -' RE:B~ to C-I~H and C-2-H for six parcels of property lyin9 on the west side of Highway #9 from ProSpect Road to the S. P. Railroad property.: Commissioner Bennett moved that the Secretary be directed to set the date for public hearing. Commissioner Crisp seconded. Carried unanimously. 2. C-20 - George Day C-20 G.Day The Secretary ~ead the request for a change of zoning from -3- Fruitvale School. .Commissioner Tiffany seconded. Carried unanimously. 2- Mr.'Bogart, Wardell Rd., stated that the station name "Azule" S.P. Rail- road station has been cha~ged to "Blue Hills" at the S- P- Railroad crossing on Highvjay #9 in the City of Saratoga- No action was taken by the Planning Commission. Commissioner Crisp moved for ad~ourmment at 9:20 P.M. Commis- sioner Tiffany seconded.
