Commissi6ner Bennett moved .for approval 6f the minutes as dis- trtbuted. Commissioner Tiffany seconded. Carried unanimously. PUBLIC 'F_ARINGS A. VARIANCES 1. V-131 - R- Henwood V-131 The Secretary read the application for a variance from Ord- R.Henwood 3-A-8 - to divide 1.989 9ross acre parcel on the east side of Ouito Road approximately 238~ south of Bicknell Rd. into two sites. Mr. Henwood spoke in favor of the variance- Commissioner Bennett moved to grant the requast for the variance subject to the followin9 conditions: 1) Entire area to be divided into two equal portions. 2) Survey map of such division to be filed with the City of Saratoga. Commissioner Paset~a seconded. Carried unanimously. The Chairman declared the.Public Hearings closed at 7:30 P.M. The City Administrator suggested: studying 12,500 sq. ft. minimum lot size to conform to the Land Use and Circulation,Policy. Commissioner Crisp moved that the Chairman appoint a com~ittee to -1- study and prepare a recommendation to submit to the Council for amendment to Ordinance 3-A-8 to carry ou~ 12,500 sq. ft. minimum lot size already approved by the Council. Comjnissioner Anderson Seconded. Carried unanimously. Chairman Webster appointed the'Subdivision Committee and Commissioner Higgins, doF~issioner Crisp to.be Chairman, to study the matter and prepare a report.for the next meetin9· IV OLD BUSI}ESS A. ACCESS ROAD RESOLUTION Access Commissioner Anderson reported that a redraft of Resolution Road Res. PC-i'3, drawn by Assistant City Attorney Clark had been presented PC-13 to him tonight. Chairman Webster referred the Resolution to the interim coramit- tee on ac'~ess roads for a ~eport at the next regular meeting. B. SUBDIVISION ORDIN/~NCE Subdiv. Commissioner P~setta stated. that the proposed Subdivision Ordi- Ord. " nance had been 'sent to the Planning Consultant and the Director of Public Works but recommendations from them have not been 'received y~t. Chairman Webster ordered t~e matter continued to the first '- .... reguiar:.m~eting in April. C. .SWII~ING PCXjL ORDINANCE Sw.im~in9 The Secretary read a letter dated March 6, 1959 from the City Pool Ord. Administrator stating that the City Council on their meetin9 on March ~., 1959 had recommended that the Plannin9 Commission take action on a Swimming Pool Ordinance. Chairman Webster referred ~he matter to the Subdivision Commit- tee for s~udy. D. C-18 - Harrison Gardiner C-18 The Secretary, read the minu.tes of the Planning Comaission meeting H.Gardiner of F~bruary 24, 1959 in which the Chairman had dtreated the Subdivision Committee to study the proposed rezoning from A2:B4 -2- to C-2H for a three acre parcel on the west side of Highway #9 adjacent to and to the north of the S. P. Railroad tracks and have a report at the next regular meeting. Commissioner Pasetta stated that the Subdivision Com~ittee had ~tudied the matter and recommends that the spplication be denied and that the Planning Consultant be directed to prepare speci- fications for Planned Comm~r'cial along Highway #9- Commissioner Pasetta moved that the Chairman of"the Planning Commission be directed to ~rrange with the Planning ~onsultant to prepare a draft of an amendment to Ordinance 3-A to set up specifications for Planned Commercial area between the railroad tracks and Prospect'Avenue 'on'Highway #9. Commissioner Bennett seconded. Carri.~d unanimously. Commissioner Pasetta moved that the application of Harrison Gardiner for ~e-zoning of land on Highway #9 - C-19 be denied. V-132 - Lyle'Benson,'Saratoga Inn V-132 Lyle The Secretary read th& application for Architectural & Site Benson Saratoga Control Permit for the addition of a po~ch and office space Inn and a new sign and gate at the Saratoga Inn. Commissioner Higgins move~..for ~pproval of the Architectural and Site Control Permit for the sign and gate as sho~m on Exhibit "A" on fi~e. Conm~tssioner Bennett seconded. Carried unanimoualy. Chairman Webster d~rected that the other matters requested be'.held over until the next regular meeting in order that Mr. Benson can submit'~od]~lcations of Exhibit "B". Mr. Benson stated that.this w~s sattsfa6tory with'him. 2. SS-10 - Moser-Long Agency SS-lO Moser-Long The Secretary read the'application for an on-tract subdivision Agency advertisin~ sign on Canyon View Drive, Lot 8, Wildwood -j- Heights subdivision. Commissioner Hi~gins moved approval of the permit subject ~o the following conditio~s: l) Sign to be as per plan ~ubmitted. 2i Compliance with Ordinance 3A-lO. Commissioner T~ffany s~conded. Carried unanimously. B, SUBDIVISION COI~]ITTEE 1. 'V-lOT - R. Babcock, .1 site on Farwell Ave. The Secretary read the conditions as set by the Dept- of V-lOT Public Works at their m~eting of February 26, 19~9 and a R.Babcock letter from the Health Deptj.dated March 5, 1959. Commissioner Pasetta mo~ed approval of the tentative map subject to the. following conditions: l) $150-00 Flood Control Fee. 2) Replace ~xisting septf~ tank system on Parcel B subject to approval of County Health Dept. 3) Set back house at least 55 fe~t from center line of Farwell. li-) Provide Record of Survey Commissioner Anderson s'econded. The following vote was recorded: Ayes: Anderson, Crisp, Htggins, Pasetta, Tiffany, Webster. Abstaining: Bennett. 2. V-10B - E. T. Stafford, I site on Woodside Drive V-lOS The Secretary read the conditions {s set by'the Dept. of E.T.Stafford Works on February 26, 19~9. Commissioner Bennett moXed that the application be held over until the next regular meeting at which time the applicant should submit an ownership map of the entire parcel to Prospect Rd., and condition #3 pertaining to Flood Control fee be clarified. Commissioner Higgins seconded. Carried unanimously. 3- V-lOS - Kosich Const. Co., 63 lots, La SaratOga. Park. V-lOS Kostch The Secretary read the 'conditions as set by the Dept. of Const. Co. Public Works at ~heir meeting on February 5, 195~- Com~issfoner Pasetta read a letter from the Planning Con- sultant dated March ~, '1959 regarding'this tentative map. Commissi~ner Pasetta moved for approval of the tehtative map subject to the following conditions: 1) Complete improvement plans and specifications to be approved by the County Engineering Dept. before recording 'of final map. '2) Orade lots to drain into streets in a manner acceptable to the Engineering D~pt. 3)Provide 1 foot reservations. ~treets to be paved. with a minimum of 2½" plant mix' surfacing on a minimum of 6" base material. Actual thickness requirements to be determined by County Engineer. 5) The developer must provide satisfactory sterm drainage facilities as required by the Engineering Dept. 6) Provide: 1. Concrete vertical curbs, gutters, and ~oncret~ driveway approaches. 7) Desigh of the geometric sections and other construction of all proppsed and. existing streets shall conform to the prevailing standards of the ~ngineering Dept. In cases of critical topography, special requirements may be imposed b~ the Engiheering Dept. for street construction, driveway design, lot grading, etc. 8) Final'map not to be recorded until (a) adequate. sanitary sewer bond is p~sted (b) plans and specifications for sanitary sewers are approved'by Sanitation Dist.'#~- 9) No occupancy of otherwise completed houses permitted until (a) usable sanitary sewer is available (b) public water ~ystem approved by Health Dept. is available. Commissioner Higgins moved approval of the proposed site with the recommendation that consideratjon be given to the location of buildings at the most westerly part of the parcel due to the proposed expressway on the east. Radius of right-of-way on cul de sac to be 4.2 feet. ll) Consult County Engineer prior to construction of entrance structures. 12) Subdivision shall provide adequate street lighting ease- ~ents as required by P. G. & E. 13) Obtain clearance from Flood Control before submitting ~mprovement plans. Dedicat~ and improWe extension of Radoyka Drive for ~tstance of approximatel~ 200' to boundary'to property adjoining on the north; right of way to be 50'; improve- ments to be to standards set forth in foregoing conditions. Campbell Union The Secretary read a letter from Campbell Union School Dist. School Dist. re School received on February 9,.19~9.requ~stin~ approval of the' site. Planning Commission of a proposed school site on ~obey Rd., ~t the s~uthern end of Marilyn Ave. Chairman Webster read a report of the Planning Consultant dated February 27, 1959- Commissioner Anderson stated that he and Councilman Rosasco- had met with Mr. Henley to apprise him of the following facts: -6- l) The site is not consistent with the Land Use and Circu- lation Policy. 2) The low density of the area 1 acre zoning - on the west side of Quito Rd. The east side 6f Quito Rd. bein9 area' a high density/will probably develop more rapidly. 3) The hazard for children crossing Quito Rd. from the east., as it is proposed to be a four lane highway. Mr. Henley and Mr. Bradley.from the Campbell School District both spoke in favor of th~ proposed site. ---~' Commissioner Tiffany mooed for approval.of the suggested school site. ComMissioner Higgins seconded. The following roll call vote was recorded: Ayes: Higgins, Tiffany. - Noes: Anderson, Bennett, Crisp, Pasetta. Abstaining: Webster. The motion'was defeated. Commissioner Bennett moved that the Planning Commission Chairman send a reply to the Campbell School District stating the Planning Commission disapproval 9f'the prSposed site, stating the reasons therefor and offering to meet with representatives of the school district to endeavor to work out mutually acceptable solution. Commissioner Pasetta seconded. Carried unanimously. Chairman Webster appointed the following committee: Crisp, Chairman, Anderson and Tiffany, to meet with the Planning Committee of the Council on this matter. 2. Moreland School The Secretary read a letter from the Moreland School'Dist., Dist. re Proposed requesting approval of ~he Planning Commission of a ~oposed school site. school site #16 adjacent and to the north of the proposed extension of'La Saratoga Park subdivision. Chairman Webster read a letter from the Planning Consultant dated Mar~h 3, 1959.
