A-4 - Sacred Heart Parish Sacred Heart Chairman Webster ordered that this matter be held over until Parish later in the meeting after the building site approval appli- cation for this property is handled. 'A-5 2. A-5 - Paul A. Jackson P.A. jackson The Secretary read the application for "The Cottage". Mr. Paul Jackson spoke in favor of the signs. Commissioner Bennett moved for denial of the application. Com- missioner Anderson seconded- Carried unanimously. B. SUBDIVISION AND BUILDING SITE APPROVAL SDR-121 1- SDR-121 - A. Mtrassou A.Mtra- ssou T~e Secretary read the conditions set by the County techni- cians dated July 8, 1959- Mr. Palm, adjacent property o~mer, and Mr. Heid, a~chitect for the applicant, answered questions as to the right of way. Commissioner Bennett moved for approval subject to the fol- lowing conditions: 1. Storm waters fee of $150.00. -1- 2- Install 18t wide double seal coat of oil and screen- lngs surface, utilizing base rock, on Kittredge Rd., from end of the existing improvement to the north end of the. 30' right of way. on this property. 3. Submit a road improvement bond of $4,500.00- 4. Record of Survey.' Commissioner Anderson seconded. Carried unanimously. 2- SDR-126 - E- W. Hotton SDR-126 E-W.Horton The Secretary read a letter from R- Neeman asking for a con- tinuance to the July 27th meeting. Chairman Webster ordered the matter continued until the next regular meeting. 3. SDR-128 - L. W. Curtis SDR-128 L-W-Curtis The Secretary read the County Technicians conditions dated 6/25/59 and a letter from Mr. Richard 6. Martin dated July 12, 1959- Commissioner Pasetta moved for approval of the tentative map subject'to the following conditions: 1. Storm waters fee of $150.00 per lot. 2. Construct otl and screenings road, 18' wide from point where two 9' access roads converge at Pike to driveways. 3. Construct concrete or asphalt 9utter for full length of driveway. 4.Put in culvert as required at the end of driveway. 5-Provide erosion control on hillside cut along driveway. 6. Driveway to be graded to provide for no more than a i5% maximum grade. CommissionerAnderson seconded. Carried unanimously. 4. SD-129 - Western Homes SD~129 Western The Secretary read a letter from George S. Nolte, engineer HOmes for the applicant, dated July 7, 1959, requesting withdrawal of the tentative map- · Commissioner Pasetta moved for disapproval of the tentative -2- map without prejudice. Commissioner Pasetta moved for approval of the tentative map subject to the conditions read and the setting of the sani- tary'sewer bond at $250.00. Commissioner Anderson seconded. Walpern SDR-131 W.Walpern The Secretary'read the conditions as set by the County Technicians dated 6/25/59. Mr. Robert Morris, prospective purchase~, spoke in favor of the site. Commissioner Pasetta moved for approval of the tentative map sub3ect to the following conditions: 1.' Connect to sanitary sewers 2- Grade front portion of lot to street 3. Construct oil and screenings surface 18' width from Quito Rd., to driveway along Souse Lane sub3ect to approval of City Engineer. 4. Set house back 41~ from center line to provide for future street widening. 5.Record of Survey. 6.Storm waters fee of.$150.00. 7.No.trees to be removed at beginning of Souse Lane. Commissioner Anderson seconded. Carried unanimously. 7. SDR-132 - F. Luksetich SDR-13a The Secretary read the County Technicians conditions dated F.Luksetich 6/25/59. Commissioner Pasetta moved for approval of the tentative map subject to th~ following conditions: 1. Health Dept. requires a minimum of 10,000 sq.ft. lot area. 2. Set houae ~5 feet from center line of Verde Vista to allow for future widening to 20t half street. 3.Record of survey Storm waters fee of $150.00 5. Construct 18' of oil and screenings surface on Verde Vista from Highway 9.to driveway. Commissioner Anderson seconded. Carried unanimously. 8. SDR-133 - P. B. Meier 5DR-133' P-B.Meter The Secretary read the County Technicians recommendation dated July 8, 1959. Mr- Norman O'Connor, representing both the buyer and the seller, spoke in favor of the site. Chairman Webster ordered the matter continued to the next regular meeting in order that Mr. O'Connor could check further with the Health Dept. fo~ the applicant. 9. SDR-134 - D. Zabelle SDR-134 D.Zabelle The Secretary read the County Technicians conditions dated July 8, 1959. Mr. Zahelle asked a~ ut the 18' pavement width. Commissioner Anderson moved for approval of the tentative map subject to the following conditions: 1. Storm waters fee of $150.00 per lot 2- Record of Survey 3. Grade building sites to drain to Pike Road. 4. Widen the existing 10, wide surfacing on Pike Road to fS' with seal coat of oil and screenings from the end of the existing improvement near the mail boxes of Jensen, Mathews and Yatsko to the most easterly driveway of this property (to~al distance about 600 feet). 5-Submit a road improvement bond of $2,500.00. 6. Submit offer of dedication of l0 feet for future widen- ing of Pike Road to 40 feet. Commissioner Pasetta seconded. Carried unanimously SDR-136 11. SDR-136 - Sacred Heart Parish Sacred Heart The Secretary read the ~ounty Technicians condi[ions dated Parish July 10, 1959. Mr. French, architect for the church,and Father Oeary spoke in favor of the church. Commissioner Pasetta stated that he felt a 60' right of way ~ms sufficient for Sarat?ga Avenue at this location. Chairman Webster stated that he felt that any widening of Saratoga Avenue, when it becomes necessary, should be at the expense of the applicant rather than of the City. Commissioner Crisp moved for approval of the tentative map subject to the following.conditions: 1. ReCord of Survey 2. All drainage to be taken to creek. -5- 3- Submit site development plans for approval. Dedication of 30' right of way along southerly boundary {o Flood Control District for the future improvement and maintenance of Wiidcat Creek. 5. Dedicate for ~5~' half street.on Saratoga Ave., no improve- ments necessary except acceleration and deceleration lanes. · Commissioner Bennett seconded. Commissioner Bennett moved for approval of the tentative map sub3ect to the following conditions: 1. Connect to sanitary sewers. 2. Improve EXva Ave., on the uphill side from the bldG- site to the intersection at Canyon View to an eleven foot · ' width, inciuding a 2 ft. plant mix gutter, centerline of existing travelled way to be considered centerline of future construction. 3. Sacred Heart Mr. Don French spoke of the number of barking places provided. Parish, Cont. Commissioner Pasetta moved for approval of the Architectural and ~ite Control Permit sub3ect to the follow]n[.conditions: 1. All parking to be off-street and to conform to the off- street parking ordinance- 2.Garage to be 10t from rector~. Commissioner Crisp seconded. Carried unanimously.' III PUBLIC HEARINGS 'A. VARIANCES V-154 1- 'V-154 - H. L. Lurid - 10:15 P. ~. H.L.Lund Commissioner Tiffany left the meeting because of illness. The Secretary read the application for a variance in lot size. Mr. H. L. Lund spoke in favor of the variance- The Secretary read letters in the file from Mr. A. L. Fletcher, 21241 Canyon View Drive; Mr. C- Prentice Androws, 2i250 Canyon'View Drive; 'and Mr'. C. L.' Taggart, 2124101enmont Drive, objecting to the variance. dommissioner B~nnett moved for denial of the variance appli- cation. Commissioner Anderson seconded. Carried unanimously. B. USE PEI~IITS UP-2 1. UP-2 - L. A. Boutdot - 10:40 P- M. L-A.B6hrdet The Secretary read the application for a use permit for a home'occupation. Commissioner Pasetta moved for approval of the use permit application subaect to the following conditions: I. Use to be conducted as outlined in letter of application. 2- Use Permit to be valid until July 13, 1960. 3. Filing fee will be waived if applicant asks for renewal at end of year. Commissioner Bennett seconded- Carried unanimously. UP-3 2. UP-3 - St. Nicholas Orthodox Church - 10:55 P. M. St.Nicholas Orothodox The Secretary read the applicatio~ for a Sunday' school and Church social hail on Elva Avende at the present location of the church- No one spoke from the audience, either for or against the use permit. Commissioner Bennett moved for approval of the use permit. Commissioner Pasetta seconded. Carried unanimously. -7- C. CHANGE OF ZONING C-21 1. C-21 - Al~ha Land Co. - 11:00 P. M- Alpha Land Co. Chairman Webster read a letter'from the Planning Consultant dated July 1, 1959. Mr. Griffin, Dick Schllltn9, and Robert More, Real Estate, all representin9 Alpha Land Co. spoke in favor of the re- zoning- Chairman Webster ordered the Public Hearing closed. Commissio~er Bennett moved fo~ denial of the application for rezoning. Commisstoner{Raset.t'a seconded. Carried unanimously. IV CHANGE OF ZONING APPLICATIONS A. C-23'- Norvel Thompson C-23 N. The Secretary read the application for rezoning from Rl:B2 to Thompson C-1-H of a -852 acre parcel on the south side of Fourth Avenue 150twest of Big Basin Way. Commissioner Pasetta moved that the Secretary be directed to set a dat~ for public hearing. Commissioner Bennett seconded. Car- Pied unanimously. V OLD BUSINESS 'A.' CUPERTINO SCHOOL SITE ~uper- tlno Chairman Webster read a report from the PlanninG'Consultant dated School Site July 6, 1~59 on the Galeb school site. Commissioner Anderson r'ead a report of the committee on the pro- posed site. -. Commissioner Anderson moved that the Secretary be'directed to write a letter to Mr- Nethery, Cupertino School District, in accord with the report just read and enclostn9 copies of the Plannin9 Consultant's report to the City dated June 19, 1959 and and July 6, 1959- Commissioner Bennett seconded. Carried unani- mously. B. SARATOC~AGENERAL PLAN Saratoga General- The Secretary distributed Progress Report No- I dated July 2, P'lan 1959, from the Planning Consultant. C. TREE ORDINANCE Tree After a'brief discussion as to the necessity of a street tree Ord. -. ordinance ~t this time, Chairman Webster referred the proposed ordinance to the subdivision committee for a written report at the next regular meeting. VI PETITIONS AND GRIEVANCES A. ~ITTEN S.C.Co. 1. Santa Clara County Planni~9 Commission P1. Commission The Secretary read a letter dated July 13, 1959 from the Santa Clara County Planning Commission regarding a proposed subdivision at the southeast boundary of the Cfty. Commissioner Bennett moved for referral of the matter to the subdivision committee for review and report at the next regular meeting. Commissioner Crisp seconded. Carried unanimously. B. ORAL 1. Mr. John Rodrigues, Saratoga Hills Road, asked for clarifi~ation SDR-68 of Condition #2 in a letterffrom the PlanninG Commission dated Je Rodriques June 12, 1958 regarding SDR-68.. Commissioner Bennett moved for approval of the interpretation of "driveway access" to mean "the entrance from the property to Saratoga Hills Ra." Commissioner Pasetta seconded. Carried unanimously. 2- The Secretary stated that permanent zoning for Annexation 1957-2 Annex- atton was still being studied. 'The Planntng Consultant has submitted 1957-2 a proposed list ~f specifications for a Planned Commercial Zone which has been distributed to the Planning Commissioners.
