ROLL CALL Present: Anderson, Bennett, Crisp, Tiffany Absent: Hi~,ins _ ~g , Webste~ B. ~:iINUTES Commissioner Bennett moved' for approval of the minutes as distributed and read, Commissioner Crisp seconded. Carried unanimously. Commissioner Tiffany moved that Commissioner Anderson act as Temporary Chairman, Commissioner Bennett seconded. Carried unanimously. II COI.~iITTEE REPORTS A. ARCHITECTURAL AI~ SiTE CONTROL A-7 1. A-7 - Argonadir Shopping Center (continued) Argonau~ Shopping Chairman Anderson read the Planning Consultant's report Center dated October 2, 1959, and suggested that the plans be referred to the Architectural and Site Control Com- mittee for consultation with D.%r. Ladarc, the developer, and his Architect. Com_missioner Bennett was appointed acting Chairman.of this committee to replace Commissioner Riggins because of the conflict of interest. Commissioner Bennett was authorized to call upon as many other members of the Commission as needed to make up a three man co~aittee. B. SUBDIVISION AND BUILDING SITE APPROVAL SD-144 1. SD-144 - S. S. Willjams (continued) Willjams The Secretary stated that no revised tentative map had yet been i'iled on this subdivision. Mr. Shelley Willjams stated that he wished the matter continued. Chairman Anderson ordered the matter continued to the next regular meeting. SDR-!~i 2. SD!~-iS1 - John D. Claborn J.D.C].aborn Chairman Anderson read a letter i'rom John D. Claborn dated October l, 1959 and a letter from the County Engineers dated October 8, 1959 regardkng condition ~2 set by the Planning Commission'on September 28, 1959~ After discussion '6etween the Co~mdssioners and Mr. Claborn, Commissioner Crisp moved that Condition No. 2 set on September 28, 1959 be deleted and that the following two conditiohs be substituted therefor: l) direct access to Pierce Road as shown on plot plan submitted October 2, 1959 is approved in accordance with requirements of City Engineer. 2) Provide bond to assure changing driveway access to the 60 foot future street right of way when con- structed and dedicate~ to public travel. Co~issioner Bennett seconded. Carried unanimously. C. VARIANCE COi~!ITTEE V-156 1. V-156 - John M. Zane (continued) ~ohn Zane The Secretary read a letter dated September 29, 1959 from ~r. and Mrs. H. Jones stating that they would not sell any additional land to John Zane. Commissioner Crisp read a report of the Variance Com- mittee dated October 9, 1959. At 7:48 P- N. Comm, issioner Webster arrived at the meeting and took the Chair. Con~nissioner Crisp moved for granting approval to the Variance application, Commissioner Tif'fany seconded. Carried unanimously. UP-~ 2. UP-~ - Saratoga Swim~ming Club Saratoga Swimruling Commissioner Anderson read the report of the Variance Club Committee dated October 6, 1959. Chairman Webster presented some suggested changes to the conditions listed in the report. After a discussion amongst the Commissioners, the rollowing ~onditions were agreed upon: (a} ORGANIZATION It is understood that the Club, at present, is organized in accordance with the laws of the State of California applying to Non-Profit Corporations. If not the Club shall be so organized. A copy of the legal documents setting up t~lis Corporation, including all present and future amendments,. shall be furnished for the files of the Planning Commission. (b) r~]EMBERSHiP The membership shall not exceed 75 families with- out the further approval of the Planning Commission, (c) ~OURS OF OPERATION The hours of operation shall be limited to from 7:00 A, M, to one hour after sunset except that a reasonable n~um. ber of social events may be conducted after these hours where approved by tke Board of Directors, (d) PARKING AND DRAINAGE Adequate drainage and off street parking facilities shall be provided as approved by the Planning Commission, Club members and their guests.shall park their vehicles only within the fenced area of the Club~s premises while attending Club functions, (e) ~ENCING The area of the Club shall be adequately fenced and provided with entrance and exit gate or gates · ~ich shall be looked before and after hours of 'operation, (f) LIGHTING Adeeuate lighting shall be provided as approved by the Pfanning Commission, It is felt that the Club should be well lighted during operation at night and sufficiently lighted after operating hours to discourage trespassing, .(g) RULES AND REGULATIONS The Club shall adopt rules and regulations for its operation including, but not restricted to, those essential for control of the swinming pool, general ~ctivities, safety, health, guests and noise. A copy of these rules and regulations, including all present and future amendments, ~hatl be filed with the Planning Conmission. (h) ARCI!ITECTURAL AND SITE COi~ROL All plans and layouts shall be submitted to the Planning Commission for approval including plans for parking, drainage, fencing and lighting. K (i) ACTIVITIES The present activities of the Saratoga Swimming Club shall not be further expanded without. the modification of this use permit. (j) TZM~ L~IITATIOM This use pemit will be void unless the condi- tions are complied.with before June 1, 1960. Chairman Webster read Resolution UP-~-I incorporating above conditions. Commissioner Bennett moved that Resolution UP-~-i be adopted, Commissio'ner Anderson seconded. Carried unanimously. Mr. Brenchley, Bella Vista Avenue, stated his opposition to the issuance of a use permit. III PUBLIC !lEARINGS None IV OLD BUSINESS C-24 A. CHANGE OF ZONING ;anoff 1. C-24 - N. Sanoff Mr. Denney, representative of the Applicant, and the Commissioners discussed the Planning Consultant's report. Commissioner Crisp moved for approval of C-l-H re- zoning for the 55' by 150 foot parcel as requested and denial of the rezoning to R-4 of the llO' by 150~ parcel. -4-- Commissioner Tiffany seconded. The following.roll call vote wa~ recorded: Ayes: Anderson, Crisp, Tiffany Noes: Bennett, Webster Chairman Webster moved that the application be granted as requested. Commissioner Bennett seconded.. COI.B~RCIAL SERVICE ZONING REPORT 3ommercial Service The Secretary distributed the Commercial Service Zoning Zoning Ord. . Qrdinance,.rewritte~ as.directe~ by the Planning Consultant. Chairman Webster dire6ted the Secretary to contact the Planning Consultant t6 see if the zoning district boundaries could be ready at the time'of the study session meeting on Monday, October 19, 1959. Commissioner Anderson moved that the Secretary be directed to set a date for'public hearing for both the Commercial Service Zoning Ordinance and 'the Con~ercial Service Zoning District Boundaries, Commissioner Crisp seconded. Carried unanimously. V PETITIONS AND GRIEVANCES A. WRITTEN None B. ORAL General 1. The Secretary announced that there would be a study Plan session on Monday, October 19, 1959 with the Planning Consultant at Fruitvale School, Fruitvale Avenue, on the Saratoga General Plan, and distributed the fourth progress report. -5- B.SoA. 2. The Director of Public Works presented a map of Civic Senter the Civic Center 8i~e for Building Site Approval and Site read a list of suggested conditions from the County Technicians. Commissioner Bennett moved for approval of the tentative map subject to the conditions read, Commissioner Crisp seconded. Carried unanimously. Co~nissioner Anderson moved fox. adjournment at 10:15 P.
