MINUTES Commissioner Crisp moved for approval of the minutes as written and distributed to the Commissioners. Commiss- ioner Higgins seconded. Carried unanimously. A-9 - Kochers A-9 After brief discussion among the Commissioners, this Kochera matter was continued to later on the agenda, when the applican~ might be present. 2. A-10 - V. E. Harkins A-IO-V.E. The Commissioners discussed the present sign with HaPkins the applicant. Chairman Webster referred the matter to the Archi- tectural and Site Control Committee for report and recommendation at the next regular meeting. 3. A-11 - Electrical Products Corporation A-11-Elec. Mr. Haskit, of Electrical Products Corporation, and Prod.Corp. Mr, Scoville, First National Bank of Saratoga-Cuper- tino, spoke in'favor of the application. SDR-I~6 - W..Seagraves SDR-146- COmmissioner Anderson read the report of the W.Seagraves Subdivision Committee, dated December 14, 19~9. Maurice Rankin, attorney for Mr. Seagraves, dis- cussed the conditions with the Commissioners. Commissioner Crisp moved for approval of the tentative map subject to the conditions read and changins conditions 2, ~ and ~ to read as follows: 2. III PUBLICF=~ARINGS A. USE PERMITS 1. UP-9 - E. Mancini - Toyan Lodge - 8:10 P.M. UP-9 The Secretary read the application ~or a Use Mancini Permit for a hotel in an R-E Zoning District. The City Clerk explained the necessity for a Use Permit, since Section 30 of the County Zon- tn9 Ordinance was not adopted by the City. - 2 UP-9 (Con.) UP-10 - San Jose Water Works-Saratoga Hills Rd. 8:22 P.M. UP-10 Mr. Norman Andrews, representing San Jose Water S.j.WaterWks. Works, spoke in favor of the Use Permit Applica- tion and stated that a second tank for additional capacity is absolutely essential to serve the future needs of SaratoGa. Chairman Webster ordered the public hearing closed at 8:51 P.M. R.j.Parden At this time Chairman Webster appointed Robert J. Parden to be the third regular member of the Sub- division Committee. 3. UP-11 - San jose Water Works - 8:51 P.M. UP-11 Mr- Norman Andtawss San Jose Wat&r Works and S.j.Water Wks Frank Druding, 12775 Saratoga Creek Drive, spoke in favor of the Use Permit. Mr. Richard Scott, 1912~ Cox Avenue, spoke in opposition. -3 UP-11 (Con.) Commissioner Anderson moved that the Use Permit S.j.Water Wks be approved. Commissioner Crisp seconded. Carried unanimously. 4. UP-12 - San Jose Water Works - 9:10 P.M- UP-12 Mr. Norman Andrews, San Jose Water Works, spoke S.J.Water Wks. in favor of the application. Mr. William P. Kirkham, 12780 Saratoga Creek Drive, spoke in favor of having this Public Utility installation completed as the other, UP-11, had already been. Chairman Webster ordered the public hearings on UP-11 and UP-12 closed st 9:14 P.M. Commissioner Anderson moved for approval of the USe P~rmit, subject to the following conditions: 1. Fencin~ to conform with the fences on the adjacent property. 2.Grass between the fence and the street. 3. Appropriate landscaping. Commissioner Crisp seconded. Carried unanimously. B. ZONINGREGULATIONS - Commercial Service - 9:32 P.M. Comm. Mr. B. T. Oaleb, ZorkaAvenue, questioned the Service boundaries of the proposed C-S District. Chair- man Webster explained that this would be brought up at a separate public hearing. Chairman Webster continued the public hearing to the first regular meetin~ in January and referred the matter to the Subdivision Committee for clarification of details and report at that time. O,Donnell, Bertholf SDR-16~, dated December 8, 1959. Mr.'Bertholf spoke from the floor concurring with the opinion of OIDonnell. Commissioner Anderson read the report of the Director of Public Works, dated December 10, 1959, and ~he recommendation of the Subdivision Committee, dated November 20, 1959. Commissioner Anderson moved for approval of the ten- tative map, subject to the conditions read, with the deletion of condition No. 8, regarding the removal of the private bridge. Commissioner Crisp seconded. Carried unanimously. 6. SDR-164 ~ J. R. O~Donnell SDR-164 .Commissioner Anderson explained that this was an ad- O~Donnell -. jotnin9 site to the SDR-155, just approved, and papers read were identical in both files. Mr. O~Donnell stated his agreement to the conditions. CommiSSioner Anderson moved for the approval of the conditions as previously read, with the deletion of condition No. 8, regardln9 the removal of the private bridge. Commissioner Crisp seconded. Carried unani- mously. 4' SD-158 - O. C. COx SD-158 Secretary read a letter from Mr. Henry D. Gilbert, Cox Mark Thomas & Co., representin9 Mr. Cox~ dated Decem- ber IS, 1959, asking that action be deferred until February 8, 1960. Chaffman Webster ordered the matter continued st the request of the applicant to the regular Planning Commission Meeting on February 8, 1960. -5- SDR-161 - Toyon Lodge SDR-161 Chairman Webster ordered the matter referred to the Toyon Subdivisiod Committee for report, in conjunction with the Use PermitAppli6ation, at the next regular meet- ing. 6. SDR-162 - D. Davis SDR-162 Commissioner Anderson read the report of the Direc- Davis tot of Public Works, dated December lO, 1959, and the Subdivision Committee recommendation, dated December 14, 195~. Mr. Gilbert, Mark Thomas & Co., indicated approval of the conditions. Commissioner Anderson moved for approval of the ten- tative map, subject to the conditions read. Commiss- ioner Higgins seconded. Carried unanimously. 7. SDR-163 - Western Hills Development Co. SDR-163 C6mmisstoner Anderson read the recommendation of the West.Hills Subdivision Committee, dated December 14, 1959. Mr. Orval B. Stanger, representing Western Hills De- velopment Co. and Weaver Realty, discussed the con- ditions with the Commissioners. Commissioner Anderson moved for approval of the ten- tative map, subject to the thirteen conditions read. Commissioner Crisp seconded. Carried unanimously. 9. SDR-165 - H. C. Turner SDR-165 COmmissioner Anderson suggested that this matter be Turner continued, so that the conditions can be discussed by the Subdivision Committee with Mr. Turner, his engineers, the City technicians and possibly adjac- ent land owners. Chairman Webster referred the matter to the Subdivi- sion Committee for further study. 10. SDR-166 - R- W- Scott SDR-166 Commissioner Anderson read the recommendation of the Scott Subdivision Committee, dated December 11.~, 1999- Mr. Scott discussed the creek easement with the Commissioners. Commissioner Anderson moved for approval of the ten- tative map, subject to the conditions read. Commiss- ioner HtOgins seconded. Carried unanimously. 11. SDR-167 - R. J. La Mantia 5DR-167 Commissioner Anderson read the report of the Subdi- La M~ntta vision Committee, dated December 1~, 1999. Mr. La Mantia stated his'approval of the conditions. Commissioner Anderson moved for approval of the ten- tative map, subject to the conditions read. Commiss- ioner Crisp seconded. Carried unanimously. II A. Mr. Sam Hernandez spoke in favor of the application. Commissioner HiOgtns moved that the report of the Variance Committee be approved. Commissioner Tiffany seconded. Carried unanimously. Keller, representin9 the B~ookside Club, spoke Demerest in favor of the points raised in the letter'dated Dec- ember lO, 1959, from the Brookside Club, signed by the President, Charles Wallau. Mr. Frank Packard, i2534 Brook Glen Drive, spoke of his dissatisfaction With the Club to date and asked for a continuance. Mr. Flechner, 12660 Saratoga Creek Drive, asked for de- tails of the Use Permit. Chairman Webster ordered the review continued and stated that if the matters outlined in the letter are to be considered, that an application for a Use Permit mu~t be submitted by the Club. Requirements on Chairman Webster read the proposed resolution regardin9 Variances and Use Permits maps and drawings submitted for Buildin9 Site Approval, Variances and Use Permits.
