MINUTES Commissioner Parden moved that the minutes be corrected to read that Commissioner Higgins abstained from voting on the motion that ~rchitectural and Site Control Permit A-7 be granted to the Argonaut Shopping Center, and the minutes be accepted as read and corrected. Commissioner Anderson seconded. Carried unanimously.. II PUBLIC HEARINGS A.. VARIANCES 1. V-171 - W. H. Kelly (Cent.) 7:02 P. M. V-171 Kelly Chairman Pro-Tem Higgins ordered the hearing continued to the next regular meeting, since conditions had not been set on SD-205. III ~TTEI~S _REFERRED FOR REPORT A. R-1 Lot Size Revision R-1 Lot Size Commissioner Anderson gave a progress report on R-1 Lot Size Revi- Revision sion and stated that the Committee recommended continuance of the study until the General Plan Public Hearings had been concluded. Chairman Webster arrived at 7:08-P. M. Chairman Webster accepted the recommendation and requested a report from the Committee at the June 27, 1960 regular meeting. -1- II PUBLIC HEARINGS i. VARIANCES 2. V-172 - Leaonard Derrick (Cont.) 7:14 P.M. V-172 Detrick Mr. Howe, City Administrator, reported the City Attorney's opinion that Lot 56, Tract 2428 is a corner lot based on paving of intersection of Old Tree Way and the future street.. Mr. Derrick spoke in favor of the variance.. Chairman Webster closed the Public Hearing at 7:22 P.M. Commissioner Parden moved that the application for V-172 be denied. Commissioner Higgins seconded. Carried unanimously. 3. V-175 - Norman Tobias 7:.24 P.M. V-175 Tobias Mr. Tobias explained the variance application to the Com- missioners.. Commissioner Anderson read the application for a Variance. Chairman Webster closed the Public Hearing at 7:40 P. M. Commissioner Parden moved that V-175 be disapproved. Commis- sioner Bennett seconded. Carried unanimously. ItI MATTERS REFERRED FOR REPORT B. SARATOGA GENERAL PLAN 1. Setting Dates for Public Hearing General Plan Chairman Webster discussed various dates for public hearings. Pnblic Hearings Commissioner Bennett moved that Public Hearings on the Saratoga General Planbe held at 7:30 P- M. Monday June 6, 1960, and at 7:30 P. M. Monday June 20, 1960, at the Fruitvale School, Saratoga, California, and that the City Administrator be direct- ed to publish notice of these Public Hearings. Commissioner Higgins seconded. Carried unanimously. SDR-185 C.. SDR-185 - Bernard J. Vogel Vogel Chairman Webster read a letter dated May 19, 1960, containing the opinio~ of the Assistant City Attorney on the status of Vogel property. -2- COmmissioner Anderson moved that the Conditions of Tentative SDR-185 Vogel Building Site Approval granted April 25, 1960, be modified in accordance with Revised Exhibit "A" dated May 9, 1960. ARCHITECTURAL AND SITE CONTROL 1. SS-19 - George Day - Kentfield -SS-19 Day Commissioner Higgins gave the Architectural and Site Control Kentfield Committee report. George Day spoke in favor of the application. Commissioner Higgins moved that the permit be granted for On- Tract Subdivision Sign, double faced and perpendicular to Saratoga Avenue. Commissioner Parden seconded. Carried unanimously. B. SUBDIVISION AND BUILDING SITE APPROVALS 1. SD-191 - Gresham Construction Company SD-191 Gresham Commissioner And~son stated that a letter authorizing extension Const. Co. to J~ne 15~ 1960, is in the file. Chairman Webster ordered the matter continued to the June 1960 meeting. 2. SD~199 - Town and Country Realty SD-199 Town and Commissioner Anderson stated that a letter presented by the Country Realty developer, authorized an extension to June 13, 1960.. Chairman Webster ordered SD-199 continued to June 1D, 1960. D. SDR-20~ - T. E. Sewis SDR-20~ Lewis Commissioner Anderson called attention to the map presented with the application for Building Site Approval. -3- COmmissioner Anderson read the Subdivision Committee Report SDR-204 ~ewis dated May 20, 1960, and moved that SDR-204 be denied, since the lot does not conform to the intent of Ordinance 3-A-8. Dr. Sewis spoke about the problem of obtaining proper site width. 4. SD-205 - W. H. Kelly SD-205 Kelly Commissioner Anderson stated that conditions had not been set and a letter was in the file granting extension to June 13, 1960. Chairman Webster ordered SD-205 continued to the next regular meeting. 5. SD-206 - Marie Rose Gaspar SD-206 Gaspar Commissioner Anderson stated that conditions had not been set and a letter was in the file granting extension to June 13, 1960. Chairman Webster ordered SD-206 continued to the next regular meeting. 6. SDR-207 - Andre Bogart SDR-207 Bogart T~e Subdivision Committee Report dated May 20, 1960 was dis- tributed to the Commissioners and the Applicant. Commissioner Anderson moved that SDR-207 be approved subject to the 8 conditions listed on Exhibit "A", the report dated Hay 20, 1960. Commissioner Higgins seconded. Mr. Bogart discussed the conditions with the Commissioners. The following roll call vote was recorded. Commissioner Anderson moved that SDR-208 be approved subject to the 8 conditions listed on the Subdivision Committee Report dated May 20, 1960, Exhibit "A". Commissioner Parden seconded. H~. Rodriques discussed Condition No. 8 with the Commissioners.. The following roll call vote was recorded. Dias SDR-209 Dias C~mmissioner Anderson stated that no conditions had been received from the County Technicians.' Chairman Webster ordered SDR-209 continued to June 13, 1960. 9. SDR-210 - W. G. Kr~mmme SDR-210 KI~,mme The Subdivision Committee Report dated May 20, 1960, was dis~ tributed to the Commissioners and the applicant. Commissioner Anderson moved for approval of SDR-210 subject to the 15 conditions listed on the Subdivision Committee Report dated May 20, 1960. Commissioner Crisp seconded. FL~. SDR-211 lO. SDR-211 - M. W. Hawks Hawks Cbmmissioner Anderson stated that BDR-211 was filed too late for the City Engineer to act upon it. Chairman Webster ordered SDR-211 continued to June 13, 1960. ll. SDR-212 - Sorensen and Dumes SDR-212 Sorensen Commissioner Anderson stated that SDR-212 was filed too late & Dumes for the City Engineer to act upon it. Chairman Webster ordered SDR-212 continued to June 13, 1960. V PETITIONS AND GRIEVANCES A. WRITTEN 1. SDR-120 - W. C. Noeggerath SDR-120 Noeggerath The Secretary read a letter from Wolfgang Noeggerath, dated May lO, 1960, asking for extension of time on SDR-120 to comply with the conditions set by the Planning Commission. The Secretary read the Report dated May ll, 1959, listing the conditions under which Tentative Building Site Approval was granted at that time. Mr. Noeggerath spoke of the time required to comply with the conditions.. Commissioner Anderson moved that a three month extension be granted from the date of expiration of Tentative Building Site ApproVal on SDR-120. Commissioner Parden seconded. Carried unanimously. 2. SDR-19~ - Saratoga Post Office SDR~194 Saratoga Commissioner Anderson snmmarized a letter dated May 13, 1960, Post Office from the Regional Office of the Post Office Department, asking for reconsideration of Condition No. 3 of Tentative Building Site Approval. COmmissioner Anderson moved that Condition No. 3 be changed to read "Setback #5 feet from the centerline of Saratoga Avenue. Commissioner Crisp seconded. Carried unanimously. Bo ORAL 1. SDR-118 - Argonaut Shopping Center S~R-118 Argonaut Mr. Joseph Ladato asked for extension of Tentative Building Shopping Center Site Approval granted on May 27, 1959- Commissioner Bennett moved that a three month extension be grante~ from the expiration da~e of Tentative Building Site -6- Approval on SDR-118. Commissioner Parden seconded. Carried SDR-118 Argonaut unsmimously. Shopping Center 2. Planning Commissioner Appointment Commissioner Higgins moved that Chairman Webster write a Appointment of letter to the City Council stressing the importance of Rl~ning Commissioner immediate .appointment of a new Pl~ing Commissioner.. Com- missioner P&rden seconded. Carried unanimously. 3. Village Redevelopment Plan Village Redevelopmerit Chairman Webster stated that the City Council Planning Com- Plan mittee was organizing meetings with the Saratoga Pierchants, the Public and the City to study the Village Redevelopment Plan. Bldg. Site 4. A general discussion was held regarding Planning Commission Approval Procedure Procedure regarding timing of action on Building Site Approval applications. Commissioner Anderson'suggested the City Administrator draw up a tentative schedule for handling these applications. 5. Off-Street Parking Ordinance Off-Street ~ ~ Parking Ord. C~mmtSs'i~ner Higgins discussed the need for a revision of the off-street parking ordinance. Commissioner Parden moved for adjournment at lO:O0 P.M. Com- missioner Bennett seconded.
