Co~lssioner ~isp seco~ed. ~ried un~ousl~. IX PUBLIC HEARINGS A. VARIANCE V-171 1. V-171 - W. H. Kelly Kelly Chairman webster opened the Public Hearing on V-171 at 7:20 P.M. Co-~nissioner Crisp stated, and Chairman Webster directed that the records show that denial would constitute a physical hardship, as the applicant, the Planning Department and the County Technicians have tried many designs, and no adequate design complying with Ordi~ance 3-A-8 depth requirement for Lot 6 could be found. Chairman Webster asked for statements from the public, but no one spoke for or against the variance. Commissioner Crisp moved that the request for variance from 140 ft. to 110 ft. depth, more or less, be approved for Lot 6, as shown on Exhibit "B" in file. commissioner Bennett seconded. Carried unanimously. III COMMITTEE REPORTS A. SUBDIVISION AND BUILDING SITE APPROVAL SD-191 1. SD-191 - Gresham Construction Company Gresham Const. Co. The Subdivision Committee Report dated June 9. 1960 was distributed to the Commissioners and the Applicant. Commissioner Anderson reviewed the report and the appli- cant stated that the conditions were satis[actory as presented. commissioner Anderson moved that SD-191 be approved, sub- 3ect to the thirty-one conditions listed on the Subdi- vision Committee Report dated June 9, 1960 and the approv- al apply to the revised tentative map dated June 10, 1960. Commissioner Crisp seconded. Commissioner Bennett moved to amend the above motion by adding as Condition No. 32 - "Revise lot lines at south- east corner of LOt 4 to~rovide 20 ft. radius turn on SD-191 Lot 3 corridor access at this corner", and that SD-191 Gresham Const. Co. be approved subject to the amended thirty-two conditions. Commissioner Anderson seconded. Carried unanimously. 8D-199 2. SD-199 - Town and Country Realty Town & country The Subdivision Com~ittee Report dated June 9. 1960 was distributed to the Ce~uissioners and Mr. George Somps, Engineer representing the applicant0 who stated the con- ditions were satisfactory. Commissioner Anderson read a letter dated June 9, 1960 from the Subdivision Committee to the Planning Commission concerning the background Of SD-199, formerly SD-192. Chairman Webster ordered that a copy of this letter be inserted in File SD-192 and File SD-199. Commissioner Crisp moved for approval of SD-199, subject to the twenty-nine conditions listed in the Subdivision Committee Report dated June 9, 1960, in accordance with the revised tentative map received June 1, 1960. Comm- issioner Anderson seconded. Carried unanimoue~. SD-206 4. SD-206 - Marie Rose Gaspar Gaspar The Secretary read a letter from Mr. Donald G. MacKay, Engineer. representing the applicant. granting extension from June 13 to a~ne 27. 1960. Chairman Webster ordered the matter continued to the next regular meeting. SDR-209 5. SDR-209 - A. ~ Dias Dias The Subdivision Committee Report dated June 10. 1960 was distributed to the Commissioners and Mr. Dan Palermo. representing the applicant. Mr. Palermo said he had questions about some of the con- ditions set forth in the Subdivision Committee Report. Chairman Webster suggested that he and Mr. Dias take the matter up with the City Administrator for clarification. Chairman Webster stated that if the conditions as written SDR-209 were followe~, the applicant can design his lot in ac- Dias cordsrice with the regulations for the C-S District. Commissioner ~risp moved ~ha~ SD-209 be approved subject to the twelve conditions as outlined in the SubdivisiOn Committee Report dated June 100 1960. Commissioner Anderson seconded. Carried unanimously. SDR-211 6. SDR-211- 'M. W. Hawks Fawks The Subdivision Committee Report dated June 10, 1960 was distributed to the Commissioners and the applicant. Mr. Hawks introduced his engineer, Mr. Robert Tower of the R. Fisher Engineering Co., and questioned Item No. 8 on the conditions. Chairman Webster suggested that this matter be taken up with Mr. Sweany of the County Public Works Department, who prepared that condition. Commissioner Anderson moved that SDR-211 be approved, subject to the ten conditions on the Subdivision Comm- ittee Report of June 9, 1960. Commissioner .Crisp second- ed. Carried unanimously. Commissioner Bennett voted yes with rese~vation, in order not to delay approval, suggest- ing now map be filed not showing access road referred to in Condition No. 8. Chairman ~qebster ordered that the records so show. SDR-212 7. SDR-212 - Sorensen & DUEas SoreriSen & DumaS Commissioner Anderson stated that the Subdivision Comm- ittee Report dated June 10, 1960 recommended denial, be- cause of disapproval by the Health Department. The Secretary read a letter from S. W. Sorensen and A. F. Dumas, requesting continuation to the next regular meet- ing. Chairman Webster ordered the matter continued as requested. IV REZONINGAPPLICATIONS C-26 1. C-26 - Sacred t~art C~urch Sacred Heart The Secretary read the Application for Change of Zoning of Church J. Cyril Johnson and the Roman Catholic Archbishop of San Francisco, dated May 20, 1960, and a letter from Mr. L. H. Loser Of Cyril Johnson's office, dated May 25, 1960. Con~nissioner Crisp moved that the Secretary be directed to set a public hearing on the application for rezoning No. C-26 at the earliest date possible. Commissioner Bennett seconded. Carried unanimously. C-27 2. C-27 - Ira Kirkorian Ira Kirkorian The Secretary read the Application for Change of Zoning of Ira Kirkorian. Commissioner Bennett moved that the Secretary be directed to set a public hearing on the application for rezoning No. C-27 at the earliest possible date. Commissioner Crisp seconded. Carried unanimously. V OLD BUSINESS A. Saratoga General Plan - Format of Publication General Plan Mr. Howe discussed with the Commissioners a letter dated May 27, 1960, from Livingston & Blayney, outlining two alternate formats for publication of the Saratoga General Plan. Commissioner Bennett moved that the Commission recommend adoption of Alternate "B" to the City Council, as shown in Livingston & Blayney's letter of May 27, 1960, and also recommend that the Council authorize purchase of an additional 500 copies of the condensed plan. Commissioner Crisp seconded. Carried unanimous- ly. VI PETITIONS & GRIEVANCES A. WRITTEN SDR-207 1. SDR-207 - Andre Bogart Bogart The Secretary stated that a letter had been received from Mr. Bogart, dated JUne 6, 1960, requesting reconsideration of conditions imposed by the Subdivision Committee Re- port of May 23, 1960. Saratoga School District School Site Chairman Webster read a letter fromMr. Daniel Ungaro, Superintendent of the Saratoga Union School District, requesting approval of a proposed 10 acre school site near Cox Lane. Commissioner Bennett moved that the ten acre site de- scribed in the letter of May 26, 1960 and shown on sketch attached to that letter be approved subject to Building ~-- Site Approval, satisfactory improvement plans and access roads. Commissioner Crisp seconded. Carried unanimously. Chairman Webster directed the Secretary to transmit this approval by letter to Mr. Daniel Ungaro, Superintendent of the Saratoga Union School District. Off-Street 3. Livingston - Re: Off-Street Parking Par~ing The Secretary read a letter from Lawrence Livingston, dated June 2, 1960, regarding the Off-Street Parking Ordinance. After discussion by the Cormnissioners, the Secretary was directed by Chairman Webster to transmit a letter to Commissioner Hlggins, before the next regu- lar meeting, requesting the changes he would propose in the Off-Street Parking Ordinance, and to followup with a telephone, call prior to the next meeting. Chairman Webster also directed the Secretary to distribute to the Commissioners a copy of Mr. Livingston's letter of June 3, requesting that their views be presented ln writing regarding the Off-Street Parking Ordinance No. 3-A-13, before the next regular meeting. SD-122 4. SD-122 - George Day George Day The Secretary read a letter from George S. Nolte's office dated June 9, 1960, requesting one year extension of ap- proval of tentative map for SD-122. Mr. George S. Nolte's representative, Mr. Kaermmerling, discussed the request with the Commissioners. Commissioner Bennett moved that extension be granted for a period of one year on the tentative map on SD-122. Commissioner Crisp seconded. Carried unanimously. B. ORAL Variance Variance Procedure Procedure -1. Commissioner Bennett discussed procedure on variances within subdivisions. Commissioner Anderson stated that City Administrator Howe had clarified this and that when tentative map is filed, the Subdivision Committee will consider any variance on map and approve both at the same time. Mr. Howe will get a ruling to clarify for public hearing on variances handled in this manner. New 2. New Planning Commissioner Plan. Comm. Commissioner Bennett moved that the Secretary be directed to send letters to the City Administrator and the City Council, stating that a new Planning Commissioner must be appointed immediately.
