TYPE: Regular Meeting I ROUTINE ORGANIZATION A. ROLL CALL Present: Anderson~ Bennett, Crisp, Glenn, HiEgins, Parden, Webster B. MINUTES Motion by Commissioner Glenn that the minutes of the meet- ing of Oc%ober 24, 1960 be approved as prepared and dis- tributed; seconded by Commissioner Anderson; motion carried unanimously. II PUBLIC HEARINGS Chairman Webster declared the ~ablic Hearings opened at 7:10 P. M. A. USE PERMITS Dr. R. M. Schumacher - Permission to move soil from one portion to another of Lot 55, Wildwood [{eights. This hearing was continued from the meeting of Octobe~ 1960. Secretary read a report from Director of Public Works, a copy having been distributed to each Commissioner, listing four conditions to be applied to the Use Permit. Dr. Schumacher appeared in his behalf and requested that Condition #2 be modified. Motion by Commissioner Crisp to approve UP-22 subject to the four conditions set forth in the Director of Public Works' memo dated November 9, 1960 Chali~nan Webster asked for further comments from the audi- ence. There being none,-'~e declared the Public Hearing on UP-22 closed at 7:30 P. M. Commissioner Parden made motion %o amend motion as follows: In lieu of Condition 2 as it now reads, substitute this wording..."the permittee shall take necessary steps to prevent errosion in the excavation as described in the application°" Seconded by Bennett; carried unanimously. Motion as amended: Use Permit 22 be granted subject to Conditions No's. 1, 3, and ~ of the Director of Public Works memo dated November 9, 1960, plus Condition 2 re- vised to read as follows: "The permittee shall take necessary steps to prevent errsalon caused by excavation described in the application." Ayes: All Noes: None Motion carried Chairman Webster co~ented that in the future it would be desirable rather than being specific, to recommend that the applicant be required to submit plans for appropriate retaining walls, slopes, ground cover, etc., to be aDDroved by the DFW and also to perform those conditions. Leave it up to the applicant and have it done by his engineer and be given City approval in site and subdivision matters. B. V-182 - Peck L. Herrick - Variance from 20,000 sq. ft. V-182 P.L. area for corridor access lot to 15,O00 so. ft. - Metrick Dr. Herrick Chairman Webster declared hblic Nearing open at 7:~O P.M. Secretary reported he had had a call from the spplicant's Attorney ~o advise he would be unable to be present at the hearing and asking for a continuance. Chairman Webster asked if anyone was present to represent applicant. Mr. Herrick appeared before the Commission to request a continuance in this matter until the next regular meeting. Chairman Webster orderad that the Public Hearing in the matter of V-182, P. L. Herrick, be continued until the next regular meeting. Public Hearing closed at 7:50 P. M. III CO~r~MITTEE REPORTS A. ARCHITECTUPIL AND SITE CONTROL 1. A-31 - San Jose Water Works landscaping plans - A-31 Vickery Avenue Reservoir. S.J.Water Works Commissioner Higgins stated %hat the landscaping plans as presented were very satisfactory except that some ground cover needs to be added to ~he Northeasterly slope; MT. Andrews of the San Jose Water Works was present and was in agreement with the suggestion. Motion by Commissioner Higgins that landscaping plans A-31 S~ £er the Reservoir as per application be approved with the addition that a ground cover be added to the north- east slope of the Reservoir, type to be determined by a landscape architect; seconded by Commissioner Glenn; motion carried unanimously. 2. A-32, A-33, A-3~, A-35 and A-36 Argonaut Shopping Commissioner Bennett continued report for Architectural Center Signs and Site Control Committee and asked that A-32, A-33, A-3~, A-35 and A-36 be considered as one since they are all located in the Argonaut Shopping Center and are re- quests for sign permits. He read a report from the Com- mittee and offered the same as a motion. After dis- cussion of the various sizes of the signs requested and study of the drawings of the Shopping Center, Chairman Webster asked for any ~urther comments on the subject. Motion made by Commissioner Bennett that applications A-32, A-33, A-3~, A-35 and A-36 be approved subject to the conditions stated in the report of the Architectural and Site Control Committee marked Exhibit "A"; seconded by Commissioner Glenn; motion carried unanimously. Chairman Webster asked that the record show Commissioner Higgins declined to vote. 3. SS-20 - Claude Lindsay, Inc. - Stellar Heights Subdivision SS-20 Stellar Commissioner Higgins reported he had examined the sign Heights Sign request, for a subdivision located 1¼ miles away from Saratoga, and since it is not a directional or subdiv- sion sign it would be classed as a billboard, which is prohibited by ordinance in Saratoga. He recommended that this sign not be approved. Motion by Commissioner Higgins that the request SS-20 be denied; seconded by Commissioner Parden; motion carried unanimously, and ~ application was denied. B. SUBDIVISION AND BUILDING SITES 1. SD-235 - Brown & Kaufmann, Subdivision on Cox Avenue near SD-235 Brown & Cox Lane. Kauffman -3 - Chairman Anderson presented a report from the Subdi- SD-235 Bro'~n & vision Committee which had been distributed to the Kauffmann Commission, listing 16 standard conditions. The Com- mission discussed the fact that the subdivision is lo- cated where the proposed Freeway intersects with Cox Avenue and conflicts with the right of way of the tele- phone company to lay cable. Mr. Kaemmerlin~ of George Nolte's Offic% appeared in behalf of the applicant and said that a report from the office of Ruth & Going for design of a street pattern was being studied, but that the matter involv- ing the Telephone Company right of way was too uncertain to be concerned about. Motion by Commissioner Anderson that SD-235 be approved subject to the 16 conditions of the Subdivision Commit- tee Report marked Exhibit "X" dated November 9, 1960; seconded by Commissioner Crisp. Chairman Webster: "Except that condition 14 is amended by substituting for the last two words the wc. rds 'fire district"' Motion carried unanimously. 2. SDR-239 - Barbara Caldwell -- i lot, Big Basin Way - SDR-239 R--4-H Caldwell Commissioner Anderson reported that the Committee had met with Mrs. Caldwell and she agreed to submit addi- tional topographical information and have the property inspected by the Flood Control District to determine feasibility of removal of barn in accordance with Conditions ss outlined in Subdivision Co~nittee Report dated October 21, 1960. Chairman Webster o~-dered that SDR-239 be continued un- til the next regular meeting and directed that the Zon- ing Administrator follow up on corrections on maps of Mrs. Csldwell and work wlth ~rs. Caldwell on bank lines for purposes of easement° 3- SD-242 - O. C. Cox - Subdivision Austin Wy. & Los Gatos SD-2~2 Saratoga Road Cox Conmissioner Anderson p~'esented report consisting of 17 cenditions wi~h suggestions for changes as follows: - 4 - Item 10 - delete the word "Saratoga" preceding fire dis- trict. Item 17 - change 'frontage' to conform with Ordi- nance 3A-~ and read 'site width., ~r. Gilbert appe~rd in behalf of the subdivider and dis- cussed the difficulties involved in fulfilling Condition 4- He was advised to report any unsurmountable difficul- ties to the Commission when they occurred. Motion by Commissioner Anderson approving SD-242 subject to 17 conditions with the changes in wording in Condi- tions lO and 17 as indicated on the official copy of the Subdivision Committee Report dated November 9, 1960, labelled Exhibit "A" and signed by Commissioner Anderson; seconded by Commissioner Glenn; motion carried unanimously. 4. SDR-2~5 - Robert Ross Walker, Jr. - i Lot - Vessing Road SDR-2~5 Mr. Reed, architect for Mr. Wal~er, appeared in behalf of Walker the applicant. Me was advised to review the plans for the proposed building before applying for a building permit, since the present plans violate the Ord. 3A-S. Motion by Commissioner Anderson that building site approval be granted subject to the 3 conditions and one comment set forth on the Subdivision Committee report dated Nov. 9, 1960 per copy siMned by Commissioner Anderson; seconded by Commissioner Higgins; motion carried unanimously. Chairman Webster welcomed CounciLnan Lan~vill to the Commission meeting. IV OLD BUSINESS A. REQUEST FOR EXTENSION OF USE PER3~IT 1. UP-15 - Saratoga Country Club & Golf Course UP-15 Saratoga Secretary read letter from Saratoga Country Club & Gol~ Country Club Course requesting an ex~nsion of Use Permit for nine monthc. Motion by Con~missioner Parden; secondod by Commissioner Higgins; that the Use Permi~ heretofore granted, File No. UP-15, be extended for a period of nine months from its present expiration date; motion carried unanimously. Del Ross appeared in behalf of the Country Club to thank the Commission for its action and said that the Chub expects to be able to apply for a building permit with- in 3 weeks. V N~ BUSINESS A. Argonaut Shopping Center - Parking spaces Argon- aut Chairman Webster read a communication from HiEgins & Shopping Center Root, Architects, regarding error in painting of park- ing spaces in Argonaut Place Shopping Center and ask- ing that they be allowed to post a bond to assure correction of this error within a 3-year period. Motion by Commissioner Glenn that the existing parking lot striping at the Argonaut Place Shopping Center be permitted to continue until passage of a new ordinance covering width of parking spaces or three years, whichever period is less, provided the owner of the facility posts a $2800 bond to insure compliance with the new ordinance when effective or the existing ordinance at the end of three years, whichever is less; seconded by Commissioner Parden; motion carried unanimously.
