Co~nissioner Webster arrived at 7:02 P,I4, and the Vice-Chairman turned the meetin8 to him. PUBLIC Chairman Webster declared Public !tearip4~s open for the eveurna at 7:03 P.I~I. A. C-41 -- Janes H. Claney, Prospect Avenue - Chan~e of Zonln~ iron R-l-lO~O00 to ~he Secretary advised that a lionice of Public lleartn~ had been published and thet Notices of Public HearinC had been nailed. There were no ~ritten cow~unications on file. A letter to the Santa Clara County Departneat of Public Works was read by the Secretary. Clancy further advised that they had o~med this property for uore than eleven (11) years. There was no one else present who wished to corinent reSarding this application. Con~_~issioner Bennett suggested that this uatter be continued until the first nesting in F~rch to allow additional tine for iuforaation concernin~ the precise plan line for the Lawrence Expressway. Chairman Webster observed that there seened to be no inconvenience involved in continuing the application, so directed C-41 continued until 7:00 P.N, on Narch 12, 1962. B. C-4._j2 -- H. C. Patrick, Prospect Avenue - Change of Zoning R-i-~O,000 to C-N , The Secretary advised that a Notice of Public Hearin8 had been published and that Notices of Public Hearin~ had been nailed. A letter iron Hr. and Nrs. Patrick was read by the Secretary. There were no other~rritten connunieations on file. NBS. H, G. PATRICK was present to discuss this application with the Comission. She stated 1) Leo Grilli*s property, recently rezoned, is adjacent 2) Subject property is no~ completely surrounded by coL~nercial zonin~ 3) Traffic is a probleu now and ~ettin~ worse 4) The Expressway plan line cannot be changed enough to have any ef£ect on subject property 5) ~roperty has lost all residential quality. *, NRS. JANES H. CLANCY spoke in Nrs. ~atrick*s behalf. She felt that N~s. Patrick*s property should be ~ezoned, even though her own application vas continued, since ~rs. Patrick's property was note directly affected by surroundin~ connercial developneat than he~ own. There vas no one else present who wished to speak for or aSainst this application. Connissioner Glenn reconnended that this natter be continued until the first neetin8 inN arch. On the basis of this recomnendation, Chairnnn~ebster directed C-42 continued until the neetin~ on Narch 12, 1962, iEnediately followin5 C-~1 which ~as continued until 7:00 P,N. on that date. C. UP-36 - Robert R. ~alker, Vessin~ Road - Use Permit for Private Stable for the keepin5 of One Norse The Secretary advised that Notices of Public Rearin5 had been nailed and a written communication had been filed in protest by T. J. Hattung. Hr. Walker was present to discuss this application further with the Comission, and was advised that the stable could not be approved in the area indicated since it did not conply with the Zoning Ordinance. - 2 - Planniu~ Co~nissie.n Minutes. - February 13~ 1962 - C.o..n't. They felt it would establish an uv~ersirable precedent for the area. HARLEY MILLAR, 18680 Vessina REad, stated that he had no objec- tion to a stable and one (1) horse. There was a notion by Connissioner Crisp, seconded by Comissioner Bennett, that the Public Hearing in connection with UP-36 be continued until the meetir~5 on February 26, 1962, and that a cocanittee be appointed to study this matter and 5ire a report at that usering; notion carried unantno_usly. Mr. %4alker advised that he would be out o£ town at that time and requested that his matter be continued until the meetir~ on Hatch 12, 1962. There was a notion by Comissioner Crisp, seconded by Corals- sinner Bennett, that the action previously taken be nodiliad by chan~in~ the date of the continued Public Bearin5 from February 26s 1962, to March 12, 1962; wtion carried uneniuously. J] Dusel, Pieduont Road - Variance from Side Yard Requ. irenents The Secretary advised that Notices of Public Hearin~ had been nailed and -~ written couuunication had been filed in protest by Mrs. Grace Richards. The Secretary read a Staff REport per- tainin8 to this application. The applicant was present and advised that the proposed house could not be moved because of the sewer line, an Oak tree and the steep slope of the lot. Frank Treseder, architect, explained the difficulty in re-desiSninB the house. The Variance Cornittee advised that ~hey had visited the site and aBreed that it would be difficult to nove the pro- posed house. After discussion, it was su~ested that Mr. Dusel try to obtain additionol property frou ltrs. Richards to allow the house to conforu to the Ordinance without a Variance.
